SECTION B – SUPPLIES OR SERVICES AND PRICES/COSTS

B.1 Purpose of Contract

The Health Resources and Services Administration (HRSA) is seeking contractors to provide outpatient HD services, which includes diagnosing, screening, outpatient treatment, case management, and follow-up care in healthcare settings located throughout the United States. It is expected eight (8) separate contracts to be awarded to Ambulatory Care Clinics, in the states of Arizona, Arkansas, Georgia, Illinois, Massachusetts, Washington, and two clinics located in the State of California. Offerors may choose to bid on any of the states.

B.2 Compensation Cost/Price

B.2.1 In consideration of the satisfactory performance of the services and tasks detailed in Section J, Statement of Work (SOW) (Attachment A), and the contractor shall be compensated in accordance with the following amounts:

a. Base Period of Performance (POP) (start and end dates to be entered at time of award).

SECTION C – DESCRIPTION/SPECIFICATIONS/ STATEMENT OF WORK

C.1 Statement of Work

Independently and not as an agent of the Government, the contractor shall furnish all personnel, material, facilities, services, and equipment as needed to perform the Statement of Work set forth in Section J, Attachment A (Statement of Work) attached hereto and made part of this document.

C.2 Incorporation of Contractor’s Proposal

It is understood and agreed that the contractor shall, in meeting the requirements of this contract, perform the work in accordance with the contractors proposal to the HRSA originally dated _________and revised _________, provided however, that to the extent that any clauses of the articles of this contract are in conflict or inconsistent with any clauses of said proposal, the provisions of the articles of this contract shall control and shall supersede the provisions of said proposal; therefore, the contractors proposal is hereby incorporated into the resultant contract.

E.1 Inspection and Acceptance

The Contracting Officer Representative (COR), as a duly authorized representative of the Contracting Officer, shall assume the responsibilities for monitoring the contractor’s performance, evaluating the quality of services provided by the Contractor and performing final inspection and acceptance of all deliverables.

SECTION F – DELIVERIES OR PERFORMANCE

F.1 Observance of Federal Holidays

The following Federal Government holidays are established by law (5 U.S.C. 6103):

• New Year's Day (January 1).

• Birthday of Martin Luther King, Jr. (Third Monday in January).

• Washington's Birthday (Third Monday in February).

• Memorial Day (Last Monday in May).

• Independence Day (July 4).

• Labor Day (First Monday in September).

• Thanksgiving Day (Fourth Thursday in November).

• Christmas Day (December 25).

F.2 Core Days and Hours of Operation

The Contractor shall provide routine hours of operation, between the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday, that meet the health care needs (routine medication management, treatment of reactions, orthotics, physical examinations, etc.) of the HD population in the service area.

Hours of operation should be adequate to support the HD patient population in the area of patient residency. The contractor shall provide standard facility and clinic hours as well as provide emergency and after hour provisions.

F.3 Period of Performance (POP)

The period of performance shall be a base period of twelve (12) months with four (4) 12-month option periods. The option periods may be exercised in accordance with Section I, FAR Clause 52.217-9 “Option to Extend the Term of the Contract (MAR 2000)”. The period of performance under this contract shall commence with the effective date of the contract.

F.4 Place of Performance

The place of performance shall be at contractor’s outpatient healthcare facilities located in the states of Arizona, Arkansas, Georgia, Illinois, Massachusetts, Washington, and two clinics located in the State of California. (Addresses to be specified at time of contract award).

F.5 Schedule of Deliverables

Regardless of format, all digital content or communications materials produced as a deliverable under this contract must conform to applicable Section 508 standards to allow federal employees and members of the public with disabilities to access information that is comparable to information provided to persons without disabilities. Remediation of any materials that do not comply with the applicable requirements as set forth below, shall be the responsibility of the vendor.

SECTION G – CONTRACT ADMINISTRATION DATA

G.1 Designation of Contracting Officer Representative (COR)

The person identified below is hereby designated as the Contracting Officer Representative (COR) for this contract. The responsibility of the COR is to ensure that the Governments technical objectives are met. To this end, the COR will provide necessary information, direction, coordination, etc., within the contractual work description. Issuance of changes which affect the articles, terms, or conditions of this contract will be accomplished through the Contracting Officer who is the only party authorized to bind the Government to contract.

G.2 Contracting Officer’s Representative’s Responsibility

Technical Direction – The COR will provide the necessary information, direction, and coordination within the confines of the existing contractual work description in order for the contract to have a successful outcome for the government.

