The purpose of this amendment is to:

1. Revise the proposal submittal method in the Letter to Prospective Offeror. See continuation pages.

2. Incorporate Attachment A: Questions and Answers raised during and after the pre-proposal conference, that was held on February 15, 2023 at 10:30 at the US Embassy Jerusalem. See continuation pages - Attachment A.

Except as provided herein, all terms and conditions of the document referenced in Item 9A or 10A, as heretofore changed, remains unchanged and in full force and effect.

1. Letter to Prospective Offerors: The method for submitting the proposals is hereby revised as follows:

Proposals can be either submitted electronically by email to the Contracting Officer at the following email address: JRSEMBProposals@state.gov or by hand delivery in sealed envelops to the

Contracting Office located at 4 HaGalgal Street, Talpiot, Jeusalem. The due date for submitting the bids remains unchanged on Wednesday, March 08, 2023 no later than 02:00 pm Israel local time.

If submitted electronically by email, the subject line should read: “Proposal for Solicitation #

191S4023Q5676”. It is important to make sure the submission is made in specific size and format; in

MS-Word 2007/2010 or MS-Excel 2007/2010 or Adobe Acrobat (pdf) file format. The file size must not exceed 30MB. If the file size should exceed the 30MB, the submission must be made in separate files and attached to separate emails with less than 30MB each.

2. Incorporate Attachment A: Answers to the questions that were raised during the pre-proposal conference, that was held on February 15, 2023 at 10:30 at the US Embassy Jerusalem.

Questions & Answers

Pre-Proposal Conference

Data Circuit Services - Solicitation # 191S4023Q5676

A pre-proposal conference conducted by the Contracting Office and IRM Telecom, attended in person by a representative from 1 company, was held at the US Embassy Jerusalem on February 15, 2023 to discuss the

Data Circuit Services solicitation terms and statement of work.

The following are the questions and answers raised during the conference and/or sent by email:

1. Question 1: Solicitation document – General: We would appreciate if you could determine, despite the above, that this tender will be subject to Israeli law only, and the competent court in the Tel-Aviv-Jaffa district will have exclusive jurisdiction for any matter and all disputes arising in connection with the tender procedure.

Answer: : Exclusive to the processes applied to awarding a contract under this solicitation issued by the U.S. Embassy of the

United States and the contractor‘s performance by the awarded vendor falls entirely under the jurisdiction, policies, and regulations of the United States of America.

2. Question 2: Solicitation doc – SOW (page 17) bullet # 5 till 7 (below): We would appreciate it if you could delete these 3 bullets, as it depends on the ISP provider.

• Vendor shall provide detailed network topology map that shows all possible paths vendor uses for the internet traffic between ISP hub in Jerusalem and the first International ISP hub.

• Vendor shall provide detailed network topology map that shows possible paths vendor uses for internet traffic between each location.

• Vendor shall have redundancy in the Internet backbone between Israel and USA. For instance, If

Network Access Points (NAP) of the host country’s backbone fail, other alternate backbone paths shall be available.

Answer: No, this can’t be deleted as this is a requirement by the Information Resource Management’s in Washington. In addition this language exists in the previous contract and was accepted and signed by the contractor.

3. Question 3: Solicitation doc – SOW (page 18) Service Support, bullet # 1 and 2: We ask to correct 7X24X364 since our company does not provide support service on "Yom Kippur" (fasting day).

• The awarded vendor shall warrant service support 7X24X365, technical/physical and phone support.

• The vendor shall warrant service support on site if necessary 7X24X365, services must be coordinated directly with US Government’s Contracting Office Representative (COR) or Information

Technology (IT) representative from the Embassy Information Systems Center (ISC).

Answer: No, this can’t be corrected as this is a requirement by the Information Resource Management’s in Washington. In addition this language exists in the previous contract and was accepted and signed by the contractor.

4. Question 4: Solicitation doc – SOW (page 19) bullet # 8: We would like you to correct the last sentence and instead of "at least one year", specify "for two months".

• The awarded vendor shall provide online web access data traffic analysis graphs capabilities. Graphs must be updated on a daily basis. Graphs must retain traffic history behavior for at least one year.

Answer: No, this can’t be corrected as this is a requirement by the Information Resource Management’s in Washington. In addition this language exists in the previous contract and was accepted and signed by the contractor.

5. Question 5: Solicitation doc – SOW (page 22) O.2 Credit for Circuit Downtime by Situation: We would appreciate if the clause would be deleted since our company works in accordance with the “service agreement” which is attached to the technical answer.

• Credit for Circuit Downtime by Situation Below Availability Level: If the downtime accumulated for a circuit adds up to 26.28 (8760 x 0.3%) cumulative hours or more during any one contract year (365 calendar days) or depending on the number of hours for the month (example 744 x .3%) cumulative hours per month (example: 31 calendar day month) the Contractor shall grant an hourly credit to the

Government for each hour of downtime. Each additional one-hour increment or portion thereof will be assessed as an additional hour.

Answer: No, this can’t be deleted as this is a requirement by the Information Resource Management’s in Washington. In addition this language exists in the previous contract and was accepted and signed by the contractor.

6. Question 6: Solicitation doc – page 37, Clause 52.228-3 WORKERS’ COMPENSATION INSURANCE (Defense Base Act)

(JUL 2014). We would appreciate if the clause would be deleted. Alternatively, please add the wording "If required under any applicable local law". It should be mentioned that in Israel, Workers' compensation is covered by the National Security

(Bituach Leumi).

Answer: This clause can’t be deleted. Provide in your bids’ technical submission a proof/statement that your workers are insured per the Israeli labor law. We can accept it.

7. Question 7: Solicitation doc – page 37, Clause 52.228-5 INSURANCE - WORK ON A GOVERNMENT INSTALLATION

(JAN 1997). We would appreciate if the clause would be deleted as this kind of insurance is not applicable in Israel.

Alternatively we can guaranty we will have Employer’s’ Liability insurance subject to a limit of liability of USD 5,000,000 per plaintiff, per event and in the aggregate.

Answer: This clause can’t be deleted. Provide in your bids’ technical submission a proof/statement that your workers are insured per the Israeli labor law. We can accept it.
