Statement of Work for Preparation of an Environmental Assessment for Proposed Dredging of a portion

Tijuana River in the City of San Ysidro, San Diego County California

I. SUMMARY

This Statement of Work (SOW) is to accomplish National Environmental Policy Act (NEPA) Environmental Assessment (EA) compliance for a United States International Boundary and Water Commission (USIBWC) requirement to increase the flood flow conveyance capacity of an approximately 1.5-mile reach of Tijuana River in San Ysidro, San Diego County California.

Tijuana River is an integral part of the USIBWC Tijuana River Flood Control Project (TRFCP).

The Tijuana River portion of TRFCP conveyance capacity that has been significantly diminished by accumulation of in channel sediment in the Tijuana River between the crossings of International Boundary and Dairy Mart Road in San Ysidro California.

II. BACKGROUND INFORMATION

The project location is shown in Attachment 1. The subject reach of Tijuana River is located in an urban area with limited access to the actual stream channel. The design flood conveyance of Tijuana River is 21,000 cubic feet per second (cfs). By 2012 accumulation of sediment and flood plain vegetation had diminished the conveyance capacity to 9,483 cfs. Selective vegetation removal completed in early 2017 has increased the conveyance capacity to 15,304 cfs.

Hydraulic modeling indicates that removal of an estimated 200,000 cubic yards (cy) will result in an increase of the conveyance capacity to 20,571 cfs or 98% of the original design.

The contractor will develop and evaluate alternative means of accomplishing of restoration design flow and in coordination with USIBWC, prepare the following deliverables in compliance with NEPA.

II.A. Agency Real Property Access and Ownership Real property ownership and easement authority that presently exists for USIBWC to accomplish the work that is the subject of this NEPA analysis is limited to levees and floodplain access from public roads.

II.B. Existing Site Specific Documentation Prior biological surveys and consultations and other site specific work has been completed in this project area. A list of these documents that will be furnished to the contractor are shown in Attachment 2. The information in these documents should be incorporated into the NEPA documents as appropriate.

III. DESCRIPTION OF WORK / SPECIFICATIONS

III.A. Duties and Responsibilities Questions and clarifications regarding this scope of work shall be immediately directed through the Contracting Officer. The Contractor, in coordination with USIBWC, shall achieve NEPA

III.A.1. Task 1. – Kickoff Meeting and Project Area Site Visit The Contractor shall perform the following tasks:

Attend morning kickoff to be held at USIBWC San Diego Field Office and participate in afternoon site visit in San Ysidro, California. Contractor shall record and deliver draft and final attendance logs and meeting minutes and provide copies of contractor site visit photos and field notes.

III.A.2. Task 2 – Fact Sheet The contractor shall research and prepare from existing information, a fact sheet suitable for the general public that provides history and context of the present role of Tijuana River in the TRFCP. Fact sheet will address community, environmental, regulatory and municipal concerns and serve as a baseline source of information available to interested parties and the media during the entire NEPA process for this action. Format, content, and distribution of this fact sheet will be coordinated and approved by USIBWC Public Affairs Officer and shall not exceed one (1) full page front and back.

III.A.3. Task 3 – Sediment Sampling and Analysis Plan The Contractor shall plan the collection and analysis of sediment samples from the bed of the perennial Tijuana River at the channel centerline including grab samples for constituent analysis and particle size distribution at up to 3 locations and at depths of up to 5 feet below the existing bed. Develop and deliver draft and final sampling and analysis plan including location and depth, utility clearance, site access, sampling methodology and recording and reporting of sampling locations and analytical methodology and Quality Assurance Quality/Control Plan. The required analytical parameters are provided in Attachment 3. The geotechnical analysis shall meet historic ASTM D422-63 (2007) e2 standard.

III.A.4. Task 4 – Conduct and Report Sediment Sampling and Analysis Report of analysis shall include Chain of Custody documentation and graphical representation of sample locations (geographic coordinate and/or channel centerline station number) and schematic channel cross section representations of geotechnical and chemical parameter results indicating water surface elevation, bed elevation, sample and total depth elevations.

III.A.5. Task 5 – Appropriate Technology Review Contractor shall research, compare and report on commercially available sediment removal, management and disposal methods and technologies that are applicable to this requirement with consideration to the stakeholder and regulatory concerns and site specific conditions. This deliverable is intended to identify and summarize applicable technology and provide a basis for informed stakeholder involvement and later development of alternatives for NEPA analysis and shall not exceed thirty (30) pages.

III.A.6. Task 6 – Stakeholder/Public Involvement Components Significant work has previously been conducted and stakeholders are well known. Contractor will use government furnished information augmented by contractor research to prepare and update stakeholder contact lists for use in all public involvement aspects needed later in this effort (including task 7 scoping meeting). A preliminary list of local stakeholders is shown in

III.A.7. Task 7 – Purpose and Need and Four Alternatives A conceptual draft of the Purpose and Need and four alternatives, including the no action alternative, is required for USIBWC review and concurrence prior to task 7 public scoping meeting. These will be used as basis for materials and presentation used in scoping meeting but may be significantly revised based on stakeholder responses. Alternatives must include all aspects of the action/technology proposed such as site ownership/access, staging areas, disposal areas, transportation and pipeline routes, environmentally sensitive or other areas or resources of special concern. USIBWC anticipates the 3 action alternatives to include two relying on sediment removal solutions and one accomplishing reduction of peak flow by means of off channel storage of a portion of peak discharge at one or more upstream locations adjacent to the Tijuana River.

