Dear Prospective Quoter:
SUBJECT: Request for Quotation Solicitation Number 19CY6025Q0003 Fuel/Oil
Enclosed is a Request for Quotations (RFQ) for the Supply and Delivery of Fuel/Oil for Buildings and Residences of the Embassy of the United States of America in Nicosia.
If you would like to submit quotation, follow the instructions in Section 3 of the solicitation, complete the required portions of the attached document, and submit it to the address shown on the Standard Form 1449 that follows this letter.
The U.S. Government intends to award a contract/ indefinite quantity/indefinite delivery to the responsible company submitting an acceptable offer at the lowest price. We intend to award a contract/ indefinite quantity/indefinite delivery based on initial quotations, without holding discussions, although we may hold discussions with companies in the competitive range if there is a need to do so.
The Embassy intends to conduct a pre-quotation conference at the site, The pre-proposal conference will be held on December 19, 2024 at 1000 hours at the US Embassy Nicosia. Prospective offerors/quoters should contact NicosiaContracting@state.gov by December 16, 2024 for additional information or to arrange entry to the building.
Please submit your proposal, in an original and one (1) copy, in a sealed envelope marked "19CY6025Q0003" to the Contracting Officer, on or before January 16, 2025 noon to the following address:

An authorized representative of your company must sign all documents or the proposal may be considered non-responsive. This will be a firm-fixed-price contract with economic price adjustment and will not be adjusted due to fluctuations in the currency exchange rates.
NOTE TO OFFERORS:
Offerors must be registered in the SAM (System for Award Management) database at https://www.sam.gov prior to submittal of their offer/proposal as prescribed under FAR 4.1102.
Failure to be registered at time of proposal submission may deem the offeror’s proposal to be considered non-responsible and no further consideration will be given. Therefore, offerors are highly encouraged to register immediately if they are interested in submitting a response to this requirement.
Potential Contractors shall be in possession of all required permits and licenses to perform these services in Cyprus. Communication, correspondence and documentation must be in the English language.

I. Scope of Services
The Contractor shall provide and deliver high grade heating oil to the U.S. Embassy Nicosia, as described in this solicitation. The contract type will be a fixed price with economic price adjustment, indefinite quantity/indefinite delivery under which may be placed firm fixed-price delivery orders. The price of the contract will be based on the discount proposed by the contractor on the Average Monthly Price for Fuel/Oil issued by the Ministry of Commerce, Industry & Tourism on a monthly basis, less VAT and Custom Duties.

The price listed below shall include all labor, materials, insurance (see FAR 52.228-4 and 52.228-5), overhead, profit, and transportation necessary to supply and deliver the Fuel/Oil to the U.S. Embassy Nicosia. In consideration of satisfactory performance of all scheduled services required under this contract, the Contractor shall be paid a firm fixed-price for each delivery.
The Contractor shall be compensated upon receipt of a proper invoice for all deliveries made under delivery orders.
II. VALUE ADDED TAX
VALUE ADDED TAX. Value Added Tax (VAT) is not applicable to this contract and shall not be included in the rates or Invoices as the U.S. Embassy is VAT exempt from the host government and shall prepare a VAT Exemption Certificate for the Contractor.

SCHEDULE OF SUPPLIES/SERVICES, BLOCK 20
DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
I. Scope of Work
For each year of the contract, the U.S. Government guarantees a minimum order of 15,000 liters of diesel fuel/oil and 3,000 kerosene fuel/oil. The maximum amount of fuel ordered under each year of the contract shall not exceed 350,000 liters.
The Contracting Officer may issue oral orders that will be confirmed in writing.
The fuel provided will be diesel/kerosene. For supply and delivery of the fuel/oil, the Contractor shall be paid the fixed price per unit as listed above. This price is not to exceed any official rate, as set by laws enacted by the Government of Cyprus.
A. Ordering:
The U.S. Government will submit (electronically) to the Contractor, a list describing in detail the delivery points, indicating Building ID number, authorized person to accept delivery, exact address, Postal Code, tank capacity and any peculiarities regarding delivery points approachability i.e., long hose, terrace tank etc.
The authorized U.S. Government’s representative will call the Contractor from between 08:00 to 16:00 hours Monday through Friday and will place order(s) mentioning the Building ID number assigned by the U.S. Government, required quantity, date and time. The U.S. Government’s representative will combine orders if possible, around the same directional route and provide them collectively to the Contractor.
B. Delivery:
Delivery must be executed within 48-hours from the date of placing the order, between the hours of 08:00 to 16:00, Monday through Friday, except all Cypriot & American holidays. In case of an emergency, the Contractor shall deliver fuel/oil within a 24-hour advance notification, if requested. The Contractor shall promptly deliver the oil by tanker truck on the dates and times that are specified on delivery orders issued under the contract. Any Contractor personnel involved with the delivery of the oil shall comply with Embassy regulations for receiving supplies. The Contractor will have to carry the necessary protective equipment (i.e. safety shoes, fire extinguisher) and will be responsible to clean any fuel/oil spillage that might be created in the premises during the delivery. The Contractor should comply with all the environmental and health and safety rules and regulations that applying. The Contractor shall be required to provide one driver and an assistant for the delivery and monitoring of the fuel. The Contracting Officer's Representative (COR), will be responsible for instructing contractor personnel at the time deliveries are made and will arrange for Embassy personnel to be on site for verification of
Heating Fuel/Oil Solicitation No. 19CY6025Q0003 Page 7 amount delivered. The driver of the tanker truck must submit a waybill to the responsible employee for approval at the time delivery is made.
C. Invoicing:
Designated Billing Office. The Contractor shall submit to the designated billing office invoice(s) for all services under this contract at the following address:

