Dear Industry Partners:
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The U.S. Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ) is issuing this combined synopsis/solicitation in accordance with FAR Subparts 12 and 13.5 on an unrestricted basis for a Commercial Off the Shelf (COTS) Purchase Card (PCARD) automated system as described in Attachment 1 - Statement of Work (SOW). The North American Industry Classification System (NAICS) code for this requirement is 511210 and the Product Service Code (PSC) is 7A21.
ICE/OAQ anticipates that this Request for Proposal (RFP) will result in a Firm-Fixed Price (FFP) single award Purchase Order (PO). All responsible sources may submit a proposal which shall be considered by the agency. This combined synopsis/solicitation incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2021-05. The Period of Performance for this PO will include a twelve (12) month base period and four (4), twelve (12) month option periods. FAR Provision 52.212-1, Instruction to Offerors– Commercial Items (Jun 2020), applies to this acquisition and is incorporated by reference. As prescribed in FAR 12.301(c), the instructions on the following pages are provided as an addendum for this solicitation.
FAR Clauses 52.212-4, Contract Terms and Conditions-Commercial Items (Oct 2018), and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (Jan 2021), also apply to this acquisition. As prescribed in FAR 12.301(c), Attachment 2 – Terms and Conditions serves as an addendum to the FAR 52.212-4 clause and incorporates additional terms and conditions.

1. GENERAL INFORMATION, INSTRUCTIONS, AND BASIS FOR AWARD
1.1. General Conditions. The Immigration and Customs Enforcement (ICE) Office of Acquisition Management (OAQ) is releasing this combined synopsis/solicitation in electronic format only. The Government intends to conduct this procurement through a phased submission and evaluation process. The Government will not be obligated to pay any costs incurred by a contractor in preparation and submission of a proposal in response to this RFP. Contractors shall fully understand and accept these terms, as well as all other terms and conditions stated herein, before deciding whether to participate in this RFP. An Offeror who includes data in their proposal that it does not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall prepare text conforming to paragraph (e) of the provision at FAR 52.215-1, Instructions to Offerors - Competitive Acquisition.

1.3. Submissions. Unless otherwise indicated in this RFP, all submissions shall be provided electronically to the Points of Contact (POCs) identified in Section 1.2. Electronic copies shall be formatted using Microsoft Office and submitted in PDF format with file names that are consistent with the structure of the proposal.
All submissions must include the solicitation number in the subject line of the e-mail. Omission of any information from the proposal submission requirements may result in rejection of the proposal.
1.4. RFP Questions. The cutoff date for questions relating to both submission phases of this RFP is
Wednesday, July 21, 2021 by 12:00 PM Central Daylight Time (CDT). Offerors are to email questions utilizing Attachment 3 – Vendor Questions to the POCs identified in RFP Section 1.2. Questions submitted after this cut off may be responded to at the discretion of the Contracting Officer. Questions with the Government’s responses will be posted to beta.SAM. Please be advised that the Government reserves the right to transmit those questions and answers of common interest to all prospective offerors.
As such, please refrain from providing proprietary information in your questions.
1.5. Basis for Award. The Government anticipates awarding a single award Firm Fixed Price (FFP) Purchase
Order (PO) for a Commercial Off the Shelf (COTS) Purchase Card (PCARD) automated system as described in Attachment 1 – Statement of Work (SOW) to the Offeror whose proposal represents the best value in terms of Corporate Experience, Technical Capability, and Price. Within the best value continuum, the Government will employ a Tradeoff analysis of Corporate Experience, Technical Capability, and Price in evaluating the proposals submitted.
1.6. Evaluation Factors. The evaluation will be based on a complete assessment of the Offeror’s submission.
Proposals shall be evaluated on the below non-price factors and price. Evaluation factor(s) evaluated in Phase I will not be re-evaluated in Phase II.