This includes providing technical direction to the contractor to guide the contract effort in order to accomplish the contractual statement of work. This may include providing information to the contractor for assistance in the interpretation of government provided information, specifications or technical portions of the work description, and where required by the contract, review and approval of product deliverables of the contractor to the Government under the contract. Only the Contracting Officer has the authority to make a formal change to the contract.

G.3 Restrictions on the Contracting Officer’s Representative’s Authority

Direction given by the COR to the Contractor must be within the parameters of the Statement of Work as stated in the Contract.

The COR may not issue any direction to the Contractor that:

1. Solicits a proposal, OR

2. Constitutes an assignment of additional work outside the Statement of Work of this

Contract, OR

3. In any manner causes an increase in the total contract cost or the time required for contract performance, OR

4. Changes any of the express terms, conditions, or specifications of the Contract (i.e., changes in the cost or scope of work, instructions to start or stop work, approval of any actions that will result in additional charges to the government).

Issuance of changes that affect the articles, terms, or conditions of this Contract will be accomplished through the Contracting Officer, who is the only party authorized to bind the Government to contract and the only party who can determine if a direction is within the Statement of Work.

G.4 Submission of Invoices and Place of Payment

You must be able to accept electronic payments and you must be registered in the System for Award Management (SAM) database (http://www.sam.gov). Your DUNS number and banking information must be current. Keep in mind that you must make changes in SAM if your bank merges with another bank or you change banks. You are responsible for updating the data in the SAM database and for re-registering before your expiration date. SAM will notify users by e-mail that their file is due to expire beginning 60 days prior to expiration, then 30 days and finally 15 days before expiration.

The contractor shall submit payment requests to the below address using Standard Form (SF) 1034, Public Voucher for Purchases and Services Other Than Personal.

Supporting documentation necessary to substantiate your request may be submitted along with the SF 1034.

Regarding technical issues, inspection and acceptance, call your Contracting Officer Representative (COR).

Regarding suspension or rejection of costs submitted, call your Contract Specialist.

Note: Your respective COR does not have the authority to (1) solicit proposals, (2) modify the stated terms of the award (i.e. change in price, change in scope of work), (3) issue instructions to the contractor to start or stop work, or (4) approve any action that will result in additional charges to the Federal Government. These changes are the sole responsibility of the Contracting Officer. The Federal Government will not be responsible for cost overruns or unauthorized procurements made by the vendor.

G.5 Evaluation of Contractors Performance

Interim and final evaluation of contractor performance shall be conducted in accordance with FAR Subpart 42.15. Upon contract completion, the Government shall complete a final evaluation of the contractor’s performance.

The Government will conduct an evaluation of contractor’s performance based on the completion of the tasks stated in the SOW. HRSA documents contractor performance using the Contractor

Performance Assessment Rating System (CPARS) (www.cpars.gov). The evaluation shall be conducted by the COR and be comprised of an evaluation of contractor performance completed by the Contractor and Federal staff, and a review of progress reports and financial reports (deliverables).

G.6 Key Personnel

The following Key Personnel shall be provided under this contract:

• Project Director or Business Manager

Education and Experience:

The program directory shall have a minimum of three year of specialized experience preparing reports and other written correspondence; diagnosing and resolving administrative problems; and devising new processes for managing the work of an office.

Duties:

The project director shall assists with planning, coordinating and implementing activities associated with administrative management, operations, equipment, space management, logistics, budget, travel and other areas for the performance accountability and management.

The project director shall work collaboratively with the Contracting Officer and COR to ensure work requirements under this contract are fulfilled.

• Physician

The physician shall have a degree in medicine or an equivalent degree resulting from a course of education in medicine with a permanent, full, and unrestricted license to practice medicine in a State, District of Columbia, the Commonwealth of Puerto Rico, or a territory of the United States. The physician shall have a minimum of three years of independent practicing experience.

• Shall perform medical screenings, evaluations, and treatment of HD and reactions.

• Shall provide medical oversight and coordinate overall care for the HD patients.

• Shall document care provided in the medical records.

• Shall collaborate with NHDP physicians as needed relating planning and managing medical care for patients.

• Shall refer patients to appropriate health care professionals as clinic judgment dictates and as outlined in the Statement of Work.

• Shall make a reasonable effort to treat HD patients prior to referring to NHDP.