Invoices must include the contract and delivery order numbers and will be checked/matched with respective delivery tickets, delivery order, and processed for payment. If a delivery ticket is missing, the Contractor agrees to provide a copy, when requested.
In case of quantity discrepancy, the Contractor agrees to issue a credit note for the quantity discrepancy and the U.S. Government will reimburse the Contractor only for the quantity received.
D. Customs Duties, Taxes and Fees:
1. The contract prices include all expenses incidental to delivery of the specified products (transit prices), exclusive of Cyprus Government customs duties and fees. The U.S.
Government will furnish to the Contractor as soon as possible all documents required for clearance, free of customs duties, taxes and fees, of petroleum products under this contract. However, Customs Clearance formalities will be the Contractor’s responsibility.
2. The U.S. Government is exempt from the payment of any taxes and duties and agrees to furnish the Contractor the relevant Tax Exemption Certificate issued by the Ministry of Finance.
E. Price Adjustment:
(a) The unit price per liter may be adjusted based on increases or decreases in the official price of diesel/kerosene fuel/oil as submitted to the oil companies by the Government of Cyprus, Ministry of Commerce, Industry & Tourism, on a monthly basis.
(b) To request an adjustment in price, the Contractor must provide written notification of the price change to the Contracting Officer immediately upon notification from the Government of Cyprus, Ministry of Commerce, Industry & Tourism, of the new average market price. This notification must be accompanied by a copy of the official announcement of the price change, showing the average price of the month. The officer or general partner of the Contractor having overall responsibility for the Contractor's affairs shall certify the submission by written signature.

(c) The U.S. Government will make no adjustment to the contract price that relates to any wages, overhead, fixed costs, general and administrative expenses, materials, or profit. Only the amount which is a direct result of an increase or decrease in the price of oil to be delivered under this contract shall be considered by the U.S. Government as the basis for contract price adjustments.
(d) The Contractor may not request an adjustment under this clause after final payment has been made under this contract.
(e) This clause shall only apply to laws enacted by the government of Cyprus which meet the criteria set forth above. The U.S. Government will make no adjustments in contract price due to currency devaluations or fluctuations in exchange rates.
F. Quality Assurance and Surveillance Plan (QASP)
This plan provides an effective method to promote satisfactory contractor performance. The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract.
The role of the Government is to monitor quality to ensure that contract standards are achieved.
Performance Objective Scope of Work Para Performance Threshold Services.
Performs all fuel oil services set forth in the scope of work.

G. Insurance:
1. AMOUNT OF INSURANCE. The Contractor is required to provide whatever insurance is legally necessary. The Contractor shall, at its own expense, provide and maintain during the entire performance period the following insurance amounts:

3. The types and amounts of insurance are the minimums required. The Contractor shall obtain any other types of insurance required by local law or that are ordinarily or customarily obtained in the location of the work. The limit of such insurance shall be as provided by law or sufficient to meet normal and customary claims.
4. For those Contractor employees assigned to this contract who are either United States citizens or direct hire in the United States or its possessions, the Contractor shall provide workers’ compensation insurance in accordance with FAR 52.228-3.
5. The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to:
• any property of the Contractor,
• its officers,
• agents,
• servants,
• employees, or
• any other person,
• arising from and incident to the Contractor's performance of this contract. The
Contractor shall hold harmless and indemnify the Government from any and all claims arising, except in the instance of gross negligence on the part of the Government.
6. The Contractor shall obtain adequate insurance for damage to, or theft of, materials and equipment in insurance coverage for loose transit to the site or in storage on or off the site.
7. Government as Additional Insured. The general liability policy required of the Contractor shall name "the United States of America, acting by and through the Department of State," as an additional insured with respect to operations performed under this contract.
8. Time for Submission of Evidence of Insurance. The Contractor shall provide evidence of the insurance required under this contract within ten (10) days after contract award. The Government may rescind or terminate the contract if the Contractor fails to timely submit insurance certificates identified above.

The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
