The MSLC reserves the right to request additional information from Bidders responding to this request. Additionally, upon reviewing the responses the PMT may decide to have certain Bidders make oral presentations.

The MSLC reserves the right to reject any and all responses to this request, to waive any minor informality in a response, and to request clarification of information from any Bidder responding. The MSLC reserves the right to amend or cancel this RFR at any time.

All responses and their contents will become the sole property of the Commonwealth/ MSLC upon receipt and will not be returned to the Bidder.

The MSLC will not reimburse any Bidder for any costs associated with the preparation or submittal of any response to this request or for any travel and/or per diem incurred in any presentation of such responses.

The narrative response should address all items included in each section under RFR

Disqualification of Responses:

Late Proposals: Proposals that are received after the deadline date and time shall be automatically disqualified.

Non-responsive Proposals: A response that fails to meet any material term, condition, requirement or procedure of this RFR may be deemed unresponsive and disqualified. The MSLC reserves the right to waive or permit cure of non-material errors or omissions. Non-responsive proposals shall include, but not be limited to those, which fail to address or meet any mandatory item, and those submitted in insufficient number, or in incorrect format.

Collusion: Collusion by two or more Bidders agreeing to act in a manner intended to avoid or frustrate fair and open competition is prohibited and shall be grounds for rejection or disqualification of a proposal or termination of this contract. Bidders will be required to complete a “Certificate of Non-Collusion” as one of the mandatory forms to this RFR.

Debarred Bidders or Subcontractors: A Bidder, who is currently subject to any Commonwealth or federal debarment order or determination, shall not be considered for evaluation by the PMT. If a Bidder’s proposal is dependent upon the services of a named subcontractor and the disqualification of this named subcontractor would materially alter the proposal, then that proposal shall be deemed unresponsive if the named subcontractor is found to be debarred. Proposals that indicate that subcontractors will be used but do not rely on any specifically named subcontractor shall not be deemed unresponsive if the disqualification of a proposed subcontractor will not materially alter the proposal.

RFR EVALUATION PROCESS

Evaluation Process:

The RFR Evaluation Process will be conducted in three phases. A review team will complete the Phase I Review for all proposal submissions. The purpose of the Phase I Review is to eliminate any bids that are non-responsive to the requirements of the RFR. Bids that are deemed to be qualified based on the Phase I Review will be submitted to the PMT for additional review. The PMT will consist of staff from the MSLC. The PMT will make a recommendation to the Commissioners of the MSLC who will then accept or reject the recommendation. (Phase I, Phase II and Phase III of this RFR will be evaluated separately.)

Phase I Review:

Bidders’ responses will be reviewed based on listed criteria and completeness of response, including mandatory forms and compliance to submission criteria. Bids that do not comply with these components will be rejected and will not proceed to the Phase II Review. The MSLC reserves the right to waive or permit cure of non-material errors or omissions.

Phase II Review:

Qualified bids, based on the Phase I Review, will be considered for additional review in Phase II by the PMT. The Phase II Review may also include any oral presentation/interview as may be requested by the PMT; the PMT may adjust a Bidder’s score based on any clarification of the Bidder’s response at any such oral presentation/interview. (See Section III.C.2). The Phase II Review will count for 65% of each Bidder’s score.

Phase III Review:

Cost will be evaluated in relationship to the Phase II Review and scoring of Bidders' responses. The successful bid will be determined based on the one that represents the "best value" overall and achieves the procurement goals.

ORAL PRESENTATIONS / INTERVIEWS

After completion of Phase I and initial review of Phase II but prior to Phase III, the PMT shall have the option to invite all or some Bidders to make oral presentations/come in for interviews. Oral presentations/interviews provide the PMT with an opportunity to evaluate the Bidder through the presentation of their proposal. The PMT will make the decision on whether to have Bidders in for oral presentations/interviews. The decision to engage in oral interviews will solely be in the purview of the PMT. Based upon scores determined during the initial Phase II evaluations of Bidders responses to the Phase II technical questions; it will be within the full discretion of the PMT to determine the cutoff for top scoring Bidders to move onto the oral presentations /interviews. If the decision is made to request oral presentations/interviews, then only Bidders that receive an invitation to participate in oral presentations/interviews will proceed to cost evaluation and Phase III. Bidders that do not receive an invitation to oral interviews will be eliminated from further consideration under this RFR. Bidders will not be informed of their rank at the time of the oral presentation/interview. Additionally, the PMT reserves the right to adjust any Phase II score following any Oral Presentation/Interview, and before proceeding on to Phase III.

