ATTACHMENT 1

TECHNICAL SPECIFICATIONS

48 Z coatings on wood, metal, masonry, plaster, concrete, light weight panels

The following Statement of Work is partly based on LB building construction LB-HB, Version 21, along with LG 48 and has specifically been adjusted to fit the requirements of the U.S. Tri Missions

Vienna.

If not quoted differently, the ÖNORM B2230, part 1 and 3, shall apply.

Scale determination:

Basically, the contractor is aware of all instances of difficulties from construction site visits and/or inspection of plans, photos and so on before submission of a bid. If there are still any open issues the contractor will clarify them with the customer before submittal of quotation.

Scale determination subject to ÖNORM only applies if circumstances of difficulties are unknown.

If the ÖNORM specifies the architecture intermediate space and such is not present (e.g. hallway windows), the dimensions of the passage opening are added by an additional 10 cm.

If a window consists of wings, whose total glass surface per wing would produce different factors, then the architecture intermediate space has to be divided accordingly (e.g. middle impost, middle centerpiece).

Box-type windows, single pane or with laminated safety glass paned wings, are allocated with the factors for simple windows; insulating glass paned wings are charged with the factors for insulating glass windows. If counter-sash windows exhibit a layer of insulating glass and another layer of simple glazing, then the layers are charged separately with the different factors for insulating glass windows and standard windows.

Muntin lengths are measured within the glass intermediate space between wing frames. Measurement is made across muntin intersections.

Surfaces with frieze and filling, including recessed or fitted strips, are considered molded work pieces.

Work pieces, whose edges were treated with a grain plane, as well as quarter-round, convex edges, are considered non-molded. Quarter-round, concave edges are considered molded. Work pieces with simple glass or cover strips are considered molded work pieces if the setoff or projection of these strips is larger than 6 mm.

Paint – coating:

To embrace multifarious application methods, the word “coating” is used instead of “paint”.

Material selection:

The used materials must adhere to the pertinent Austrian (Ö-Norm) and European (EN-Norm) standards. The materials may only be handled system conformably. Environmentally friendly, ecologically harmless coating materials (like reduced solvent or solvent-free, emollient-free and reduced emission or emission-free coating substances), are to be used whenever technically possible.

Evidence of this has to be provided. Reference notes from safety data sheets and technical bulletins for the employed materials are to be followed.

Material composition - compatibility

The contractor will unrequitedly demonstrate the compatibility of all components in a coating composition if they do not all originate from the same manufacturer. The contractor is liable for the compatibility of new coating material with any remaining old coatings during repair work.

Impregnation – priming/undercoat:

In case that impregnations and/or undercoats have been undertaken by any other skilled craftsmen, the contractor checks their compatibility with his stated coating programs (coating systems).

Completion of the coatings:

ÖNORM B 2230 parts 1 and 3 define the concepts of simple, standard, and high value execution.

Window wings and door leaf coatings in the hung-in position only occur upon customer's approval.

The surfaces to be coated are professionally sanded (matt) and dusted. All individual work processes to complete the coatings adhering to ÖNORM standard are included in the unit price. Furthermore, all additional expenditures exceeding the ones in the ÖNORM standard have to be included if EN-norms, safety data sheets, material specifications or technical bulletins specify subject performances.

Walls /flat soffits (ceilings):

If not stated otherwise, unit prices are calculated without distinguishing whether services are rendered on walls and/or flat (horizontal or aslope) soffits (ceilings).

Surface coating system:

All individual work processes for completion of the coatings adhering to ÖNORM standard are included in the unit price. All additional expenditures exceeding the ones in the ÖNORM standard have to be included if EN-norms, safety data sheets, material specifications or technical bulletins specify subject performances.

Subsurface preparation:

Cropping and cleaning to remove mortar spots, impurities (like dust, soot, grease, chalking components,…) as well as spackling, which is the professional closing of insignificant damages with a putty of up to 7 cm width using an appropriate material suitable for the subsurface and the subsequent coating, is included in the unit price.

