About this file

This is a Request for Proposals (RFP) for clarifier equipment repair and refurbishment services at the Nogales International Wastewater Treatment Plant in Rio Rico, Arizona. The United States Section of the International Boundary and Water Commission (USIBWC) is soliciting one firm fixed price contract for complete repair, rebuild, installation, alignment, testing, commissioning, training, documentation, and warranty of one existing wastewater clarifier and one spare clarifier drive unit. The solicitation is a 100 percent small business set aside under NAICS 811310 (Commercial and Industrial Machinery and Equipment Repair and Maintenance) with a $12.5 million size standard. The procurement method uses FAR Parts 12 and 13.5 for commercial services with a lowest price technically acceptable (LPTA) evaluation approach. The proposal due date is Friday, September 18, 2026, at 3:00 PM Mountain Time, with target award on September 29, 2026, and latest award date of September 30, 2026. All proposals must be submitted exclusively through the USIBWC secure Microsoft SharePoint portal, with one authorized representative and approved business email address per offeror.

The contract involves ten line items encompassing sandblasting and painting, clarifier drive rebuild, hardware replacement with stainless steel, seal replacement, scraper blade replacement, clarifier leveling, concrete wall sanding, panel box relocation, shelf clarifier drive rebuild with new pinion gear and shaft, and draft tube modification. The contractor must complete all work within 180 calendar days after contract award, with a kickoff meeting required within five business days and a project schedule due within seven calendar days of award. The offeror must provide at least a one-year warranty beginning on Government acceptance, qualified personnel with demonstrated expertise in clarifier and industrial drive repair, and a detailed price breakdown with Schedule of Values for billing purposes. Replacement parts may be original equipment manufacturer (OEM) or equal provided they meet compatibility with existing Ovivo equipment specifications. The Service Contract Act applies with wage determinations specified for Arizona counties (Graham, Greenlee, and Santa Cruz), and the Government will provide site drainage, electrical power, water, and disposal containers but will not furnish cranes, rigging, tools, parts, or materials.

SECTION A, SOLICITATION AND ACQUISITION INFORMATION

A.1 The United States Section, International Boundary and Water Commission requests proposals for complete repair, rebuild, refurbishment, installation, alignment, testing, commissioning, training, documentation, and warranty services for one existing wastewater clarifier and one existing spare clarifier drive unit at the Nogales International Wastewater Treatment Plant.

A.2 This acquisition is a 100 percent total small business set aside. Offers from concerns that are not small business concerns under NAICS 811310 will not be considered for award.

A.3 The Government intends to award one firm fixed price contract using FAR Parts 12 and 13.5. The Government will use a streamlined lowest price technically acceptable evaluation as described in Section M.

A.4 This solicitation is for equipment repair and refurbishment services. It is not a construction solicitation. Surface preparation, touch up painting, localized concrete clearance adjustment, electrical reconnection, rigging, installation, alignment, and site restoration are incidental to the principal equipment repair service.

A.5 The existing clarifier drives are Ovivo equipment. Genuine Ovivo parts are not mandatory unless a specific PWS requirement expressly states otherwise. Replacement parts may be original equipment manufacturer parts or equal parts that are fully compatible with the existing equipment and meet applicable dimensions, materials, ratings, performance, safety, and interface requirements. The pinion gear and pinion shaft shall be rebuilt or replaced to meet applicable Ovivo specifications.

A.6 The Government may cancel this solicitation at any time before award and may reject any or all proposals if cancellation or rejection is in the Government's interest.

A.7 This solicitation does not authorize work. The Government incurs no obligation until a warranted Contracting Officer executes a written award.

(see pages 1-5)

SECTION B, SUPPLIES OR SERVICES AND PRICES

B.1 The offeror shall enter a firm fixed price for each contract line item. Prices shall include all labor, supervision, project management, engineering support, parts, materials, tools, crane and rigging, transportation, freight, travel, lodging, per diem, permits, testing, training, manuals, warranty, insurance, overhead, general and administrative expense, and profit necessary to complete the PWS.

B.2 A detailed price breakdown and proposed Schedule of Values shall be submitted for price analysis and contract administration. The breakdown is informational and does not convert this firm fixed price contract into a cost reimbursement, time and materials, or construction contract.

B.3 The Government will not separately reimburse costs that the solicitation requires the contractor to include in the firm fixed price.

(see pages 1-5)

SECTION C, DESCRIPTION AND PERFORMANCE REQUIREMENTS

C.1 Attachment 1, Performance Work Statement, May 2026, is incorporated into this solicitation, subject to the clarifications in C.2. If a conflict exists between Attachment 1 and C.2, C.2 controls.