• Registered Nurse

The registered nurse assigned to the contract shall be a graduate of a school of professional nursing approved by the appropriate State-accrediting agency and accredited by one of the following accrediting bodies at the time the program was completed by The Accreditation Commission for Education in Nursing (ACEN) or The Commission on Collegiate Nursing Education (CCNE).

The nurse shall have a minimum of three years of experience as a fulltime nurse.

Licensure:

The registered nurse shall have a current, full, active, and unrestricted registration as a graduate professional nurse in a State, Territory or Commonwealth (i.e., Puerto Rico) of the United States, or the District of Columbia.

• The nurse shall plan and deliver comprehensive healthcare service to individuals, families and communities with HD.

• The nurse shall conduct patient outreach for patients who have not kept clinic appointment or have lapse in their medication regimen.

• The nurse shall provide patient teaching regarding medication side effects, disabilities, stigma, reactions, treatment, and communicability of HD.

• The nurse shall be proactive in coordinating healthcare service with other healthcare professional, as the patient’s condition requires.

• The nurse shall coordinate videoconferencing with the COR of this contract twice per year to present cases seen in their clinics.

Consultative or Referral Labor Categories

• Physical Therapist

The physical therapist shall be a graduate from a degree program in physical therapy from an approved college or university in physical therapy from an approved college or university approved by the Commission and Accreditation in Physical Therapy Education (CAPTE). The CAPTE is the only accreditation agency recognized by the United States Department of Education (USDE) and the Council for Higher Education Accreditation (CHEA) to accredit entry-level physical therapy programs.

The physical therapist shall have a minimum of three years of full time experience.

Current, full, active, and unrestricted license to practice physical therapy in a State, Territory or Commonwealth (i.e., Puerto Rico) of the United States, or in the District of Columbia.

• Screen, assess, and evaluate the functional, physical, and psychological capabilities while considering capabilities, environment, disease and treatment.

• Coordinate and collaborate with interdisciplinary team members regarding the plan of care.

• Manage and monitor and determine the best course of treatment for insensitive neuropathic feet.

• Educate patients on disease process and course of treatment.

Successful completion of at least a Doctor of Podiatric Medicine (D.P.M.) from a school of podiatric medicine accredited by the Council of Podiatric Medical Evaluation in the year in which the degree was granted.

Shall have a minimum of three years of experience working in the field of podiatry.

Applicants shall be currently licensed to practice podiatric medicine in one of the States, the District of Columbia, or Puerto Rico.

The ophthalmologist shall have a degree in medicine or an equivalent degree resulting from a course of education in medicine.

Shall possess a current, full and unrestricted license to practice medicine or surgery in a State, Territory, or Commonwealth of the United States, or in the District of Columbia and be board certified in Ophthalmology.

The ophthalmologist shall perform eye exams, diagnose and treat diseases of the eye, prescribe medications, provide medical management of eye conditions and perform eye surgery.

• Occupational Therapist

The occupational therapist shall possess have a degree program in occupational therapy approved by the Accreditation Council for Occupational Therapy Education (ACOTE) or predecessor organizations to include interns (supervised fieldwork experience required by the educational institution). The ACOTE is the only accreditation agency recognized by the United States Department of Education (USDE) and the Council for Higher Education Accreditation (CHEA).

The occupational therapist shall have a minimum of three years of full time experience in an acute, chronic, rehabilitative, or outpatient facility.

The occupational therapist shall hold a full and current unrestricted state Occupational Therapist License and possess written documentation that the individual has passed the entry-level certification examination for OTs, which is administered by the National Board for Certification in Occupational Therapy (NBCOT).

I.1.1 Federal Acquisition Regulation (FAR) Contract Clauses – Full Text

FAR 52.217-9 Option to Extend the Term of the Contract (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

The key personnel specified in this contract are considered to be essential to work performance.

At least 30 days prior to the contractor voluntarily diverting any of the specified individuals to other programs or contracts the Contractor shall notify the Contracting Officer and shall submit a justification for the diversion or replacement and a request to replace the individual. The request must identify the proposed replacement and provide an explanation of how the replacement's skills, experience, and credentials meet or exceed the requirements of the contract (including, when applicable, Human Subjects Testing requirements). If the employee of the contractor is terminated for cause or separates from the contractor voluntarily with less than thirty days’ notice, the Contractor shall provide the maximum notice practicable under the circumstances.

The Contractor shall not divert, replace, or announce any such change to key personnel without the written consent of the Contracting Officer. The contract will be modified to add or delete key personnel as necessary to reflect the agreement of the parties.
