Dear Prospective Quoter:

The Consulate General of the United States of America in Sydney, Australia invites you to submit a quotation for janitorial services.

We will conduct a site visit and pre-proposal conference. See Addendum to Section 3 for date, time, location, and pre-registration information.

The U.S. Government intends to award a contract/purchase order to the responsible company submitting an acceptable offer at the lowest price. We intend to award a contract/purchase order based on initial quotations, without holding discussions, although we may hold discussions with companies in the competitive range if there is a need to do so.

Quotations will only be accepted electronically. Hardcopy quotations will not be accepted. Electronically submitted quotations shall be e-mailed to SYDAccounts@state.gov by 5:00PM on Wednesday, February 24, 2021. No quotations will be accepted after this time.

1. PRICES AND PERIOD OF PERFORMANCE

The Contractor shall perform janitorial work, including furnishing all labor, material, equipment, and services, for the U.S. Consulate in Sydney, Australia. The price listed below shall include all labor, materials, insurance (see FAR 52.228-4 and 52.228-5), overhead, and profit. The Government will pay the Contractor, upon satisfactory performance, the fixed price per month for standard services, a fixed rate per square meter for temporary additional services, and a fixed rate per square meter for disinfection services.

After contract award and submission of acceptable insurance certificates, the Contracting Officer shall issue a Notice to Proceed. The Notice to Proceed will establish a date (a minimum of fifteen [15] days from start date listed in Notice to Proceed unless the Contractor agrees to an earlier date) on which performance shall start.

Because Temporary Additional Services and Disinfection Services are based on indefinite delivery/indefinite quantity, the minimum and maximum amounts are defined below:

Minimum: The Government shall place orders totaling a minimum of 100 square meters for temporary additional services and 100 square meters for disinfection services. This reflects the contract minimum for the base year and each option period.

Maximum: The amount of all orders shall not exceed 20,000 square meters for temporary additional services and 20,000 square meters for disinfection services. This reflects the contract maximum for the base year and each option period for temporary/additional services.

The performance period of this contract is from the start date in the Notice to Proceed and continuing for twelve (12) months, with four (4) one-year options to renew. The initial period of performance includes any transition period authorized under the contract.

1.1 GOODS AND SERVICES TAX & CURRENCY USED

1.1.1 Goods and services Tax (GST) is not included in the Contract Line Item Number (CLIN) rates. Instead, it will be priced as a separate Line Item in the contract and on Invoices. Local law dictates the portion of the contract price that is subject to GST;

this percentage is multiplied only against that portion. It is reflected for each performance period. All portions of the solicitation are subject to GST.

1.1.2 A quoter may elect to submit its quotation in either U.S. Dollars (USD) or Australian Dollars (AUD). The quoter must clearly indicate whether the currency used in its quotation is USD or AUD. To permit a fixed standard of comparison among offers, any quotations submitted in USD will be converted to AUD using the USD:AUD exchange rate established by the U.S. Department of State’s Bureau of the Comptroller and Global Financial Services on the dates noted in FAR 52.225-17, which is provided in full text in the addendum to evaluation factors.

1.1.3 The awarded vendor must invoice, and will be paid, in the currency in which it submits its quotation.

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

1. SCOPE OF WORK

The purpose of this fixed price contract is to obtain janitorial services for real property owned or managed by the U.S. Government in Sydney, Australia. The Contractor shall perform janitorial services in all designated spaces including, but not limited to halls, offices, restrooms, work areas, entrance ways, lobbies, storage areas, elevators, kitchens, maintenance areas, exterior areas, and stairways. The contract will be for a one-year period from the date of the contract award, with four (4) one-year options.

The Contractor shall furnish all managerial, administrative, and direct labor personnel that are necessary to accomplish the work in this contract. Contractor employees shall be on site only for contractual duties and not for other purposes.

1.1 General Instructions

The Contractor shall prepare general instructions for the work force. The Contractor shall provide drafts to the Contracting Officer's Representative (COR) for review within thirty (30) days after contract award. The Contracting Officer’s Representative must approve these general instructions before issuance.