C.2 Solicitation Clarifications to the PWS

• The required quantity is one clarifier rebuild and one spare drive unit rebuild. References to rebuilding two clarifiers, or to more than one clarifier rebuild, are deleted.

• This is a nonpersonal equipment repair and refurbishment service. References to construction, constructed works, or a new system mean the repaired, rebuilt, reinstalled, and commissioned existing equipment.

• References to Texas statutes or Texas professional licensing requirements are inapplicable. The contractor shall comply with applicable Federal, Arizona, Santa Cruz County, and local requirements.

• Only localized touch up painting and surface preparation are required unless the Contracting Officer issues a written amendment or modification. Complete sandblasting and full coating replacement are not included.

191BWC26R0016 | Page 4

• Localized sanding or grinding of the concrete wall is limited to removal of minor bulges needed to provide operating clearance for the rake arm. Structural alteration is not authorized.

• The Government will drain, clean, lock out, and tag out the clarifier before contractor performance.

Existing site electrical power, water, drainage, and designated disposal containers will be made available. The Government will not furnish cranes, rigging, contractor tools, replacement parts, materials, or other equipment.

• Replacement parts may be OEM or equal. The contractor shall submit technical documentation showing compatibility before installation. No statement in the PWS requires the prime contractor to be an Ovivo authorized dealer or requires all parts to be Ovivo branded.

• The contractor shall use qualified personnel with demonstrated expertise in clarifier and industrial drive repair. Factory trained personnel are required only when a specific task or offered product requires such training for safe and proper performance.

• The Schedule of Values is a billing allocation for accepted service milestones. It does not establish construction progress payment procedures or permit payment for unaccepted work.

• The period of performance is 180 calendar days after contract award. The kickoff meeting shall occur within five business days after award. The contractor shall submit the project schedule within seven calendar days after award.

• The contractor shall provide at least a one year warranty beginning on the date of Government acceptance, as required by the PWS.

SECTION D, PACKAGING AND MARKING

D.1 The contractor shall protect all removed, repaired, rebuilt, new, and Government retained components from damage, corrosion, contamination, weather, and improper handling. Reusable and rebuildable Government property shall remain at the site unless the Contracting Officer provides written direction otherwise.

D.2 Deliveries shall identify the solicitation or contract number, contractor name, CLIN, component description, and destination point of contact.

SECTION E, INSPECTION AND ACCEPTANCE

E.1 Inspection and acceptance will occur at the Nogales International Wastewater Treatment Plant. The Contracting Officer or authorized Contracting Officer's Representative will determine acceptance after review of required documentation and successful completion of alignment, electrical, no load, operational, full load, safety, and commissioning tests required by the PWS.

E.2 Government review, observation, or approval does not relieve the contractor of responsibility for compliance with the contract.

E.3 The Government may require correction, repair, replacement, or reperformance of nonconforming work at no increase in contract price.

SECTION F, DELIVERIES AND PERFORMANCE

F.1 Place of Performance. Nogales International Wastewater Treatment Plant, 865 E. Frontage Road, Rio Rico, Arizona 85648.

L.02.D Optional site visits are available by appointment with Albert Flores and must be completed no later than Friday, September 11, 2026. A site visit request does not extend the question, SharePoint access request, or proposal deadline.

L.03 SharePoint Access Request L.03.A Each offeror shall submit one SharePoint access request by email to Suzette.Smith@ibwc.gov no later than Friday, September 11, 2026, at 12:00 PM Mountain Time.

L.03.C The request shall include:

• Company legal name and doing business as name, if applicable.

• Unique Entity Identifier.

• Name and title of the single authorized representative.

• The authorized representative's business, corporate, or enterprise managed email address.

• Direct telephone number.

L.03.D The email address provided must be the address of the individual who will upload the proposal. Only one access request, one authorized representative, and one approved email address will be honored for each offeror unless the Contracting Officer approves an exception in writing.

L.03.E Personal, free, consumer, disposable, temporary, anonymous, shared, or group email accounts will not be approved. The SharePoint link is nontransferable and shall not be forwarded or shared.

L.03.F Offerors are responsible for requesting access early enough to resolve access issues. USIBWC is not responsible for late submission caused by an untimely access request, a prohibited email domain, failure to test access, or technical issues within the offeror's control.

L.04 Proposal Submission Deadline and Method L.04.A Proposals shall be uploaded to the designated secure SharePoint folder no later than Friday, September 18, 2026, at 3:00 PM Mountain Time. The SharePoint upload record and time stamp will determine timely receipt.

L.04.C Late proposals will be handled strictly under FAR 52.212-1(f). The Government ordinarily will not reactivate an expired link after the deadline. There will be no public proposal opening.