III.A.8. Task 8 – Costed Option for Wetland, Cultural, and Biological Resource Survey and Reporting Contractor, with coordination and approval of USIBWC shall supply expertise to accomplish additional Wetland, Cultural, or Threatened and Endangered Species Survey and Reporting that may be required to complete evaluation of the alternatives developed under task 7. Costed Option may be provided based on cost per acre for combined resource survey and reporting.

III.A.9. Task 9 – Conduct Scoping Meeting Contractor, with coordination and approval of USIBWC at each step, shall plan, advertise, prepare and send invitations, facilitate, conduct, and report the results of a public scoping meeting. The Contractor shall publish USIBWC-approved public notices in at least two local newspapers prior to the scoping meeting. The meeting will be held in San Ysidro, California.

Contractor will be responsible for production of all meeting materials, displays, presentations, site visits that are required to fully inform and solicit input from stakeholders with respect to the purpose and need for action. This includes providing Word format drafts of all necessary Agency, Tribal and other stakeholder letters to be sent out by USIBWC. Any new stakeholders identified during the scoping meeting process will be included in revision of the task 5 Stakeholder/Public Involvement Components.

III.A.10. Task 10 – Internal Draft EA and Decision Document An internal draft of the full EA document (in accordance with 40 CFR 1500-1508) to include all significant impact, mitigations, figures, tables, maps, photos, agency and stakeholder coordination, and appendices shall be provided to USIBWC for technical and legal review.

III.A.11. Task 11 – Public Draft EA and Decision Document Upon receipt of all comment via USIBWC, the contractor shall prepare and deliver the Public Draft EA and Decision Document to USIBWC for posting with the USIBWC prepared Notice of Availability in the Federal Register and USIBWC website. Contractor shall include the most recent revision of the task 5 stakeholder contact list in order for USIBWC to conduct the stakeholder letter mailing.

III.A.12. Task 12 – Consolidate and Report Stakeholder Comment

All public comments received by USIBWC will be furnished to contractor at conclusion of public comment period for analysis, technical response, recording and summary. At a minimum, the Contractor will compile all comments into a comments matrix with appropriate recommended responses to be included in the NEPA document. Substantial comments may require a formal letter response, to be drafted by the Contractor.

III.A.13. Task 13 – Public Final EA and Decision Document for USIBWC Signature Any revisions to the EA and supporting documentation will be completed with coordination and approval of USIBWC and the Public Final EA and Decision Document along with complete administrative record delivered to USIBWC.

III.A.14. Task 14 – Costed Option Consulting Hours for Additional Analysis and Public Involvement Consulting hours for additional analysis and/or public involvement effort under this scope may be required.

III.A.15. Task 15 -- Project Administration Regarding project administration the Contractor shall:

1. Provide monthly progress reports, which should include description of work performed, pending issues or concerns, work to be performed during the next two month period, and detailed financial progress reports with the amount billed by task and percent task complete.

2. Provide monthly progress reports, including photos and field notes and map based depictions of work completed versus planned.

3. Provide spatial data of proposed sampling locations and depths, staging areas, travel routes, and project limits of disturbance associated with each alternative. Delivered geospatial data shall be contained in an ESRI file geodatabase that is compatible with the ArcGIS version currently used by USIBWC, or some other mutually agreed upon format as described by task order. Delivered geospatial data must have complete metadata that meets or exceeds the minimum content required by either the Federal Geographic Data committee's Content Standard for Digital Spatial Metadata (FGDC CDSGM) or the North American Profile of ISO 19115 2003 Standard or as specified in task order, and include detailed definitions of all layer attributes.

4. Provide overall project management and work coordination. Duties include project tracking, schedule oversight and contract administration. The Contractor shall maintain in close coordination and communication with USIBWC COR throughout the period of performance.

III.B. Government Provided Information and Property The Contractor shall furnish all labor, material, supplies, equipment, and personnel, unless otherwise noted. Attachments 2 and 4 are sources of data and stakeholder information known to the USIBWC that should be evaluated and considered by the contractor. Additional relevant information is likely to be identified by the contractor in execution of this effort. The USIBWC will retain ownership of all equipment purchased for and billed through this contract.

III.C. Performance Period

1. The period of performance for this project will be from the Notice to Proceed (NTP) plus 250 days.

2. The Contractor will provide a draft schedule which identifies the key milestones and project deliverables.

3. Any project or schedule delays or unforeseen issues will be addressed immediately by the Contractor.

IV. TASK ORDER LOGISTICS

IV.A Quality Assurance The Contractor performance and deliverables shall be subject to review by USIBWC technical staff and management to ensure adequacy, accuracy, and completeness. If project performance and deliverables do not meet the USIBWC acceptance criteria, the USIBWC reserves the right to issue corrective action to remedy the deficiencies. Corrective action may include withholding of payment and denial of schedule modifications until project deliverables are met. The USIBWC acceptance criteria may include: timeliness of scheduled deliverables; degree of technical accuracy & coverage of subject; compliance with legal requirements and industry standards; efficacy of design; legibility. In limited circumstances the USIBWC may request that advance copies of specific sections of the Environmental Assessment and Decision Document be provided for review prior to completion of the full deliverable. USIBWC may consult with stakeholders for input prior to acceptance of deliverables.

IV.B Changes

Changes to scope requirements shall be provided in writing to the CO for approval.

Under this task order, the Contractor shall furnish all labor, material, supplies, equipment, and personnel.