1.2 Duties and Responsibilities

1.2.1 Certain areas listed in paragraph #3 require an escort and can only be entered during scheduled times. The general instructions shall emphasize security requirements so that accidental security violations do not occur.

1.2.2. Contractor shall schedule routine cleaning requirements to ensure that these are done in the order and time frame that are most efficient and have the least impact on normal operations.

1.2.3. Contractor shall schedule periodic cleaning requirements so that it causes minimal disruption to the normal operation of the facility. The COR shall determine the schedules presented which meet the needs of the individual facility.

1.2.4. Temporary Additional Services are janitorial-type services that are requested to occur in supplement to the schedule listed in Section 2.1 and/or at U.S. Government owned or leased locations other than the U.S. Consulate Office Building. These services shall support special events at the Post or purposes identified by the COR. The Contractor shall provide these services in addition to the scheduled services specified in this contract. The COR shall order these services on an as needed basis. This work shall be performed by Contractor trained employees and shall not be subcontracted. The COR may require the Contractor to provide temporary additional services with 24-hour advance notice.

1.2.5 Disinfection Services are services intended to kill pathogenic material (e.g. bacteria, fungi, protozoa, viruses, and prions) on surfaces to lower the risk of spreading infection.

The Contractor shall provide these services in addition to the standard services specified in this document. The COR shall order these services on an as needed basis. This work shall be performed by appropriately trained individuals and, if necessary to obtain properly qualified personnel, may be subcontracted. The COR may require the Contractor to provide disinfection services with 24-hour advance notice.

1.2.6 When temporary additional services and/or disinfection services are required, the Contractor shall include, in its next regular invoice, details of the temporary additional services and/or disinfection services. The Contractor shall also include a copy of the COR’s written confirmation for the requested services.

2. SCOPE OF WORK (CONTINUED) – DESCRIPTION OF SERVICES)

2.1 Standard Services - The following services are considered “standard services” and must be performed on regular Consulate working days between 0800 and 1700.

2.1.1 Daily (or Near-Daily, as specified) Cleaning Requirements shall consist of:

2.1.1.1 Sweeping all floor areas including damp mopping of areas such as tile, rubber tiles, terrazzo floors, wooden flooring, and public areas. Floors shall be free of dust, mud, sand, footprints, liquid spills, and other debris. Chairs, trash receptacles, and easily moveable items shall be tilted or moved to clean underneath.

The frequency for high-traffic areas, such as the visitor screening facility, consular waiting room, kitchenettes, and work rooms, shall be daily. The frequency may be higher than once per day when it is rainy or water intrusion occurs. When completed, the floor and halls shall have a uniform appearance with no streaks, smears, swirl marks, detergent residue, or any evidence of remaining dirt or standing water.

2.1.1.2 On the ground floor, dusting and cleaning all furniture including desks, chairs, credenzas, computer tables, counters, telephone tables, bookshelves with or without glass doors, coat racks, umbrella stands, pictures, maps, telephones, computers and screens, lamps, and other common things found in an office environment. All furniture shall be free of dust, dirt, and sticky areas.

2.1.1.3 Thorough cleaning of kitchens, toilets, bathrooms, countertops, sinks, and mirrors using suitable non-abrasive cleaners and disinfectants. All surfaces shall be free of grime, soap scum, mold, smudges, and visible soiling of any type. The Contractor shall check those areas, particularly bathrooms used by personnel visiting the consulate, several times daily to ensure that the facilities are always clean and neat.

2.1.1.4 Refilling paper towels, toilet paper, tissue, toilet seat covers, hand soap, and dishwashing liquids in all bathrooms and kitchenettes as needed.

2.1.1.5 Emptying all trash receptacles in the visitor screening facility, consular waiting room, kitchenettes, bathrooms, conference rooms and workrooms and, if needed, washing or wiping them clean with a damp cloth, replacing plastic wastepaper basket linings and returning items where they were located. Trash receptacles in high-trafficked areas may need to be emptied more than once per day.