191BWC26R0016 | Page 12

L.04.D The offeror shall upload all files before the deadline and verify that the upload completed successfully. A draft, incomplete, corrupted, password protected, or inaccessible file may be treated as not received or may make the proposal unacceptable.

L.05 Proposal Organization The proposal shall contain three separately labeled electronic volumes. Searchable PDF is preferred. Microsoft Excel may be used for the price schedule. Files shall not contain executable code, macros, external links requiring access, or passwords.

Volume Required content Volume I, Technical Acceptability 20 pages maximum, excluding resumes, licenses, certifications, and manufacturer literature.

Volume II, Price No page limit. Include signed offer, completed Section

B prices, and detailed price breakdown.

Volume III, Administrative and Representations No page limit. Include SAM confirmation, amendments, representations, and contact information.

L.06 Volume I, Technical Acceptability The offeror shall provide enough information for the Government to determine compliance without assumptions.

Merely repeating the PWS or stating that the offeror will comply is insufficient when the solicitation requests supporting details.

Technical approach: Describe the sequence for inspection, disassembly, repair, machining or remanufacture, parts selection, installation, alignment, electrical work, testing, commissioning, training, documentation, and warranty. Identify planned subcontracted work.

Compatibility and parts: Explain how proposed OEM or equal parts will meet existing Ovivo dimensions, materials, operating ratings, interfaces, performance, safety, and maintenance requirements. Identify the proposed approach for the pinion gear and shaft.

Relevant experience: Provide at least two projects completed within the last five years involving wastewater clarifiers, clarifier drives, large industrial gear drives, or comparable rotating equipment rebuilds. Include customer, scope, value, completion date, and reference contact.

Key personnel: Identify the project manager, lead mechanical technician, electrical or instrumentation technician, and quality control lead. Provide qualifications and relevant experience.

Schedule: Provide a milestone schedule showing completion within 180 calendar days after award, including long lead parts, removal, shop work, reinstallation, testing, training, and acceptance.

Quality control and safety: Provide the quality control process, inspection hold points, measurement and alignment methods, testing approach, job safety analysis process, and incident reporting process.

Warranty and support: Confirm the minimum one year warranty and describe warranty response, repair, replacement, and point of contact.

Small business performance: Describe how the offeror will comply with FAR 52.219-14, including the work the prime will perform and any similarly situated subcontractors.

L.07 Volume II, Price

• Completed Section B CLIN pricing and total evaluated price.

• Detailed price breakdown separating labor, travel, freight, parts and materials, crane and rigging, subcontracted effort, testing, training, overhead, and profit. The breakdown is for price analysis and does not change the FFP nature of the contract.

• Proposed Schedule of Values for invoicing. At minimum include mobilization and parts receipt, clarifier rebuild and installation, spare drive rebuild, electrical and alignment testing, commissioning, training and manuals, and final acceptance.

191BWC26R0016 | Page 13

• Identification of any assumptions, exceptions, discounts, or contingent pricing. Contingent or open ended pricing may make the proposal unacceptable.

• Confirmation that the offer remains valid for 90 calendar days after the proposal deadline.

L.08 Volume III, Administrative and Representations

• Signed SF 1449 or signed offer cover sheet identifying the solicitation number and legal offeror name.

• Acknowledgment of every amendment.

• Unique Entity Identifier, CAGE code, legal address, remittance address, and small business representation under NAICS 811310.

• Name, title, telephone number, and approved business email address of the authorized representative.

• Completed solicitation specific representations and disclosures required by Section K.

• Disclosure of actual or potential organizational conflicts of interest, or a statement that none are known.

• Identification of exceptions to solicitation terms. Silence constitutes acceptance of the solicitation terms.

L.09 Discussions, Clarifications, and Award Without Discussions The Government intends to evaluate initial proposals and may award without discussions. Offerors shall submit their best technical and price proposal initially. The Government may request clarifications or conduct exchanges permitted by FAR Parts 12 and 13.5, but is not obligated to do so.

L.10 Proposal Preparation Costs The Government will not reimburse proposal preparation, site visit, SharePoint access, or other solicitation response costs.

L.11 Contractor Responsibility The apparent successful offeror shall provide information requested by the Contracting Officer to support a responsibility determination under FAR 9.104. L.12 52.233-2, Service of Protest, Sep 2006

(a) Protests, as defined in FAR 33.101, that are filed directly with an agency, and copies of protests filed with the Government Accountability Office, shall be served on the Contracting Officer by obtaining written and dated acknowledgment of receipt from: Contracting Officer, United States Section, International Boundary and Water Commission, 4191 North Mesa Street, El Paso, Texas 79902, with an electronic courtesy copy to Suzette.Smith@ibwc.gov.

