(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) of this paragraph in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

(a) Definitions. As used in this clause-
(1) Contract financing payment has the meaning given in FAR 32.001.
(2) Invoice payment has the meaning given in FAR 32.001.
(3) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.
(b) Electronic Payment Requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this clause, and therefore no additional electronic invoice submission is required.
(c) Data Transmission. A contractor must ensure that the data transmission method and format comply with the following provisions:
(1) The contractor shall:
a. Address the invoice to the appropriate e-mail address specified in the contract.
b. Submit the invoice via attachment in PDF or TIFF format.
c. Submit only one invoice per electronic submittal.
d. Enter specific information in the subject line of the e-mail in the following format:

The U.S. Department of Labor, Mine Safety and Health Administration (MSHA) is responsible for enforcing health standards promulgated under the authority of Section 103 (a) of the Federal Mine Safety and Health Act of 1977. A national network of MSHA inspectors collects health samples at approximately 880 coal mines located in the United States and its territories to monitor miners’ exposures to hazardous contaminants. Respirable coal mine dust samples are analyzed for quartz using validated analytical methods and citations are issued to mine operators if exposure limits are exceeded. (a) North American Industry Classification System (NAICS) code and small business size standard. (b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. (c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers. (1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m.
one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. 1.0 BASIS FOR AWARD
The Government contemplates award of a Purchase Order under the Best Value continuum using the Tradeoff source selection process as a result of this Solicitation. Award will be made to the responsible vendor whose quote is determined to conform to the solicitation, Product Specification, meets the delivery requirements, rates the best in performance during testing, and is fair and reasonable in price.
In using the Tradeoff approach, the Government seeks to award to the Seller who gives the Government the greatest confidence that it will best meet or exceed the requirements affordably in a way that will be advantageous to the Government.
This may result in an award to a higher rated, higher priced quote where the decision is consistent with the evaluation factors and the Source Selection Authority (SSA) reasonably determines that the technical superiority of the product outweighs the cost difference.
The government does not intend to make an award at risk premium. The Government reserves the right to conduct discussions if determined necessary but intends to award without discussions.
2.0 EVALUATION FACTORS
The Government’s evaluation will be based on the following factors and subfactors:

4.0 PROPOSAL EVALUATION
Each Seller’s technical and past performance responses shall be evaluated based on the factors/subfactors below, to determine if the product meets the requirements of the government and demonstrates that it will best meet or exceed the requirements affordably, in a way that will be advantageous to the Government.
4.1 Factor 1. Technical – Subfactor a. Adherence to Product Specification An acceptable response must fully address the salient characteristics of the product, the estimated delivery date, any exceptions taken to the product's specifications and/or delivery schedule, and additional terms/conditions proposed by the contractor and shall conform with the following:
The salient characteristics of the polypropylene membrane filters used in the FTIR (Fourier Transform Infra-red) analysis for crystalline quartz in coal mine respirable dust samples are 19 mm diameter, 0.45 µm pore sized, and are hydrophilic with a typical thickness of 114 µm (4.5 mils). The membrane filters must have a uniform porosity and thickness and not contain any artifacts that interfere with the determination of crystalline quartz and kaolinite* by FTIR.
*Kaolinite clay can also be present in coal dust and interferes by absorbing radiation at the same wavelength as quartz. If kaolinite is present in the sample it must be quantified and subtracted from the measurement of quartz.
4.2 Factor 1. Technical – Subfactor b. Product Performance & Characteristics A sample of ten polypropylene membrane filters from each product bid shall be submitted with your quotation in order to be considered for award. The samples will be scanned by FTIR (Fourier Transform Infra-red) between the wave numbers of 1,000 and 700 cm¿¹ to view how much radiation is absorbed by blank filters and whether or not samples from the same lots are consistent. Blank filter scans will also be examined for residual peaks that show up at the same wavelengths where the laboratory measures for quartz and kaolinite, (815-770 cm¿¹ and 930-900 cm¿¹). If the media does not contain artifacts at those wavelengths and returns consistent blank scans for the entire lot, a slurry containing approximately 1.0 mg of respirable sized NIST 1878b quartz standard reference material in 15 mL of Technical grade isopropyl alcohol will be deposited on five of the filters via vacuum filtration to observe the time it takes for the slurry to make its way through the filter. The deposition process will include one rinse of the funnel with another 15 mL of isopropyl to duplicate the standard procedure used by the laboratory. Although there is no standard for the time it should take for a sample to be re-deposited on the polypropylene media, the lab is looking for filters that take the same amount of time or less than the time it takes using the current polypropylene media. This process will be duplicated for the remaining five filters using approximately 1.0 mg of respirable Georgia Kaolin so that all ten filters can be scanned by FTIR and calculate recoveries of the reference materials on the media.
Results should be within ± 10% of the weighed amounts.
4.3 Factor 2. Past Performance
Past performance shall be evaluated as a measure of the Government’s confidence in the seller’s ability to successfully perform based on previous and current contract efforts. In addition to information supplied by the seller, the government may review the Past Performance Information Retrieval System (PPIRS), and any additional information to which the Government has readily available. The Government reserves the right to verify statements and representations made in the quote. For sellers with no relevant corporate past performance, the Government may take into account information regarding the past performance of predecessor companies, key personnel with relevant past performance, or subcontractors that will perform key aspects of the requirement.
In addition, the product’s performance will also be evaluated through the examination of references for laboratories currently using the seller’s products. Please include names of customers that purchased the same proposed polypropylene media for the purpose of conducting quartz analysis using NIOSH Method 7603.
5.0 SUBMISSION REQUIREMENTS
5.1 SYSTEM FOR AWARD MANAGEMENT (SAM) REGISTRATION
Sellers submitting quotes must be registered in the System for Award Management (SAM) with complete Representations and Certifications to receive the award.
5.2 REQUIRED DOCUMENTS
Submission MUST include at a minimum, the vendor’s own proposal document containing enough information for the government to make a decision on the technical acceptability of the product and adherence to the Product Specification.
General attachments to the quote shall not exceed twenty (20) pages. FAILURE TO RETURN THE REQUIRED DOCUMENTS AND SAMPLES MAY RESULT IN YOUR QUOTATION BEING DEEMED UNRESPONSIVE AND WILL
NOT BE CONSIDERED FOR AWARD.
Quotation packages must be submitted in hard copy, by mail, in two parts:
Part 1) Quotations documents to include the required provisions, Technical, and Past Performance responses, shall be submitted in hard copy; and Part 2) Sample filters required in the Technical response shall be submitted in a separately sealed package to be forwarded to the laboratory for testing.
The seller must send the quotation package via a major mail carrier and obtain a tracking number. The package must be marked “CONFIDENTIAL – MAILROOM DO NOT OPEN” and be sent to the address below by the closing date of the requirement:

5.2.1 REQUIRED PROVISIONS