Trash receptacles in other areas may be emptied less frequently, such as when filled or when potentially malodorous items are present.

2.1.1.6 Removing trash to designated area as directed by the COR and keeping the trash area in a reasonably clean condition.

2.1.1.7 Cleaning the elevators and elevator lobbies, including sweeping, mopping, handrail cleaning, cleaning the walls, and cleaning touch points like floor call buttons, door open/close buttons, etc.

2.1.1.8 Cleaning interview windows, document pass-through trays, and counter surfaces in the Consular waiting room on Level 5.

2.1.2 Weekly Cleaning Requirements shall consist of:

2.1.2.1 Sweeping and mopping emergency stairwells and the exterior Level 10 terrace. The COR may also request that such services be conducted in supplement to this schedule if surfaces are visibly soiled or occluded and waiting for the next scheduled cleaning would result in unsightly or unsafe conditions.

2.1.2.2 Vacuuming all rugs and carpets, entry mats, runners, and carpet protectors so that they are free from dust, dirt, mud, etc. When completed, the area shall be free of all litter, lint, loose soil, and debris. Any chairs, trash receptacles, and easily moveable items shall be moved to vacuum underneath, and then replaced in the original position. Vacuuming services may also be required on an as-needed basis upon direction of the COR.

2.1.2.3 Cleaning interior windows at or below arm’s length in the Consular waiting room on Level 5.

2.1.3 Bi-weekly (Fortnightly) Cleaning Requirements:

2.1.3.1 On floors other than the ground floor, dusting and cleaning all furniture including desks, chairs, credenzas, computer tables, telephone tables, bookshelves with or without glass doors, coat racks, umbrella stands, pictures, maps, telephones, computers, televisions, monitors, screens, lamps and other common things found in an office environment. All furniture shall be free of dust, dirt, and sticky surfaces and areas.

2.1.4 Monthly Cleaning Requirements shall consist of:

2.1.4.1 Dusting windowsills and blinds.

2.1.4.2 Cleaning the interior and exterior of microwave ovens, toasters, hot water kettles, and other Government-owned benchtop appliances.

2.1.4.3 Cleaning all interior window glass, glass partitions, and glass walls not otherwise indicated for more or less frequent cleaning.

2.1.4.4 Emptying or exchanging sanitary bins for feminine hygiene products. This service may be subcontracted. The Contactor and/or subcontractor is required to provide all supplies necessary for this service, including bins and liners. If this service is subcontracted, the Contractor will be responsible for obtaining entry permission for subcontractor personnel from the Regional Security Officer prior to each instance of service and for escorting subcontractor personnel during the conduct of the service.

2.1.5 Quarterly Cleaning Requirements shall consist of:

2.1.5.1 Spot cleaning baseboards.

2.1.5.2 Cleaning major appliances (e.g. refrigerator, dishwasher) inside and out including vacuuming dust from around motor areas. The Contractor shall remove all food items from refrigerators, clean and sanitize the inside, and replace the food articles after cleaning.

2.1.5.3 Dusting and wiping light fixtures and wooden ceiling slats. When completed, fixtures and slats shall be free from bugs, dirt, grime, dust, and marks.

2.1.5.4 Cleaning interior window glass, partitions, and glass walls at heights above arm’s length in the multi-floor waiting room on Levels 5 and 6 (NOTE: This task will require cleaning glass up to 7 meters high. A vertical lift cannot be brought into the space due to physical constraints. The Contractor will therefore need to supply appropriate telescopic extension poles and related equipment to reach this non-standard height).

2.1.5.5 Brushing for cobwebs and other occluding materials at heights above arm’s length in the multi-floor waiting room on Levels 5 and 6. See note above.

2.1.5.6 Cleaning exterior window glass on the Level 10 terrace and cleaning the building-facing side of the glass paneling beneath the balcony railing and the balcony railing itself on the Level 10 terrace.

2.1.6 Semi-Annual Cleaning Requirements shall consist of:

2.1.6.1 Dusting tops of tall furniture, tops of picture frames and areas not covered in daily dusting.

2.1.6.2 Spot waxing and polishing floors and glass/wood wall panels.

2.1.6.3 Wiping window blinds with a damp cloth to ensure that all smudges are removed. Cleaning inside window glass and sash of smudges and dirt.