SECTION M, EVALUATION FACTORS AND BASIS FOR AWARD

M.01 52.212-2, Evaluation, Commercial Products and Commercial Services, Nov 2021

(a) The Government will award one firm fixed price contract to the responsible small business offeror whose proposal conforms to the solicitation, is technically acceptable, and has the lowest total evaluated price that the Contracting Officer determines fair and reasonable.

The Government will use a lowest price technically acceptable process. The nonprice factors are Technical Capability and Past Performance. Each nonprice factor will receive a rating of Acceptable or Unacceptable. No additional credit will be given for exceeding an acceptable requirement, and the Government will not make a price and technical tradeoff.

The evaluation factors are:

• Factor 1, Technical Capability.

• Factor 2, Past Performance.

• Factor 3, Price.

Technical Capability and Past Performance are not weighted against price. They are minimum acceptability requirements. Price will determine the apparent successful offeror among proposals rated acceptable under both nonprice factors.

(b) Options. No option CLINs are included. Paragraph (b) of the basic provision does not apply.

(c) A written notice of award or acceptance of an offer furnished to the successful offeror within the offer acceptance period shall result in a binding contract without further action by either party. Before the offer expiration time, the Government may accept an offer, whether or not exchanges occurred, unless the Government received a written withdrawal before award.

(End of provision)

M.02 Factor 1, Technical Capability The Government will evaluate the proposal as a whole and determine whether it clearly demonstrates the ability to meet every material PWS and solicitation requirement. Technical Capability will be rated Acceptable only when all subfactors below are acceptable:

Approach: The approach is complete, logical, feasible, and addresses repair, rebuild, installation, alignment, testing, commissioning, training, documentation, and warranty.

Compatibility: The proposal demonstrates a sound method to verify that OEM or equal parts will be fully compatible with the existing Ovivo equipment and that pinion gear and shaft work will meet applicable Ovivo specifications.

Relevant experience: The offeror demonstrates at least two relevant projects completed within the last five years, or other evidence that provides equivalent confidence in its ability to perform.

Key personnel: Proposed personnel possess qualifications and experience appropriate to the mechanical, electrical, instrumentation, quality, and project management work.

Schedule: The milestone schedule is realistic and shows completion within 180 calendar days.

Quality and safety: The quality control, inspection, testing, safety, and incident response processes satisfy the PWS.

Warranty: The proposal accepts and supports the required minimum one year warranty.

Small business performance: The proposed performance structure is consistent with FAR 52.219-14.

M.03 Factor 2, Past Performance The Government may evaluate submitted references and information from CPARS, SAM.gov, other Government databases, customers, and other sources. The Government will consider recency, relevance, quality, schedule control, cost or price control, management, safety, and customer satisfaction.

An offeror with no relevant past performance will not be rated favorably or unfavorably solely because of the absence of past performance. The Government may evaluate the offeror's experience information under Technical Capability

191BWC26R0016 | Page 16 and assign a neutral Past Performance rating when appropriate. For this LPTA evaluation, a neutral rating will be treated as Acceptable if the proposal otherwise demonstrates technical capability and responsibility.

M.04 Factor 3, Price The total evaluated price is the sum of all CLINS. The Government will evaluate price completeness, mathematical accuracy, reasonableness, and material unbalancing. The Government may use competition, comparison with the independent Government estimate, market research, historical prices, parametric methods, or other price analysis techniques permitted by FAR 13.106-3 and FAR 15.404-1(b).

The Government may reject a proposal with omitted prices, contingent pricing, material exceptions, materially unbalanced pricing, or a price that cannot be determined fair and reasonable.

M.05 Ratings Rating Definition Acceptable The proposal meets the solicitation requirement and presents no material deficiency or unacceptable risk.

Unacceptable The proposal fails to meet a material solicitation requirement, contains a deficiency, or presents risk that cannot be accepted without a material proposal revision.

M.06 Award Sequence

1. The Government will rank proposals by total evaluated price from lowest to highest.

2. The Government will evaluate the lowest priced proposal for technical acceptability, past performance, responsibility, and price reasonableness.

3. If the lowest priced proposal is unacceptable or the offeror is not eligible or responsible, the

Government may evaluate the next lowest priced proposal.

4. Award will be made to the lowest priced offeror that is acceptable under all nonprice factors, responsible, eligible for award, compliant with the total small business set aside, and priced fairly and reasonably.

5. The Government may evaluate all proposals or may stop when it identifies the lowest priced acceptable, responsible, and eligible offeror.

M.07 No Tradeoff and No Public Opening The Government will not make a best value tradeoff or pay a price premium for a technically superior proposal.

Proposals will not be publicly opened. Proposal information will be protected in accordance with applicable procurement integrity requirements.