1.7. Evaluation Factor Order of Importance. The Evaluation factors are listed below in descending order of importance.
Technical Capability (Oral Presentation/Technical Demonstration) Corporate Experience Price
The non-price factors when combined, are more important than price. As the non-price evaluation of proposals determines there are no substantial differences, price becomes more important, but not necessarily determinative, in making the award determination. The evaluation results from both Phases will be considered when making the final award decision.
2. PHASE I SUBMISSION INSTRUCTIONS
2.1 Submission Due Date. Phase I proposals shall be emailed to the POCs identified in Section 1.2.
Submissions must be received no later than 3:00 PM CDT on Tuesday, July 27, 2021. Late Phase I proposal submissions will not be considered.
2.2 Communications. The Government intends to evaluate Phase I proposals and proceed with evaluation and Advisory Down Select without discussions with Offerors. Therefore, the Offeror’s initial Phase I proposal should contain the Offeror’s best terms from a Corporate Experience standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
2.3 Proposal Documents and Contents.
2.3.1. Page Limitations. The title page, table of contents, table of figures, list of tables and glossary of abbreviations & acronyms do not count against page count limitations. Proposal contents that exceed the stated page limitations will be removed from the proposal by the Contracting Officer prior to turning the proposal over to the Government evaluation team and will not be considered in the evaluation. See Section 2.3.3 for applicable page limits.
2.3.2. Format. Print shall be on 8½” x 11” paper (except as specifically noted). Print shall be of a minimum 12-point font. Graphic presentations, including tables, while not subject to the same font size and spacing requirements, shall have spacing and print that is easily readable. All submissions shall be provided electronically.
2.3.3. Volumes and Organization. Offerors must submit their Phase I written response in two (2) separate volumes:

Pricing data relating to RFP Section 4.6 is prohibited in, and shall be omitted from, Volumes I and II.
Any conditional assumptions taken with respect to the requirements and the RFP shall be fully explained in Volume I of the proposal.
The page limitations shown below do not include any “front matter” information such as a title page, table of contents, definitions, or acronyms. Any Corporate Experience information submitted within the “front matter” will not be considered.
2.4. Volume I: Proposal Summary. The proposal shall include the following:
a. RFP Number & Title
b. Name and address of Offeror
c. Name, telephone number & e-mail address of Offeror’s main point-of-contact
d. Socio-economic status
e. Dun & Bradstreet Number
f. All assumptions (for non-price factor and pricing) to the RFP (including the SOW) must be identified in this section.
g. Any contractor provision fill-ins as required by Attachment 2 – Terms and Conditions.
Specifically, but not limited to:
i. FAR 52.204-24

2.5. Volume II: Evaluation Factor 1: Corporate Experience. The Offeror’s Corporate Experience submission shall include up to three (3) recent and relevant Corporate Experience contract references that demonstrates the Offeror has prior experience providing a COTS PCARD automated system. Recent is defined as work performed (completed or ongoing) within the last five (5) years from the date of issuance of this RFP. Relevant is defined as similar in scope, magnitude, and complexity to the SOW requirements. At least one (1) of the contract references submitted must be for work performed by the Prime Offeror. The other contract reference submissions may be from the proposed subcontractors.
Offerors must cite experiences in which they had significant involvement and provided majority contributions to the overall contracts. It is the Offeror’s responsibility to clearly represent to the Government, the degree to which it was involved and provided contributions in its cited examples of experience. If demonstrated Corporate Experience of the Prime Offeror’s Major Subcontractors is utilized, the Offeror must clearly identify the owner of the demonstrated Corporate Experience in the response. For Corporate Experience of proposed subcontractors, the offeror must explain the percentage of work that is anticipated to be performed by the subcontractor. The Government reserves the right to verify this information by any number of methods at its discretion.
For the purposes of Factor 1 Corporate Experience, a contract shall be defined as:
a. a Task Order (TO) or Delivery Order (DO) placed under a single-award or multiple-award contract (FAR 16.501-1); or,
b. a single work directive or similar instrument which contains a separate statement of work issued under a broader contract; or,
c. a single order placed under a basic ordering agreement (BOA) (FAR 16.703); or,
d. a single TO placed under a federal supply schedule (FSS) (FAR 8.405-2); or, Volume Volume Title

The Offeror’s Corporate Experience submission shall include all of the following for each contract reference:
The Contract/Task order Number (and delivery/task order number, if applicable).
The Contract/Task order Type.
Total Value of the Contract/Task order (inclusive of all options)). *If the project was performed as a subcontractor or at a task order level, provide the applicable dollar value of the work performed as opposed to a total contract/ceiling value
Whether the Offeror was the prime or a subcontractor on the project.
The Contract/task order’s Period of Performance.
The Government or commercial contracting activity’s address, telephone number and email.
Description of scope and brief explanation of how the contract reference demonstrates experience with the Experience Questions cited below.
If the experience is for a parent company, an affiliate, or another subcontractor/team member, with a different CAGE code, the Offeror shall include information demonstrating how the resources of the parent company, affiliate, or subcontractor/team member resources will be utilized to affect the performance of the offer.
The Offeror’s Corporate Experience submission shall also include clear, concise, and complete responses to all of the below Experience Questions. Failure to include a response to all of the below Experience Questions will render the Offeror’s submission ineligible for award.