2.1.6.4 Cleaning all mechanical air handler rooms.

2.1.7 Annual Cleaning Requirements shall consist of:

2.1.7.1 Cleaning and polishing of anti-fatigue rubber tiles.

2.1.7.2 If requested by the COR, shampooing the entire surface of carpets in the high traffic areas.

2.1.8 Periodic Cleaning Requirements are conducted when conditions warrant or upon request of the COR and shall consist of:

2.1.8.1 Replacing and/or refilling hand sanitizer stations. Maintain the dispensers and stations by cleaning with a clean cloth.

2.1.8.2 During any active precipitation event or when precipitation is likely to occur, placing umbrella wrapping machines near the staff and public entrances to the Consulate. Relocating the umbrella wrapping machines to their storage locations when the precipitation event has concluded or precipitation is no longer likely.

2.1.8.3 Cleaning of Government-owned glasses, cups, plates, and coffee services in kitchenettes adjacent to conference rooms. The Contractor shall clean the items in hot soapy water and rinse, dry and polish so that a presentable appearance is maintained.

2.1.8.4 Shampooing (small area spot clean as needed) carpets.

2.1.8.5 Removing any grease marks or fingerprints from walls (painted walls, wooden wall panels and glass wall panels), doors, door frames, windows and window frames, glass partitions, reception booths and similar surfaces.

2.1.8.6 Emptying and wiping down vacuums that are mounted to walls or otherwise located in one workroom on each floor of the facility.

2.1.9 Special Cleaning Schedule for Escort-Required Area:

2.1.9.1 Once per week on dates or days identified by the COR, conducting services specified in sections 2.1.1.1 and 2.1.1.3-6. For the executive office only (~150sqm), conducting services specified in sections 2.1.1.2, 2.1.2.2, and 2.1.4.3.

2.1.9.2 Once per month on dates or days identified by the COR, conducting services specified in sections 2.1.2.2, 2.1.4.4, and cleaning one shower stall.

2.1.9.3 Up to four times per year on dates or days specified by the COR, conducting services specified in section 2.1.5.2.

2.1.10 Recycling - The Contractor shall collect, separate, and move to designated locations all recyclable items in accordance with applicable laws and regulations. Recyclable boxes or containers shall be broken down by the Contractor.

2.1.11 Safety Signage - The Contractor shall provide and place appropriate safety signs and barriers at locations where work is performed.

2.1.12 Transportation - The Contractor will not be reimbursed for any expenses associated with the transport of Contractor staff or material to or from a location at which standard services, temporary additional services, or disinfection services are performed.

2.2 Temporary Additional Services – Janitorial-type services that are requested to occur in supplement to the schedule listed in Section 2.1 and/or at U.S. Government owned or leased locations other than the U.S. Consulate Office Building are considered “temporary additional services” and may be requested to occur after hours, on weekends, or on holidays. Such services shall be billed at the per square meter rate specified in Block 23 of the Continuation to SF-1449.

2.3 Disinfection Services – The following services are considered “disinfection services” and may be requested to occur after hours, on weekends, or on holidays. Such services shall be billed at the per square meter rate specified in Block 23 of the Continuation to SF-1449.

2.3.1 Cleaning any soiled surfaces in the area(s) designated for disinfection prior to conducting disinfection. Cleaning methods shall prevent contact with individuals and avoid aerosolization of the soiling.

2.3.2 Disinfection of all surfaces, with particular attention paid to high-touch surfaces (e.g.

door handles, telephones, elevator buttons, card swipe keypads, service counters, computer peripherals, etc.) utilizing a product listed as being effective against pathogens, including the COVID-19 virus, by either the U.S. Environmental Protection Agency or the Australian Therapeutic Goods Administration. Product information shall be provided in advance to the COR. If the product is not specifically listed as effective, then labeling must be submitted to the COR for acceptance. The Contractor shall follow the manufacturer’s instructions for all cleaning and disinfection products (e.g., concentration, application method and contact time, etc.).

