About this file

This is an Express NDAA Certification form issued by the United States Department of State to collect representations from vendors regarding compliance with Section 889 of Public Law 115-232 (John S. McCain National Defense Authorization Act for Fiscal Year 2019). The form is a template used by the Department of State to ensure contractors meet federal requirements regarding covered telecommunications equipment and services in federal procurements.

The certification requires vendors to provide Yes/No representations on four specific compliance matters: (1) that the offeror does not provide covered telecommunications equipment or services as a substantial or essential component or critical technology within any system in violation of Section 889(a)(1)(A); (2) that the offeror does not use covered telecommunications equipment or services within its enterprise as defined in Section 889(a)(1)(B); (3) that the offeror has conducted a reasonable inquiry to identify producers or providers of covered telecommunications equipment or services used by the entity; and (4) that the offeror will report to the Government if it identifies covered telecommunications equipment or services during contract performance. The form requires completion and signature by an authorized representative of the merchant and must be returned to the Contract Specialist. Vendors are directed to review FAR provisions 52.240-90 and clause 52.240-91 prior to completing the representation.