The time allotments and the format shall be the same for all oral presentations/interviews. The PMT will give the Bidder at least three (3) business days prior notice regarding the date of an oral presentation/interview. The PMT may waive the location and medium requirements of an oral presentation/interview upon the written request of a Bidder due to special hardships, such as a Bidder with disabilities or limited resources. In these circumstances the PMT may conduct oral presentations through an alternative written or electronic medium (e.g., telephone, videoconference, TTY or Internet). The PMT may require the Bidders assign key personnel to conduct the oral presentation/interview.

A Bidder is limited to the presentation of material contained in its proposal, with the limited exception that a Bidder may address specific questions posed by the PMT or provide clarification of information contained in its proposal. Any other correction or modification of the proposal or the presentation of supplemental information shall be considered prejudicial to the interests of other Bidders and fair competition and shall not be permitted. A Bidder’s attempt to submit such corrections, modifications or supplemental information during an oral presentation/interview may subject the Bidder’s proposal to disqualification. A Bidder’s failure to agree to an oral presentation/interview may result in disqualification from further consideration. Oral presentations may be recorded by the MSLC as a matter of public record.

On-Site Visits (Optional). The PMT reserves the right to conduct on-site inspections of any or all Bidder locations at any time prior to the awarding of this contract to verify the Bidder’s ability to perform the services required. The PMT shall schedule the time of these site visits and shall provide notice of at least three (3) business days before a visit. Failure to agree to a site visit may result in disqualification of a Bidder’s proposal. Only those firms that were evaluated in Phase II and were invited for an oral presentation / interview will be the subject of an on-site inspection, in the event the PMT elects to conduct such an on-site inspection.

PRINTING SPECIFICATIONS

It will be the print vendor’s responsibility to make sure its vendors are aware of the requirements in any components that they supply or apply to the thermal paper stock.

The print vendor must:

· Confirm with the ink vendor that the ink being used is recommended for direct thermal printing applications.

· Confirm that the inks used have good hot mar resistance so the inks do not get soft and build up on the print head which will cause damage.

· Submit converted roll samples to the MSLC for inspection and evaluation against the requirements as defined in this RFR. Samples must be submitted in response to this RFR or any time the design changes. Re-approval must take place when any change is made to the front design of the ticket or the backer except in the case where there is a simple text change where the color is not affected.

1. Ticket Stock Face (Thermal Side): A uniform background across the face side of the ticket stock is necessary so the artwork does not interfere with the OMR sensors or characters printed on the ticket. The background color is PMS 177. The front side of the ticket roll will be printed repeatedly with display art, logo-type, and/or copy (printed text) in an ink color that is either a screen or dot matrix. Presently, there is only one color on the front. To assure production of working stock, all ticket designs and secondary ink colors must be submitted and approved by the MSLC. See Below.

2. In the future there may be a secondary ink that will have its own specifications and will be priced separately.

3. Ticket Stock Reverse (Non Thermal Side): The reverse side of the ticket stock will be printed with approved copy (printed text) in PMS 177 red ink, and repeated in an increment not greater than 2.00 0.25 in. (50.8 mm 6.35 mm). In addition, sequential numbering can be printed on the reverse side consisting of a unique prefix identifier, avoiding any duplicate numbers. There will be a minimum clear margin of 0.500 in. (12.70 mm) on both sides of the printed text. PMS 177 red ink shall have a spectral reflectance within 10% of the stock (ink pattern reflectance value must not exceed 90%). See Below.

TICKET STOCK FACE (THERMAL SIDE)

TICKET STOCK REVERESE (BACK)

Also printed on the back is an invisible florescent color, such as florescent yellow. This florescent yellow color, when printed will not appear visible to the eye, and will show up only under a black light. The spectral reflectance of this color is +/- 20% of the virgin stock reflectance number. It does not show up as a color and reflects almost all the light.

4. End-of-Roll Stripe (“EOR”): An EOR warning stripe must be printed on the reverse side of the ticket stock. The stripe must be printed in black ink that is visible to the sensor in the printer. The EOR stripe must have a maximum reflectance of 10% as measured on the MacBeth PCM II using the 660 nm filter setting or equivalent measuring instrument.

The EOR must be solid and continuous with no bleed through, 36.0 ± 6.0 in. (914.40 ± 152.44 mm) in length and 0.50 ± 0.030 in. (12.7 ± 0.76 mm) wide. There will be no white paper visible between the EOR warning stripe and the edge of the paper.

5. Agent Warning Stripe: An Agent Warning Stripe must be overprinted on the face of the ticket stock. Preferred color is Warm Red. The Agent Warning Stripe must be 0.25±0.05 in. (6.35± 1.27mm) wide and 36 ± 6.00 in. (9140.00 ± 152.4mm) long. The Agent Warning Stripe reflectance shall measure within 10% of the printed base.