Color:

Unless stated otherwise, all coatings are calculated for white or off-white according to the customer’s choice (one color per room).

Multi-layer coating system, coating execution:

The contractor guarantees the compatibility of the used coating substances among themselves. Any possible manufacturer processing guidelines for the used products are followed and considered part of the contract. Any necessary absorption compensation measures during coating completion, depending on coating substance and manufacturer, are included in the particular line items. (Primary coating/treatment for stabilization of sanded or too soft subsurface is not affected by this – separate line item).

Processing (shearing) of subassemblies and color tones:

Processing (shearing) of subassemblies, meaning either processing of material boundaries (e.g. with socket strips or coverings that are not being removed) or producing straight-line color strokes on surfaces, in room corners or along subassembly edges with two or more colors has to be included in the particular line items.

Even on walls or level soffits (ceilings), this task is already included in the described main tasks for baseboards and wainscoting.

Coating substances – selection:

The used materials must adhere to the pertinent Ö-norms and EN-norms. The coating materials may only be handled system compliant. Environmentally friendly, ecologically harmless coating materials

(like reduced solvent or solvent-free, emollient-free and reduced emission or emission-free coating materials), are to be used whenever technically possible. Evidence has to be provided. Directions from safety data sheets and technical bulletins of the used materials are to be followed.

Anti-mold execution (fungicidal coatings):

Harmful fungicides like mercury interfaces are not used. Any applicable certificates have to be presented upon the customer’s request.

Production site:

The unit price applies unchanged regardless of where the services are to be provided; for example, whether the service is provided in the contractor's workshop or at the construction site. (The customer’s directive is crucial.) Unhinging and hinging, dismantling and assembling windows and door leaves, as well as any other necessary manipulation have to be included in the unit price.

Disposal:

Legal regulations (primarily the waste management law AWG and the regulation concerning separation of materials incidental to construction activities) are to be complied with. Furthermore, the disposal standards of the particular disposal company regarding trash separation and the like are to be followed. All related expenditures (like loading, removal, handling, etc.) are to be included in the price. The contractor shall provide disposal confirmation upon the customer’s request.

Completion:

Acceptance of the work only occurs upon written completion report and inspection by the U.S.

Embassy.

Warranty – Damage compensation

The regulations of the “Österreichisches Allgemeines Bürgerliches Gesetzbuch” shall apply.

Contractor’s insurance coverage – Third Party Liability Insurance

Upon the request of the U.S. Embassy the contractor shall provide evidence of Third Party Liability

Insurance for all his employees or any other assigned personnel as well as subcontractors at a minimum insurance amount of € 2,000,000. Subject Third Party Liability Insurance also applies for damages caused to the environment caused by the contractor.

48.00 Z Additional contract provisions

480001 Z The offered materials and their composition are tested by an accredited test and inspection agency on suitability for the stated intended purpose. The suitability test encompasses: weather ability - physical endurance of environmental influences – light resistance, particularly loss of luster, chalking, yellowing, and color shade consistency

– durability – adhesion and spread ability – resistance to ordinary household cleaning substances – restorability – recoat ability - water vapor permeability (only for wood coating).

480004B Z Color and degree of gloss in accordance with pre-existing material

If not stated otherwise, the contracted coatings are to be executed in the same color and degree of gloss as the pre-existing material.

480006A Z Coating thicknesses for metal coating

The nominal layer thickness for each individual coating on external subassemblies amounts to 40 µm when coating metal. In case of multi-layer coatings intermediate layers shall be easily distinguishable by tinting. Ö-norms and EN-norms are to be considered.

480007A Z Material and execution tests

The contractor is obligated to make the samples required for the material tests available free of charge. When taking samples, the worker provides the requested sample quantity from his usage container. If the customer executes other tests like cross-hatch adhesion tests, or cuts to check the number and thickness of applied coatings, the places damaged by the tests are restored without separate compensation.

480008A Z Reference surfaces

The customer will define representative reference surfaces for the totality of the surfaces to be processed before execution of the work if specifically directed. Reference surface processing occurs as quoted, but each work step is executed in the presence of a customer representative. The contractor and the customer will establish and sign a protocol concerning the initial condition, pre-treatment, individual work steps and the used materials. Execution of the remaining surfaces has to be at least equivalent to the execution of the reference surfaces.

