B.4 Economic Price Adjustment
B.4.1 Premium Adjustment based on Experience - For health insurance, prices may be adjusted upward or downward based on the experience rating of the Mission(s) covered by this contract. No adjustment will be allowed during the first twelve months. After such time, the Contractor or the Government may request an adjustment in premiums, on an annual basis. Before any such adjustment is made, the contractor shall provide the Government a balance sheet (relatório de sinistralidade) showing two main components for the time period: (1) receipts (premiums received) minus the (2) claims paid (sinistro x prêmio), considering that the technical limit (limite técnico) is 75% of the premiums paid. The reevaluation of the premiums paid can be done every year. One of such adjustment (if approved) must coincide with the adjustment based on laws (B.4.2).
The Government reserves the right to have an independent third party review the balance sheet and make recommendations regarding the appropriateness of the requested adjustment. Any adjustment shall be subject to mutual agreement of the parties and shall result in a written modification to the contract. Any failure to reach agreement under this clause shall be subject to the procedures in the Disputes clause - FAR 52.233-1, Disputes (Jul 2002) Alternate I (Dec 1991).
B.4.2 Premium Adjustment Based on Laws - The rates may also be adjusted during the performance period of the contract as a result of laws enacted by the host Government, if such change in the laws has a direct impact on the cost to the Contractor to perform this contract at the contracted rate. In that event, the Contracting Officer may enter into negotiations with the Contractor to modify the contract to adjust the premium rate. No adjustment shall be allowed during the first six months of the contract. After this period, the Contractor may request adjustment in premiums provided that the Contractor presents documentation that clearly supports the requested adjustment. Any adjustment shall be subject to mutual agreement of the parties and shall result in a written modification to the contract.
SECTION C
DESCRIPTION/SPECIFICATION/WORK STATEMENT
PART I - HEALTH INSURANCE
C.1 Health Insurance Services
The Government of the United States of America requires Health Insurance coverage for its employees and dependents as further described in C.1.1, in Brazil.
The Government has determined that the prevailing practice by employers in Brazil is to provide health insurance protection for their employees. Health insurance protection will be representative of locally prevailing compensation practice as further described in C.1.1.
The enrollment in the health insurance plan is an option for employees who may elect any of the three proposed categories of health insurance plans. The cost of such insurance protection will be borne by both the employee and the employer. The Government shall pay a fixed amount (90%) of the standard plan for employees/dependents. The difference in costs for extended coverage plans will be at the employee’s personal expense, paid through the Government. The numbers provided in section B.2 correspond to the present number of employees and dependents enrolled in the current health plan. These numbers can either increase or decrease depending on proposed price and coverage.
At the time of a covered employee's death, his/her eligible dependents covered under post's medical plan and as designated in the official personnel file, are eligible to temporarily continue receiving the same level of medical coverage for up to 180 days. This continued coverage is limited to 180 days only, is subject to availability of the funds at post, and no extensions are possible.

Any other laws related to health insurance services shall immediately be incorporated to this contract, except for reductions in benefits. In all cases, the contract prevails.