3. PHASE I EVALUATION METHODOLOGY AND ADVISORY DOWN SELECT
3.1. Evaluation Process. The Government will evaluate by performing a risk assessment based on a complete analysis of the Offeror’s Factor 1: Corporate Experience submission. The Government will consider all Corporate Experience information as well as the recency and relevance of the information, and the Offeror’s responses to the Experience Questions. Factor 1 submissions will be reviewed, evaluated, and assigned a Risk Rating as described in the table below.

Low Risk Little doubt exists, based on the Offeror’s Corporate Experience, that the Offeror can perform the proposed effort.
Moderate Risk Some doubt exists, based on the Offeror’s Corporate Experience, that the Offeror can perform the proposed effort.
High Risk Significant doubt exists, based on the Offeror’s Corporate Experience, that the Offeror can perform the proposed effort.
3.2. Advisory Down Select. The Government will conduct a phased evaluation and proceed with an Advisory
Down Select after evaluation of Phase 1 proposals.
3.2.1. Notification. Offerors will receive an Advisory Down Select Notice via email from the Government POCs listed in Section 1.2 of this RFP. The notification will advise the Offeror of the Government’s advisory recommendation to proceed or not to proceed to Phase II. Offerors who are rated most highly will be advised to proceed to Phase II. Offerors who were not among the most highly rated, will be advised that they are unlikely to be viable competitors. The intent of this advisory notice is to minimize development and other costs for those Offerors with little to no chance of receiving an award. The Government’s advice will be a recommendation only and those Offerors who are advised not to proceed may elect to continue their participation in the procurement. The Government does not intend to provide debriefings after the completion of the Advisory Down Select notifications.
Failure to participate in Phase I precludes further consideration of an Offeror. Phase II Offeror submissions will not be accepted from Offeror’s who have not submitted Phase I proposals by the Phase I proposal due date. Late Phase I proposal submissions will not be considered.
3.2.2. Offeror’s Intent Submissions. Offeror’s will have approximately 48 hours after the issuance of the Advisory Down Select notifications to make the decision and inform the CO as to whether or not they intend on participating in Phase II. A specific due date and time for notification of an Offeror’s decision to continue to Phase II will be stated in the Advisory Down Select notification letter. Offeror communications received after the 48 hour deadline may be considered at the discretion of the Government. Failure to inform the Contracting Officer of the Offeror’s intent to proceed will be taken as tacit evidence that the Offeror does not intend to continue their participation in the solicitation and will receive no further information regarding this RFP.
4. PHASE II SUBMISSION INSTRUCTIONS
4.1. Submission Due Dates.
4.1.1. Written Proposals. The Phase II – Evaluation Factor 3: Price Proposal shall be emailed to the POCs listed in Section 1.2 approximately one (1) week from the date of issuance of the Advisory Down Select notification. A firm Phase II – Evaluation Factor 3: Price Proposal submission due date will be provided in the Advisory Down Select Notice. No other methods of submission will be accepted. Price proposals will not be accepted from Offerors who did not submit Phase I proposals. Late Phase II – Evaluation Factor 3: Price Proposal submissions will not be considered.
4.1.2. Oral Presentations. The Oral Presentations/Technical Demonstrations for Evaluation Factor 2:
Technical Capability will be conducted remotely via Microsoft Teams approximately seven (7) calendar days (or the following business day if the timeframe falls on a weekend or federal holiday) from the date of issuance of the Advisory Down Select notification. The order in which Offerors are scheduled will be randomly selected by the Government. Requests to reschedule will be at the discretion of the Contracting Officer. The Offeror shall submit a handout to the POCs cited in Section 1.2 prior to their scheduled Oral Presentation. See Section 4.5.6 for handout requirements. Within 48 hours after the Offeror has sent notice to the Contracting Officer of Offeror’s intent to participate in Phase II, the Offeror shall provide the Contracting Officer with the names of the participants who will attend the presentation, their current employers, and their intended roles on the PO. See section 4.5.2 for Offeror participant requirements.
4.2. Communications. The Government intends to evaluate Phase II proposals without discussions with
Offerors. Therefore, the Offeror’s initial Phase II proposals should contain the Offeror’s best terms from a Technical Capability and Price standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
4.3. Proposal Documents and Contents.
4.3.1. Page and Time Limitations. The title page, table of contents, table of figures, list of tables and glossary of abbreviations & acronyms do not count against page count limitations. 4.4. Volume III: Phase II – Evaluation Factor 2: Technical Capability. The Offeror shall perform an Oral
Presentation/Technical Demonstration that addresses and includes all of the below:
o Presents a live and complete response to the entire Technical Exercise (See Attachment 4).
o Demonstrates that the Offeror’s solution satisfies all minimum requirements outlined in Section 3 of the SOW and has the capability to support the number of card holders, approving officials, users, and transactions as described in Section 1 of the SOW.
o Outlines the solution’s ease of use and user friendliness.
o Presents sufficient information to reflect that the Offeror has a thorough understanding of the SOW requirements.
4.5. Technical Capability Oral Presentation/Technical Demonstration Rules of Engagement.
4.5.1. General Rules. By participating in the Oral Presentations, the Offeror acknowledges that it is in compliance with all solicitation rules and parameters, in accordance with applicable laws and statutes. The Oral Presentations/Technical Demonstrations will be conducted via a Microsoft Teams link provided by the Government. The link shall not be shared with anyone other than the authorized Government participants and the authorized Offeror participants, and shall be treated as source selection sensitive. The Government and Contractor may agree to test the connection at a convenient time prior to the Oral Presentation. In the event the selected technology platform or tool cannot be made functional at the time of the scheduled Oral Presentation, the Oral Presentation may proceed as a voice-only telephone call, at the Government’s sole discretion.

