About this file

This is a Justification and Approval document for other than full and open competition (J&A) for a federal contract action.

The U.S. Army Corps of Engineers (USACE), Seattle District is requesting approval to increase capacity of the Northwestern Division's $75,000,000 Section 8(a) Small Business Set-Aside IDIQ MATOC for Preplaced Remedial Action Contracts by $10,000,000, raising the total from $75,000,000 to $85,000,000 (a 13% increase). The 2019 PRAC MATOC, which ended on June 4, 2024, is held by seven contractors: Bethel Tech, Brice AECOM, Innovex ERRG, Noreas APTIM, Northwind CDM, Olgoonik FPM, and SRS CAPE. The increased capacity will fund in-scope modifications to seven existing task orders and obligate unexercised reserved options under the MATOC. Services include hazardous, toxic, and radioactive waste (HTRW) remediation projects, environmental restoration activities under the Defense Environmental Restoration Program (DERP), and environmental compliance support across 15 states and EPA Region 2. The justification cites 10 U.S.C. 3204(a)(1) and RFO 6.103-1 as authority, noting that competition would be cost-prohibitive due to existing contractor familiarity with ongoing projects, mobilization costs for new contractors, and higher labor rates compared to the 2019 PRAC base year. A Notice of Intent was published on SAM.gov for 15 calendar days in accordance with FAR Part 6 procedures. The approval was authorized on June 13, 2026, by Curt D. Stepp, Contracting Officer for the Seattle District.
