Attachment J-12, Energy Watch Dog Data Report, contains 2019 YTD amounts for electric, water and natural gas. Please clarify the specific months involved for these 2019 YTD amounts? The report covers the actual calendar year. It consists of three years of operations. The reporting for 2019 is not yet complete.
Attachment J-12, Energy Watch Dog Data Report, indicates that the Flint Genesee Center has experienced a 100%+ increase in water costs from 2016 to 2017, and continuing in 2018 and 2019 YTD. The attached Facility Survey is dated November 2016 and does not identify any apparent water issues at the time. Please clarify the specific cause for this significant cost increase to the Center and Government. The center has had two water main breaks during the past year. Both breaks have been repaired.
Page 8 Please confirm that National Training Contractors (NTCs) will be responsible for providing training supplies and materials for NTC-operated trades. The NTCs provide materials and supplies used exclusively in the training programs that they operate. Center operators are not expected to purchase any training supplies and equipment. As needed, the Government provides funding to purchase select large equipment. The equipment becomes part of the center’s inventory.
Page 18 The current Flint Genesee contract includes the State of Michigan OA/CTS component. Will the successful offeror be responsible to provide CTS services to all graduates and former enrollees that are on the State of Michigan CTS caseload at time of contract award? No. Please note Page 8 of the Solicitation. "The Contractor shall provide Career Transition Services for all graduates and former enrollees of the center, regardless of where the graduate or former enrollee resides or matriculates."
Page 20-21 National Training Contractors are responsible to identify, hire and train designated CTT Instructor positions, independent of Center authority. Please confirm that Center operators will not be held responsible for NTC-operated CTT Instructor staff vacancies that exceed the 30-day requirement. NTCs are required to maintain adequate staffing for the CTT offerings provided by them. The center operator will be held accountable for reporting staff vacancies.
Page 10 Please clarify if the NTE amount for travel includes every day travel in the course of providing Admissions and CTS services in the territory or if it is for training travel only. No. The NTE for travel is intended for center operations only. OA and CTS components have their own travel expenses incorporated into their budget.
Page 19 In accordance with PRH Appendix 604, "Licensing" under whose name is the On-Center Child care Center licensed and what is the current status of the license for the child care center? The Child Care Center is licensed and operated by the State of Michigan. The center is fully operational and we expect this to continue. The license is held by the current contractor.
Page 19 A public search for the license using the State of Michigan licensing site does not show a license for the current address (https://childcaresearch.apps.lara.state.mi.us/). If the center is not licensed at the time of transition is the incoming operator expected to remove students from the On-center Child Care Center? No. The Child Care Center is fully operational and we expect this to continue. The operator becomes the license holder for the center. The license is transferred as the contract changes. It is the responsibility of the operator to obtain and maintain the license with the State of Michigan.
Page 19 In accordance with PRH Appendix 604, "Funding" how is the on-center child care center funded? If the operation and funding of the center is under a Memorandum of Understanding or agreement, please state the name of the funding organization and if available, provide a copy of the Memorandum of Understanding or Agreement. The Child Care Center is licensed to the center but operated by the State of Michigan. There is no MOU.

| Section 2. Demonstrated Record of Effectiveness (Past Performance) - Past | ||
| Performance Questionnaires | The key personnel of small business concerns may be former personnel of Job Corps operators. Will the government accept the relevant experience of the key personnel in place of the J-7 attachment (Performance Confirmation Questionnaire)? | In accordance with Section L.7 of the Request for Proposal: "You may identify projects performed by predecessor companies, by key personnel working for other organizations, and by subcontractors that will perform major or critical aspects of the requirement. In such cases, you should provide information to explain the experience and its relevance to this solicitation." (emphasis added). However, please note that per Section L.7: "Past Performance Questionnaires: For each project identified in this section for which there is no report in the Past Performance Information Retrieval System (PPIRS), you must complete Section A of Attachment J-7, Performance Confirmation Questionnaire. You must forward this questionnaire to the Government agency or company listed as a reference for the project and request that the Relevant Past Performance evaluation be completed for Sections B-F of Attachment J-7. Each agency/company evaluator must return the questionnaire directly by email to the Contracting Officer and Contracting Specialist identified in this Solicitation." |
| Section 2. Demonstrated Record of Effectiveness (Past Performance) - Past | ||
| Performance Questionnaires | Disadvantaged small businesses seeking to enter the Job Corps market may not have experience managing projects under the small business's name. However, key personnel have overseen identical functions for other corporations. How will the totality of work experience of key personnel be evaluated, in light of no PPQs or projects under the corporate entity?