480009A Z Preparatory work executed by other skilled craftsmen

During repair work, the contractor takes care that all subassemblies are repaired by the appropriate skilled craftsmen (carpenter, locksmith, glazier etc.) before beginning the coating work. Furthermore, the contractor assures that the fittings have been made accessible after this repair work, the glazing including the putty or the glass strips are alright, and the wooden parts repaired by the carpenter are not covered with inordinate amounts of putty. New or entirely stripped parts that are exposed to weathering and dampness must have been impregnated or pre-treated with corrosion protection. The contractor will inform the skilled craftsmen of the materials to be used in a timely manner. Incorrectly repaired subassemblies are not treated and the customer will be notified in writing.

Greater or lesser costs associated with the possible rendering of services outside the construction site are included in the quoted prices.

4801 Z Preliminary work

Covering of furniture- moving of furniture

The coverings are at the option of the contractor and only refer to the protection of the referenced parts of the building or objects for the duration of and for the nature of his own service. They are removed immediately after completion of the contractor's service. Coverings for baseboards, railings, handrails, lighting fixtures, switches, walls, soffits, windows and doors, strip sockets, etc.) have to be included in the particular line items.

The same applies for the removal and re-positioning of moveable furniture such as armchairs, tables, and jalousies.

Disposal of residual construction materials

Disposal encompasses the necessary loading, transportation, utilization, incineration, treatment, and dumping in compliance with all legal regulations. The contractor takes care of the appropriate sorting and interim storage of all waste materials guaranteeing an economical and environment friendly disposal. (Waste Management Law, AWG).

Confirmation of proper disposal pursuant to the governing laws and regulations has to be proved by invoice upon the contractor’s request. These costs have to be included in the unit price.

If furniture is not removed or covered on site, it has to be protected with suitable covering material. Removal and disposal of covering material after task completion is also included in the price. The extent of the subassemblies to be protected has to be billed.

The individual preparatory work line items are calculated with an average unit price dependent on the damage determination. Disassembly and reassembly of window and door handles have to be included in the relevant line items.

Disposal encompasses the necessary loading, transportation, salvage, incineration, treatment, and dumping in compliance with all legal regulations. In the process, the contractor takes care of the appropriate sorting and interim storage of all waste materials guaranteeing an economical and environmentally friendly disposal. Confirmation of orderly disposal pursuant to the governing laws and ordinances is produced at the client’s demand with the invoice attached. These costs are included in the unit prices.

Impregnate raw wood parts colored or colorless (with wood preservative in the exterior area), clean corrodible metal parts and furnish them with an undercoat

Mechanical cleaning of the surfaces (resulting in a stable subsurface). Spackle small holes and cracks as far as possible with a 7 cm painter’s spatula with an appropriate material for the subsequent coating. Eventually treating (primary coating) and repeatedly coating with a suitable coating material technically adapted to the existing façade coating (diffusion, water absorption, etc.). Color to be determined by the customer.

Wherever the technical requirements are given, a silicon resin coating (water permeability W3, moisture flow rate density V1 according to ON EN 1062) is to be applied.

Time-based services are only performed if specifically ordered in individual cases by the customer even if provided for in the contract (statement of work).The performed hours, used appliances, transportation services and used materials are entered daily in the overhead log and are to be presented to the customer for countersignature.

The regulations to request unit price revisions based on quantity changes are not applicable to overhead expenses.

The cited occupation groups correspond to the collective bargaining agreement. Prorated tolls, travel allowances and fringe benefits have to be calculated. Charged are only working hours actually spent at the work or assembly site, the smallest unit is the started half hour.

Independent of the qualification of the personnel actually assigned to perform the services, only those wage groups are charged sufficient to fulfill the requested service.

Any required material necessary to perform subject services has to be defined at the time of inspection of a property and will be reimbursed at cost only upon presentation of the applicable invoice.