Presentations/Technical Demonstrations. The Offeror shall enable video so that the Government may see and interact with the attendees. Offeror attendees shall mute their microphones when not speaking. The Government encourages Offerors to abide by applicable social distancing guidelines and rules established by the Centers for Disease Control and Prevention (CDC) and state and local Governments, including applicable active stay-at-home orders, to reduce the spread of the coronavirus disease 2019 (COVID-19). Pricing data and information shall not be included nor discussed during the Oral Presentation/Technical Demonstration. The Oral Presentation/Technical Demonstration shall only include discussion relating to Evaluation Factor 2 - Technical Capability cited in Section 4.4.
4.5.2. Offeror Participants. The Offeror’s Oral Presentations/Technical Demonstrations team is limited to three (3) employees. At least two (2) of the three (3) team members must be current employees from the Prime Contractor (not a proposed subcontractor or consultant). Only the three (3) members of the team shall be present during the eighty (80) minute demonstration. If a Sub-contractor is included in a Prime Contractor’s Oral Presentations/Technical Demonstrations, that Sub-contractor shall not participate in another demonstration for this requirement. Sub-contractor participation in the Oral Presentations/Technical Demonstrations is limited to one Prime Contractor only. Substitutions of attendees is strongly discouraged. The Government will not relax the requirement of no more than three (3) persons, two (2) of whom are current Prime Contractor employees. If an offering contractor sends a substitute, it should provide an updated list of attendees to the Oral Presentations/Technical Demonstrations for the Government’s record at least twenty-four (24) hours prior to the Offeror’s scheduled Oral Presentation/Technical Demonstration. The Offeror participants shall not reach back, by phone/conference bridge, email, or any other means, to any other personnel or persons for assistance during the Oral Presentations/Technical Demonstrations. The Government assumes no responsibility whatsoever for any attendee’s inability to attend the scheduled Oral Presentations/Technical Demonstrations, access to the Microsoft Teams platform, or technical difficulties on the part of the Contractor.
4.5.3. Recording. Oral Presentations/Technical Demonstrations will be recorded by the Government.
The recording is source selection sensitive and will be handled accordingly. The recording will not be evaluated but may serve as a record of the content of the oral presentation, if needed.
Only the oral presentation itself will be evaluated. The Offeror is strictly prohibited from recording the Oral Presentations/Technical Demonstrations.
4.5.4. Exchanges. The Government may ask clarification questions about content presented by the Offeror during the Oral Presentation/Technical Demonstration. These exchanges are viewed as a component of the Oral Presentation/Technical Demonstration itself and do not constitute discussions. Oral Presentations/Technical Demonstrations are distinct from the Government’s reserved right to conduct further clarifications or discussions. The Government will not ask questions about information contained in an Offeror’s previously submitted Phase I proposal or Phase II Price proposal and Offerors are prohibited from discussing Phase I proposals or Phase II Price during its Oral Presentation. Further, the Government will not ask questions that will invite or allow the Offeror to change its proposal from either Phase I or Phase II. The Offeror shall not volunteer any information that might be construed as changing any of its proposals. Offeror’s attendees are in control of the Oral Presentations/Technical Demonstrations and may choose not to present or respond to any question posed by the Government. The Offeror may not generally ask questions during the Oral Presentations/Technical Demonstrations. Any questions asked must be directed to the Contracting Officer and should only deal with logistics and conduct of the Oral Presentations/Technical Demonstrations.
4.5.6. Offeror Handouts. Contractors shall provide a handout to the POCs listed Section 1.2 prior to the day of the presentation to aid the Government in following along the presentation. The handout must be compiled in an MS PowerPoint slide deck not exceeding twenty-five (25) slides. These slides will NOT be evaluated, and any content the Contractor wishes to present for an evaluation must be done orally during the Oral Presentations/Technical Demonstrations. The handout/slide deck should serve as a summary of the content the Offeror will present during its oral presentation and may be referred to by evaluators, though the handout/slide deck will not be evaluated itself. Pricing data and pricing information are prohibited and shall not be included in the handout. 4.6. Volume IV: Phase II – Evaluation Factor 3: Price. Offerors shall submit a price proposal for all items and quantities listed in the table below. Offerors shall use the exact table format listed below without deviation when submitting their price proposals. All items covered under option years may be ordered and performed during the scheduled period of performance of this contract. Offerors are required to provide prices for these items under option years. The prices for all option items will be evaluated in accordance with FAR 52.217-5. The Government makes no guarantee that the option years will be exercised. It will be the Government’s unilateral right to exercise the option years. Once the option is exercised, the Offeror is required to perform all required services as applicable and deliver all products when ordered during the scheduled period of performance of this contract.