2.3.3 Disinfection of any glasses, cups, dishes, flatware, and coffee services in the spaces.

The Contractor shall clean the items in hot soapy water, rinse, and dry.

2.3.4 Waste removal to include emptying all rubbish bins and clearing and disinfecting the waste receptacles, then replacing plastic linings / trash bags and returning items where they were located.

2.3.5 Worker Training and Health and Safety

2.3.5.1 The Contractor shall ensure that all workers are trained on safe and effective disinfection procedures as well as measures for protecting themselves including fastidious hygiene practices and personal protective equipment. The Contractor shall provide all protective measures that at a minimum will include those identified on the disinfectant labeling. Generally, personal protective equipment is anticipated to include impervious disposable gloves, eye protection, and if justified by the pathogenic agents of concern, masks and gowns. Worker PPE needs are driven primarily by the chemical disinfectants in use. Most definitely, PPE will include disposable impervious gloves. Additionally, if sprays are used, eye protection and protective clothing coverings are prudent. Work practices must minimize aerosolization of both soiling and any body fluids.

2.3.5.2 Gloves should be discarded after each cleaning/disinfection job. Consult the manufacturer’s instructions for cleaning and disinfection products used. Workers should wash their hands immediately after gloves are removed.

2.3.5.3 Contractors should follow applicable standards to include:

Hazard Communication Standard (29 CFR 1910.1200). To train workers on the hazards of chemical products

PPE Standard. Requiring selection of PPE based on the hazards and training on proper use, care, and limitations of the PPE.

Respiratory Protection Standard (29 CFR 1910.134). If respiratory protection is used.

3. MANAGEMENT AND SUPERVISION

3.1 The Contractor shall designate a representative who shall always be responsible for on-site supervision of the Contractor’s workforce. This supervisor shall be the focal point for the Contractor and shall be the point of contact with U.S. Government personnel. The supervisor shall have sufficient English language skill to be able to communicate with members of the U.S.

Government staff. The supervisor shall have supervision as his or her sole function.

3.2 The Contractor shall maintain schedules. The schedules shall take into consideration the hours that the staff can effectively perform their services without placing a burden on the security personnel of the Post. For those items other than routine daily services, the Contractor shall provide the COR with a detailed plan as to the personnel to be used and the time frame to perform the service.

3.3 The Contractor shall be responsible for quality control. The Contractor shall perform inspection visits to the work site on a regular basis. The Contractor shall coordinate these visits with the COR. These visits shall be surprise inspections to those working on the contract.

3.4 The Contractor shall control overtime through efficient use of the work force. Individual work schedules shall not exceed 40 hours per week to preclude overtime being part of the standard services provided under the contract. Overtime may be necessary under Temporary Additional Services.

*NOTE: There are no pre-specified locations for temporary additional services or disinfection services. The Contractor may be requested to perform temporary additional services or disinfection services at any U.S. Government owned or leased location within a 50-kilometer radius of 50 Miller Street, North Sydney, Australia.

5. PERSONNEL

5.1 General. The Contractor shall maintain discipline at the site and shall take all reasonable precautions to prevent any unlawful, riotous or disorderly conduct by Contractor employees at the site. The Contractor shall preserve peace and protect persons and property on site. The Government reserves the right to direct the Contractor to remove an employee from the worksite for failure to comply with the standards of conduct. The Contractor shall immediately replace such an employee to maintain continuity of services at no additional costs to the Government.

5.2 Standard of Conduct.

5.2.1 Uniforms and Personal Equipment. The Contractor's employees shall wear clean, neat, and complete uniforms when on duty. All employees shall wear uniforms approved by the Contracting Officer's Representative (COR).

5.2.3 Neglect of duties shall not be condoned. The Contractor shall enforce no sleeping while on duty, unreasonable delays or failures to carry out assigned tasks, conducting personal affairs during duty hours and refusing to render assistance or cooperate in upholding the integrity of the worksite security.