6. Durability: Ticket stock which has been printed must remain readable regardless of environment encountered in normal handling and usage for a minimum of 18 months from delivery date to the MSLC by the printer.

WASTE DISPOSAL

MSLC paper stock shall never, under any circumstances, be furnished by the Vendor or his/her representative to any other country, state, organization, company, agency, jobber, distributor, or individual other than directly to the MSLC at their designated location(s).

All salvage stock created in the manufacturing process, printed and/or numbered, will be shredded before removal.

IMPORTANT: The height of any and all pallets (actual pallets, cases of rolls and wooden pallet topper) must not exceed 63 inches in total height and have the ability to triple stack.

7. No disposable pallets will be allowed.

8. No pallets will be returned to the vendor.

9. Each pallet must not exceed 63”, contain 60 cases with 6 rolls per case for a total of 360 rolls per pallet.

MSLC WAREHOUSE MANAGEMENT SYSTEM

The MSLC uses their Warehouse Management System (“WMS”) to track the actual receipt of a pallet, actual physical location of a pallet in any MSLC warehouse, the transferring of a pallet between any MSLC warehouses, and the status of a pallet as to whether in stock, opened, and or consumed. This information will be provided on four (4) 8 ½” x 11” minimum white load tags. These load tags will specify the following:

· Product Identification

· Purchase Order #

· Pallet Number

· Manufactured Date (Born on Date)

The successful vendor must adhere to the following requirements in order for the vendor supplied pallet load tag and our WMS System to operate:

1. Four (4) 8 ½” x 11” minimum size load tags applied to the outside of the stretch wrap – one (1) on each of four (4) sides.

2. Load tag to be white.

3. Barcode to be in 3/9 HRD or 128 HRD

4. Height of the barcode must be a minimum of (1) inch.

5. The 1st line of the load tag must be 24 characters in length, and example is as follows:

PC01132858 1 0102 011816

The format is as follows:

· Purchase order # (10 characters), in this example is PC01132858

· A blank space

· 1 (is in the line # on a Purchase Order and is usually 1)

· Skid # (4 characters – This unique number will be the starting number and will be mutually agreed upon), in this example the skid number is 0102

· A blank space

· MMDDYY (this will be the manufacturers date and will be referred to as the “Born on Date”), in this example the date is 011816.

SAMPLE PALLET LOAD TAG

NOTE: BIDDERS RESPONDING TO THIS RFR MUST SUBMIT A SAMPLE LOAD TAG AS PART OF THEIR SUBMISSION

As the MSLC Warehouse Management System implements additional functionality, there is the potential to add additional bar coded information to the products. This additional information may require modifications to the existing label described above or may require any new bar coded information to appear on a pallet load tag and/or a second label to be provided by the vendor.

Carton Numbering and Labeling.

Cartons of thermal paper should be labeled (for example) as follows:

MASSACHUSETTS STATE LOTTERY COMMISSION

THERMAL PAPER ROLLS

DATE OF PRESS DATE CUT

Final label must be approved by MSLC.

Ordering Flexibility.

In general, printing orders for thermal paper rolls shall be placed in production lots to conform to usage levels and to the quantity of rolls that can be accommodated conveniently in full trailer truck loads/straight trucks. The MSLC generally prefers to have approximately a 3-month inventory of thermal paper rolls on hand and will order to insure that this level is maintained. Vendors should be advised that the MSLC, however, reserves the option to order any quantity of thermal paper rolls at any given time if it is in its best interests to do so. Thus, a requirement of this procurement is that the MSLC must have complete flexibility to order any quantity of thermal paper rolls it feels is necessary to meet its current and anticipated needs.

DELIVERY

Each shipment must be in a minimum 48’ non refrigerated trailer, 22 skids per shipment, and 7920 rolls per shipment. These shipments are to be in sealed, exclusive use trailers with a numbered seal to go directly from the Vendors plant to the designated MSLC locations. These trailers must not stop or deliver anything, anywhere except to the designated MSLC locations. These trailers must not carry anything else except thermal roll ticket stock. The MSLC has storage warehouses in Springfield, Worcester, Woburn, New Bedford, Canton, Braintree, Rowley, and Chelmsford Massachusetts. Vendors are required to be prepared to drop-ship portions of trailer loads at one or more of these locations at the MSLC’s request and be resealed by the MSLC. Shipments will be made to our Braintree and Canton locations between 6:00AM – 12:00PM. Other warehouses receive shipments between 8:00AM – 2:00PM.

Platform delivery is required.

The delivery of thermal paper rolls must be made on a schedule acceptable to the MSLC and the vendor must be willing to guarantee an agreed-to-delivery schedule.
