Revise the language in section M.1, Factor 2 Demonstrated Record of Effectiveness to read as follows:
Factor 2. Demonstrated Record of Effectiveness (Past Performance).
In accordance with WIOA Section 147(a)(2)(B)(i)(IV) & (V) and WIOA Section 147(a)(3)(C), the past performance evaluation may include consideration of the quality of each offeror’s past performance, if any, operating or providing activities at a Job Corps center or similar facility, and its demonstrated effectiveness in assisting individuals in achieving the primary indicators of performance for eligible youth described in WIOA Section 116(b)(2)(A)(ii), in successfully assisting at-risk youth to connect to the workforce, including providing them with intensive academics and career and technical education and training, and in placing at-risk youth into employment and postsecondary education.
Relevance determination. Only those projects deemed relevant will be considered in the evaluation of past performance. Relevant projects are those of similar size, scope and complexity to the work required in this solicitation. Relevant projects may include operation of a Job Corps center or similar facility. The narrative provided by the offeror (per the instructions at Section L) regarding their past record will be used solely to establish the relevance of the projects identified by the offeror (i.e., DOL will use the information submitted in response to Section L to identify the projects that are similar in size, scope, and complexity to the current project). However, DOL may identify other projects, not identified by the offeror in its proposal, which DOL deems relevant and will be considered in the past performance evaluation. Note that only projects performed in the last three years and lasting at least twelve months will be deemed relevant. Projects found not to be similar in scope, size or complexity and projects older than three years or lasting less than 12 months are not relevant and will not be considered.
Quality of Performance determination. In assessing the quality or effectiveness of the offeror’s performance in relevant projects, the evaluators may rely on PPIRS, CPARS, OMS ratings, reports and audits of the Office of the Inspector General, esrs.gov, and other sources of data.
DOL will not consider, however, the offeror's description of the quality or effectiveness of its own performance. Such information, if submitted by the offeror in response to Section L instructions, is not considered objective and will not be considered.
The Government will consider Past Performance information for the entity proposed as the prime contractor and/or its principals, as well as information for proposed subcontractors that will perform major or critical aspects of the requirement, when such information is relevant to this procurement. In addition, the Government may consider past performance information regarding predecessor companies. Greater emphasis may be placed on the past performance of the prime contractor.
mailto:OCFOinvoiceinquiries@dol.gov
When the offeror is a joint venture or contractor team at the prime level, the past performance of the team, if any, will be considered. If the Offeror is a newly formed entity, the Government will evaluate the experience of the individual entity or entities that comprise the newly formed entity. If the Offeror is a joint venture, LLC, team, or other similar entity, DOL will evaluate the experience of the entities comprised of the joint venture, LLC, team or other similar entity. If the team has no relevant past performance, but one or more team members do, the Contracting Officer will make a determination, at his/her discretion, based on the availability of past performance information for a team member, and the nature and extent of that team member’s proposed contribution to the work of the contract, as to whether or how to evaluate past performance for the team.
For Offerors that have performed (or are currently performing) under other Job Corps Center (JCC) contracts, in-house relevant historic performance data and information, for example, OMS-10 Report Cards, ROCAs, Student Satisfaction Surveys (SSS), may also be used in accordance with. FAR 15.305(a)(2)(i), (ii), and (iii). The currency and relevance of past performance information, the sources of the information, context of the data, and general trends in contractor’s performance shall be considered during the evaluation of past performance.
In accordance with the Federal Acquisition Regulation, an offeror without a record of relevant past performance shall not be evaluated favorably or unfavorably for this factor. The offeror will receive a Neutral rating.