| Factor 2 Demonstrate Record of Effectiveness | ||
| (Past Performance) | The referenced section does not discuss how the government will evaluate the Relevance determination and Quality of Performance determination of the key personnel as responded to in Section 2. Demonstrated Record of Effectiveness. In Section 2, it appears that offerors may describe the experiences of the key personnel in light of the formation of new entity. Factor 2, Demonstrate Record of Effectiveness states, "If the Offeror is a newly formed entity....." --- Will the government revise the language to state: "If the Offeror is a newly formed entity, the Government will evaluate the experience of the key personnel of the individual entity, individual entity, or entities that compromise the newly formed entity." | The determining factor regarding relevancy is not the personnel or the entity involved, rather it is the project. Per Section M.1 of the Request for proposal: "Relevance determination. Only those projects deemed relevant will be considered in the evaluation of past performance. Relevant projects are those of similar size, scope and complexity to the work required in this solicitation. Relevant projects may include operation of a Job Corps center or similar facility. The narrative provided by the offeror (per the instructions at Section L) regarding their past record will be used solely to establish the relevance of the projects identified by the offeror (i.e., DOL will use the information submitted in response to Section L to identify the projects that are similar in size, scope, and complexity to the current project). However, DOL may identify other projects, not identified by the offeror in its proposal, which DOL deems relevant and will be considered in the past performance evaluation. Note that only projects performed in the last three years and lasting at least twelve months will be deemed relevant. Projects found not to be similar in scope, size or complexity and projects older than three years or lasting less than 12 months are not relevant and will not be considered." |
Business Mangement Data Small business concerns-- 8(a) certified, HUBZone certified, and minority-owned small businesses-- face difficulties accessing financial resources to operate multi-millions dollar Job Corps contracts. The difficulties both delay entry into the Job Corps market and/or places an unfair burden on small businesses to partner with large corporations who exert unfair advantages. Similarly, Alaskan Native Corporations, who compete under small business set-asides leverage ANC corporate headquarter's finanical resources. Will the government consider other financial capability strategies to allow small business concerns to enter the Job Corps market on a level field and without dependence on large operators? The Department of Labor's market research indicates that there are mulitple small businesses capable of providing the required services as explained in the Request for Proposal.
Page 83 States: "In addition to the written pricing proposal, offerors shall provide the following using Microsoft Excel." Please clarify if the written pricing proposal is referencing a required narrative of cost. See L.7, Section 4a, Business Management Plan.
Page 82 In reference to this sentence “Projects identified should include work experience within the three (3) years preceding the submission of this proposal, and for at least one year in duration.” Can the prime and subcontractor submit a listing of projects as an appendix that is not included in the 5 page limit for Section 2 Past Performance? The projects submitted are considered the Narrative portion of the Past Performance portion of the Proposal and will be subject to the applicable page limit. Refer to Section L.6 for additional information.
Page 83 Can Phase-In/Phase-Out schedules not be included in the 10 page limit for staff resources and provided as an appendix? The Phase-In/Phase-Out schedules are a required part of the Staff Resources Proposal, and are subject to the applicable page limitations.
Section F Deliveries or Performance, Page 23 Section F.3 Period of Performance includes "(insert dates)". Please confirm the dates should be as follows:Phase In: If appropriate, for the purpose of assuming the responsibility of center operations, the Contractor shall perform necessary phase-in functions from June 1-30, 2020.Operations: Center Operations shall commence in accordance with Section B of the contract.Outreach and Admissions and Career Transition Services shall commence on (insert date if different than time of award).Phase Out: If appropriate, for the purpose of transitioning the responsibility of center operations, the Contractor shall perform necessary phase-out functions from July 1-31, 2025. The dates are to be determined.
Are the pricing forms on pages 10-14 required as part of the BMP? Yes, the pricing forms are required as part of the BMP.
(Section 4. Business Management Proposal) lists Statement of Financial Capability (ETA 8554) and statement from a lending institution, as requirements for the proposal. Job Corps contracts are now Firm-Fixed Price (FFP). FAR 32.403 discusses the Applicability of Advance payments. Will the government allow Advance Payment for Non-commerical items as referenced in FAR 32.403, in light of the following:
-- FAR 32.403 (b) Contracts solely in the management and operation of Government-owned plants?
-- FAR 32.403 (e) Contracts entered into financially weak contractors whose technical ability is considered essential to the agency?
-- FAR 32.403 (f) (2) Loans with reasonable interest rates or finance charges are not available to the contractor?
-- FAR 32.403 (g) Contracts with small business concerns, under which circumstances that make advance payments appropriate?
-- FAR 32.403 (h) Contracts under which exceptional circumstances make advance payments the most advantageous contract financing method for both the Government and contractor? The offeror may propose advanced payments in their proposal, which may then be considered in the Government's evaluation of the offeror's proposal.
Business Manamagement Data, 2 - Statement of Financial Capability (ETA 8554) - J2 Attachment Job Corps contracts are now Firm-Fixed Price (FFP). Sections D and E of the ETA 8554 make reference to Advance Payment. Will the government accept "Estimated Amount for Advance Payment" as an acceptable response to demonstrate financial capability of covering one-month's cost of the contract? The Government cannot assess the acceptability of such a comment as part of an advanced evaluation of a potential offeror's proposal. Such a statement would be evaluted in the proper context of the proposal to determine if sufficient financial capability is demonstrated.
Site Visit/Other Public reports of the city's waste water infrastructure is failing or was fast approaching a "critical point". Similarly, the city had recent water crisis. Should offers anticipate any environmental or facility concerns in management and operation of the center? Do any facility issues related to water or sewer currently exist at the center? According to our studies, the Flint Genesee Job Corps center was not impacted by the environmental concerns that have recently affected the city of Flint, Michigan. On page 83 of the solicitation, offerors are reminded not to propose pricing for “construction, rehabilitation, and acquisition.” The Government provides funding for facility projects on a cost reimbursement basis.