5. PHASE II EVALUATION METHODOLOGY
5.5. Evaluation Process for Evaluation Factor 2: Technical Capability. The Government will assess its level of confidence that the Offeror understand the requirement, proposes a sound and easy-to-use solution that meets all of the minimum system and user requirements outlined in the SOW Sections 3 and 1, and will be successful in performing the work based on a complete assessment of the Offeror’s Technical Capability proposal. The Government will evaluate and consider the Offeror’s response to all items detailed in RFP Section 4.4. Simple statements of compliance or reiteration (e.g.., “understood”; “will comply”, “has the capability to”, “well-known techniques will be used”), without a detailed description of how compliance or performance will be met, may not sufficiently demonstrate an Offeror’s ability to meet the requirements and may result in a rating of Low Confidence. Factor 2: Technical Capability submissions will be reviewed, evaluated, and assigned a Confidence Rating as described in the table below.
Confidence Rating Definitions
High Confidence The Government has high confidence that the Offeror understands the requirement, has proposed a sound and easy-to-use solution that meets the minimum SOW system and user requirements, and will most likely be successful in performing the contract requirements with little-to-no Government intervention.
Some Confidence The Government has some confidence that the Offeror understands the requirement, has proposed a sound and easy-to-use solution that meets the minimum SOW system and user requirements, and will most likely be successful in performing the contract requirements with some Government intervention.
Low Confidence The Government has low confidence that the Offeror understands the requirement, has proposed a sound and easy to use solution that meets the minimum SOW system and user requirements, and will be successful in performing the contract requirements even with Government intervention.
5.6. Evaluation Process for Factor 3 Price. Price proposals will not be assigned a confidence rating but will be evaluated with respect to reasonableness and completeness based on the information submitted in the Offeror’s price proposal. As part of the price evaluation, the Government will evaluate the extension period authorized by Federal Acquisition Regulation (FAR) 52.217-8, “Option to Extend Services.” The pricing for evaluation of FAR 52.217-8 will be derived by dividing the total amount of Option Period 4 by a factor of two (2). Thus, for the purposes of evaluation under this RFP, the Offeror’s total price for the PO will include the Base Year, all Option Periods, and the FAR 52.217-8 Option to Extend Services.
5.6.1. Reasonableness. The Government will evaluate the total proposed price for reasonableness inclusive of the Base Year, all Option Periods, and the FAR 52.217-8 Option to Extend Services.
The Government may utilize one or more of the following methods to evaluate price reasonableness:
• Comparison to other proposals received.
• Comparison and/or analysis based on Independent Government Cost Estimate.
• Comparison/analysis to historical prices.
• Comparison with competitive published price lists.
5.6.2. Completeness. The Government’s price evaluation will also assess the accuracy and completeness of the price proposal, which involves verification that:
1) all line items in Section 4.6 are priced;
2) figures are correctly calculated; and
3) prices/discounts are presented in the adequate format.