5.2.4 Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words, actions, or fighting shall not be condoned. Also included is participation in disruptive activities, which interfere with normal and efficient Government operations.

5.2.5 Intoxicants and Narcotics. The Contractor shall not allow its employees while on duty to possess, sell, consume, or be under the influence of intoxicants, drugs or substances that produce similar effects.

5.2.6. Criminal Actions. Contractor employees may be subject to criminal actions as allowed by law in certain circumstances. These include but are not limited to the following actions: falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records or concealment of material facts by willful omission from official documents or records; unauthorized use of Government property, theft, vandalism, or immoral conduct; unethical or improper use of official authority or credentials; security violations; or, organizing or participating in gambling in any form.

5.2.7 Key Control. The Contractor shall receive, secure, issue and account for any keys issued for access to buildings, offices, equipment, gates, etc., for the purposes of this contract. The Contractor shall not duplicate keys without the COR's approval. Where it is determined that the Contractor or its agents have duplicated a key without permission of the COR, the Contractor shall remove the individual(s) responsible from this contract. If the Contractor has lost any such keys, the Contractor shall immediately notify the COR. In either event, the Contractor shall reimburse the Government for the cost of rekeying that portion of the system.

5.3. Notice to the Government of Labor Disputes

The Contractor shall inform the COR of any actual or potential labor dispute that is delaying or threatening to delay the timely performance of this contract.

5.4. Personnel Security

5.4.1 Within ten (10) days of award of the contract, the Contractor shall provide a list of workers and supervisors it intends to assign to this project. The Contractor shall provide a completed security package, in the format requested by the Regional Security Office, that includes information about each employee who will be working under the contract. An example security package is included as Attachment 3. The personal information requested is extensive, and there is an estimated time burden of 1-2 hours per employee to complete the forms and obtain necessary supporting documentation. The Government will conduct background checks on these individuals. It is anticipated that these security checks will take up to 30 days to perform.

The Government shall issue identity cards to Contractor personnel, after they are approved.

Contractor personnel shall display identity card(s) on the uniform at all times while providing services under this contract. These identity cards are the property of the U.S.

Government. The Contractor is responsible for their return at the end of the contract, when an employee leaves Contractor service, or at the request of the Government.

The Government reserves the right to deny access to U.S. Government-owned and U.S.

Government-operated facilities to any individual at any time. A reason(s) for denial of access may or may not be shared with the Contractor, at the Government’s discretion. If any Contractor personnel are denied access to Government facilities, either prior to the commencement of or during work under this contract, the Contractor shall quickly schedule alternate staff members who have already been vetted and approved for access to avoid a disruption in service. The Contractor shall ensure that a sufficient number of its staff are vetted and approved for access to ensure uninterrupted delivery of service at all times. Non-availability of staff while awaiting the results of background checks and access approvals is not an acceptable reason for failure to perform standard services once the period of performance has commenced.

6.0. MATERIALS AND EQUIPMENT

Except as listed in Attachment 1 – GOVERNMENT FURNISHED PROPERTY, the Contractor shall provide all necessary janitorial supplies and equipment, including mops, brooms, dust rags, detergents, cleaners, etc. to perform the work identified in this contract.

7.0. GOVERNMENT FURNISHED PROPERTY/EQUIPMENT

7.1 The Contractor has the option to reject any or all Government furnished property or items (see Attachment 1 - GOVERNMENT FURNISHED PROPERTY). However, if rejected, the Contractor shall provide all necessary property, equipment or items, adequate in quantity and suitable for the intended purpose, to perform all work and provide all services at no additional cost to the Government. All Government furnished property or items are provided in an "as is" condition and shall be used only in connection with performance under this contract. The Contractor is responsible for the proper care, maintenance and use of Government property in its possession or control from time of receipt until properly relieved of responsibility in accordance with the terms of the contract. The Contractor shall pay all costs for repair or replacement of Government furnished property that is damaged or destroyed due to Contractor negligence.

7.2 The Contractor shall maintain written records of work performed, and report the need for major repair, replacement and other capital rehabilitation work for Government property in its control.