| Section 2. Demonstrated Record of Effectiveness (Past Performance) - Past | ||
| Performance Questionnaires | The key personnel of small business concerns may be former personnel of Job Corps operators. Will the government accept the relevant experience of the key personnel in place of the J-7 attachment (Performance Confirmation Questionnaire)? | In accordance with Section L.7 of the Request for Proposal: "You may identify projects performed by predecessor companies, by key personnel working for other organizations, and by subcontractors that will perform major or critical aspects of the requirement. In such cases, you should provide information to explain the experience and its relevance to this solicitation." (emphasis added). However, please note that per Section L.7: "Past Performance Questionnaires: For each project identified in this section for which there is no report in the Past Performance Information Retrieval System (PPIRS), you must complete Section A of Attachment J-7, Performance Confirmation Questionnaire. You must forward this questionnaire to the Government agency or company listed as a reference for the project and request that the Relevant Past Performance evaluation be completed for Sections B-F of Attachment J-7. Each agency/company evaluator must return the questionnaire directly by email to the Contracting Officer and Contracting Specialist identified in this Solicitation." |
| Section 2. Demonstrated Record of Effectiveness (Past Performance) - Past | ||
| Performance Questionnaires | Disadvantaged small businesses seeking to enter the Job Corps market may not have experience managing projects under the small business's name. However, key personnel have overseen identical functions for other corporations. How will the totality of work experience of key personnel be evaluated, in light of no PPQs or projects under the corporate entity?
| Factor 2 Demonstrate Record of Effectiveness | ||
| (Past Performance) | The referenced section does not discuss how the government will evaluate the Relevance determination and Quality of Performance determination of the key personnel as responded to in Section 2. Demonstrated Record of Effectiveness. In Section 2, it appears that offerors may describe the experiences of the key personnel in light of the formation of new entity. Factor 2, Demonstrate Record of Effectiveness states, "If the Offeror is a newly formed entity....." --- Will the government revise the language to state: "If the Offeror is a newly formed entity, the Government will evaluate the experience of the key personnel of the individual entity, individual entity, or entities that compromise the newly formed entity." | The determining factor regarding relevancy is not the personnel or the entity involved, rather it is the project. Per Section M.1 of the Request for proposal: "Relevance determination. Projects found not to be similar in scope, size or complexity and projects older than three years or lasting less than 12 months are not relevant and will not be considered." |
Business Mangement Data Small business concerns-- 8(a) certified, HUBZone certified, and minority-owned small businesses-- face difficulties accessing financial resources to operate multi-millions dollar Job Corps contracts. The difficulties both delay entry into the Job Corps market and/or places an unfair burden on small businesses to partner with large corporations who exert unfair advantages. Similarly, Alaskan Native Corporations, who compete under small business set-asides leverage ANC corporate headquarter's finanical resources. Will the government consider other financial capability strategies to allow small business concerns to enter the Job Corps market on a level field and without dependence on large operators? The Department of Labor's market research indicates that there are mulitple small businesses capable of providing the required services as explained in the Request for Proposal.
Page 83 States: "In addition to the written pricing proposal, offerors shall provide the following using Microsoft Excel." Please clarify if the written pricing proposal is referencing a required narrative of cost. See L.7, Section 4a, Business Management Plan.
Page 82 In reference to this sentence “Projects identified should include work experience within the three (3) years preceding the submission of this proposal, and for at least one year in duration.” Can the prime and subcontractor submit a listing of projects as an appendix that is not included in the 5 page limit for Section 2 Past Performance? The projects submitted are considered the Narrative portion of the Past Performance portion of the Proposal and will be subject to the applicable page limit. Refer to Section L.6 for additional information.
Page 83 Can Phase-In/Phase-Out schedules not be included in the 10 page limit for staff resources and provided as an appendix? The Phase-In/Phase-Out schedules are a required part of the Staff Resources Proposal, and are subject to the applicable page limitations.
Section F Deliveries or Performance, Page 23 Section F.3 Period of Performance includes "(insert dates)". Please confirm the dates should be as follows:Phase In: If appropriate, for the purpose of assuming the responsibility of center operations, the Contractor shall perform necessary phase-in functions from June 1-30, 2020.Operations: Center Operations shall commence in accordance with Section B of the contract.Outreach and Admissions and Career Transition Services shall commence on (insert date if different than time of award).Phase Out: If appropriate, for the purpose of transitioning the responsibility of center operations, the Contractor shall perform necessary phase-out functions from July 1-31, 2025.