7.3 The Contractor shall physically inventory all Government property in its possession.

Physical inventories consist of sighting, tagging or marking, describing, recording, reporting and reconciling the property with written records. The Contractor shall conduct these physical inventories periodically, as directed by the COR, and at termination or completion of the contract.

8. INSURANCE

8.1 Amount of Insurance. The Contractor is required to provide whatever insurance is legally necessary. The Contractor shall, at its own expense, provide and maintain during the entire performance period the following insurance amounts:

8.3 The types and amounts of insurance are the minimums required. The Contractor shall obtain any other types of insurance required by local law or that are ordinarily or customarily obtained in the location of the work. The limit of such insurance shall be as provided by law or sufficient to meet normal and customary claims.

For those Contractor employees assigned to this contract who are either United States citizens or direct hire in the United States or its possessions, the Contractor shall provide workers’ compensation insurance in accordance with FAR 52.228-3.

The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to any property of the Contractor, its officers, agents, servants, employees, or any other person arising from an incident to the Contractor's performance of this contract. The Contractor shall hold harmless and indemnify the Government from any and all claims arising, except in the instance of gross negligence on the part of the Government.

8.6 The Contractor shall obtain adequate insurance for damage to, or theft of, materials and equipment in insurance coverage for loose transit to the site or in storage on or off the site.

8.7 Government as Additional Insured. The general liability policy required of the Contractor shall name "the United States of America, acting by and through the Department of State," as an additional insured with respect to operations performed under this contract.

8.8 Time for Submission of Evidence of Insurance. The Contractor shall provide evidence of the insurance required under this contract within ten (10) calendar days after contract award. The Government may rescind or terminate the contract if the Contractor fails to timely submit insurance certificates identified above.

9.0. LAWS, REGULATIONS, LICENSES, AND PERMITS

9.1 Without additional expense to the Government, the Contractor shall comply with all laws, codes, ordinances, and regulations required to perform this work. In the event of a conflict among the contract and requirements of local law, the Contractor shall promptly advise the Contracting Officer of the conflict and of the Contractor's proposed course of action for resolution by the Contracting Officer.

9.2 Without additional cost to the Government, the Contractor shall obtain all permits, licenses, and appointments required for the performance of work under this contract. The Contractor shall obtain these permits, licenses, and appointments in compliance with applicable host country laws.

The Contractor shall provide evidence of possession or status of application for such permits, licenses, and appointments to the Contracting Officer with its proposal. Application, justification, fees, and certifications for any licenses required by the host government are entirely the responsibility of the Contractor.

9.3 The Contractor shall comply with all local labor laws, regulations, customs and practices pertaining to labor, safety, and similar matters, to the extent that such compliance is not inconsistent with the requirements of this contract.

10.0. TRANSITION PLAN

Within ten (10) days after contract award, the Contracting Officer may request that the Contractor develop a plan for preparing the Contractor to assume all responsibilities for janitorial services.

The plan shall establish the projected period for completion of all clearances of Contractor personnel, and the projected start date for performance of all services required under this contract.

The plan shall assign priority to the selection of all supervisors to be used under the contract.

12. QUALITY ASSURANCE AND SURVEILLANCE PLAN (QASP)

This plan provides an effective method to promote satisfactory contractor performance. The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting

Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to monitor quality to ensure that contract standards are achieved.

Performance Objective Scope of

(Services) Performs all janitorial services set forth in the scope of work.

All required services are performed and no more than one (1) customer complaint is received per month.

(Safety) Safely performs all services set forth in the scope of work.

Zero (0) injuries occur to Contractor personnel and zero (0) injuries for which the Contractor is responsible occur to Consulate personnel or visitors.

12.1 SURVEILLANCE. The COR will receive and document all complaints from Government personnel regarding the services provided. If appropriate, the COR will send the complaints to the Contractor for corrective action. The Contractor will report, to the COR, any instances of injury to Contractor or Consulate personnel that occur during the performance of this contract.

12.2 STANDARD. The performance standard is that the Government receives no more than one

(1) customer complaint per month. The COR shall notify the Contracting Officer of the complaints.

The performance standard for safety is that zero (0) injuries occur to Contractor personnel and zero

(0) injuries for which the Contractor is responsible, as determined by the Post Occupational Safety and Health Officer, occur to Consulate personnel. The Contracting Officer may take appropriate action to enforce the inspection clause (FAR 52.212-4, Contract Terms and Conditions-Commercial Items), if any of the services exceed the standard.

12.3 PROCEDURES.

(a) If any Government personnel observe unacceptable services, incomplete work, required services not being performed, or potentially unsafe situations they should immediately contact the COR.

(b) The COR will complete appropriate documentation to record the complaint or incident.

(c) If the COR determines the complaint or incident is invalid, the COR will advise the complainant. The COR will retain the annotated copy of the written complaint for his/her files.

(d) If the COR determines the complaint or incident is valid, the COR will inform the Contractor and give the Contractor additional time to correct the defect, if additional time is available. The COR shall determine how much time is reasonable.

(e) The COR shall, as a minimum, orally notify the Contractor of any valid complaints or incidents.

(f) If the Contractor disagrees with the complaint or incident after investigation of the site and challenges the validity of the complaint or finding of responsibility for a safety incident, the Contractor will notify the COR. The COR will review the matter to determine the validity of the complaint.

(g) The COR will consider complaints as resolved unless notified otherwise by the complainant.

(h) Repeat customer complaints are not permitted for any services. If a repeat customer complaint is received for the same deficiency during the service period, the COR will contact the Contracting Officer for appropriate action under the Inspection clause. Any valid safety incident will be forwarded to the Contracting Officer for appropriate action under the same clause.

The Government shall also make the following consumable items available to the Contractor as "Government furnished property" under the contract:

• Anti-viral / anti-bacterial wipes

The consumable items listed above will be provided to the Contractor on an as-needed basis to replenish stock used by Consulate staff and visitors during day-to-day operations of the Consulate facility.

The Government will maintain inventory controls to prevent pilferage and will monitor usage patterns.

ATTACHMENT 2

CONTRACTOR FURNISHED MATERIALS

The Contractor shall provide all equipment, materials, supplies, and clothing required to perform the standard, temporary additional, or disinfection services as specified in this contract. Such items include, but are not limited to uniforms, personnel equipment, tools, cleaning supplies, equipment and any other operational or administrative items required for performance of the duties and requirements of this contract.

The Contractor shall maintain sufficient parts and spare equipment for all Contractor-furnished materials to ensure uninterrupted service. The Contractor will be permitted use of three janitorial closets to store contractor furnished materials. The Contractor must maintain a sufficient quantity of such materials on site to avoid any interruption in work.

A non-exhaustive list of items the Contractor may need to supply to meet the terms of this contract includes:

The Contractor shall use only commercial grade chemical cleaning-products. The Contractor shall identify products, by brand name, for each of the following product types:

In addition, the Contractor shall provide following non-chemical products containing the maximum feasible amount of recovered materials:

(1) Bathroom tissue - The bathroom tissue must be 2-ply and be Forest Stewardship Council (FSC) certified.

(2) Paper Towels - The paper towels must be of high quality and be Forest Stewardship Council (FSC) certified.

(3) Toilet seat covers – The toilet seat overs must be of high quality and be Forest Stewardship Council (FSC) certified.

All non-chemical products (paper, plastic, etc.) should conform to the Environmental Protection Agency (EPA) Comprehensive Procurement Guide (CPG) if the products are CPG-designated items. CPG information is available on the Internet at http://www.epa.gov/cpg. Alternatively, AUS/NZ standard cleaners may be used.

The Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category

Once this list of products has been approved by the Contracting Officer, the Contractor is responsible for using only those approved cleaning chemical products in the building. If for some reason the product is found later to be ineffective, hazardous, not suitable for continued use, the Contractor would like to propose an alternative product, or the Contracting Officer would like to propose a more environmentally-preferable product, either the Contractor or Contracting Officer may propose for consideration an “equal” product.
