End of Clause
Factor 2. Demonstrated Record of Effectiveness (Past Performance).
In accordance with WIOA Section 147(a)(2)(B)(i)(IV) & (V) and WIOA Section 147(a)(3)(C), the past performance evaluation will include consideration of the quality of each offeror’s past performance, if any, operating or providing activities at a Job Corps center or similar facility, and its demonstrated effectiveness in assisting individuals in achieving the primary indicators of performance for eligible youth described in WIOA Section 116(b)(2)(A)(ii), in successfully assisting at-risk youth to connect to the workforce, including providing them with intensive academics and career and technical education and training, and in placing at-risk youth into employment and postsecondary education.
1. Relevance determination. Only those projects deemed relevant will be considered in the evaluation of past performance. Relevant projects are those of similar size, scope and complexity to the work required in this solicitation. Relevant projects may include operation of a Job Corps center or similar facility. The narrative provided by the offeror (per the instructions at Section L) regarding their past record will be used solely to establish the relevance of the projects identified by the offeror (i.e., DOL will use the information submitted in response to Section L to identify the projects that are similar in size, scope, and complexity to the current project). However, DOL may identify other projects, not identified by the offeror in its proposal, which DOL deems relevant and will be considered in the past performance evaluation. Note that only projects performed in the last three years and lasting at least twelve months will be deemed relevant. Projects found not to be similar in scope, size or complexity and projects older than three years or lasting less than 12 months are not relevant and will not be considered.
2. Quality of Performance determination. In assessing the quality or effectiveness of the offeror’s performance in relevant projects, the evaluators may rely on PPIRS, CPARS, OMS ratings, reports and audits of the Office of the Inspector General, esrs.gov, and other sources of data. DOL will not consider, however, the offeror's description of the quality or effectiveness of its own performance. Such information, if submitted by the offeror in response to Section L instructions, is not considered objective and will not be considered.
The Government will consider Past Performance information for the entity proposed as the prime contractor and/or its principals, as well as information for proposed subcontractors that will perform major or critical aspects of the requirement, when such information is relevant to this procurement. In addition, the Government may consider past performance information regarding predecessor companies. Greater emphasis may be placed on the past performance of the prime contractor.
When the offeror is a joint venture or contractor team at the prime level, the past performance of the team, if any, will be considered. If the Offeror is a newly formed entity, the Government will evaluate the experience of the individual entity or entities that comprise the newly formed entity.
If the Offeror is a joint venture, LLC, team, or other similar entity, DOL will evaluate the experience of the entities comprised of the joint venture, LLC, team or other similar entity. If the team has no relevant past performance, but one or more team members do, the Contracting
Officer will make a determination, at his/her discretion, based on the availability of past performance information for a team member, and the nature and extent of that team member’s proposed contribution to the work of the contract, as to whether or how to evaluate past performance for the team.
For Offerors that have performed (or are currently performing) under other Job Corps Center (JCC) contracts, in-house relevant historic performance data and information, for example, OMS-10 Report Cards, ROCAs, Student Satisfaction Surveys (SSS), may also be used in accordance with. FAR 15.305(a)(2)(i), (ii), and (iii). The currency and relevance of past performance information, the sources of the information, context of the data, and general trends in contractor’s performance shall be considered during the evaluation of past performance.
In accordance with the Federal Acquisition Regulation, an offeror without a record of relevant past performance shall not be evaluated favorably or unfavorably for this factor. The offeror will receive a Neutral rating.

Soliciation Section (when cited by contractor) Question(s) Answer(s)
L.9 The Office of Contract Management is hosting a webinar on the day when the RFCs are due. Will the Government provide 1 additional week to submit RFCs that may come up after the webinar? The Department of Labor will not be extending this Request for Proposal at this time.
SF33 Block 9 Will the Government extend the proposal due date for 2-3 additional weeks, to October 7, 2019? The Department of Labor will not be extending this Request for Proposal at this time.
M.1 Factor 2 The key personnel of small business concerns may be former personnel of Job Corps operators. Will the government accept the relevant experience of the key personnel in place of the J-7 attachment (Performance Confirmation Questionnaire)? In accordance with Section L.7 of the Request for Proposal: "You may identify projects performed by predecessor companies, by key personnel working for other organizations, and by subcontractors that will perform major or critical aspects of the requirement. In such cases, you should provide information to explain the experience and its relevance to this solicitation." (emphasis added). However, please note that per Section L.7: "Past Performance Questionnaires: For each project identified in this section for which there is no report in the Past Performance Information Retrieval System (PPIRS), you must complete Section A of Attachment J-7, Performance Confirmation Questionnaire. You must forward this questionnaire to the Government agency or company listed as a reference for the project and request that the Relevant Past Performance evaluation be completed for Sections B-F of Attachment J-7. Each agency/company evaluator must return the questionnaire directly by email to the Contracting Officer and Contracting Specialist identified in this Solicitation."
| M.1 Factor 2 | Disadvantaged small businesses seeking to enter the Job Corps market may not have experience managing projects under the small business's name. However, key personnel have overseen identical functions for other corporations. | |
| How will the totality of work experience of key personnel be evaluated, in light of no PPQs or projects under the corporate entity? Each agency/company evaluator must return the questionnaire directly by email to the Contracting Officer and Contracting Specialist identified in this Solicitation." |
| M.1 Factor 2 | The referenced section does not discuss how the government will evaluate the Relevance determination and Quality of Performance determination of the key personnel as responded to in Section 2. Demonstrated Record of Effectiveness. In Section 2, it appears that offerors may describe the experiences of the key personnel in light of the formation of new entity. Factor 2, Demonstrate Record of Effectiveness states, "If the Offeror is a newly formed entity....." | |
| --- Will the government revise the language to state: "If the Offeror is a newly formed entity, the Government will evaluate the experience of the key personnel of the individual entity, individual entity, or entities that compromise the newly formed entity." | The determining factor regarding relevancy is not the personnel or the entity involved, rather it is the project. Per Section M.1 of the Request for proposal: "Relevance determination. Projects found not to be similar in scope, size or complexity and projects older than three years or lasting less than 12 months are not relevant and will not be considered." |
| Business Mangement Data | Small business concerns-- 8(a) certified, HUBZone certified, and minority-owned small businesses-- face difficulties accessing financial resources to operate multi-millions dollar Job Corps contracts. The difficulties both delay entry into the Job Corps market and/or places an unfair burden on small businesses to partner with large corporations who exert | |
| unfair advantages. Similarly, Alaskan Native Corporations, who compete under small business set-asides leverage ANC corporate headquarter's finanical resources. Will the government consider other financial capability strategies to allow small business concerns to enter the Job Corps market on a level field and without dependence on large operators? | The Department of Labor's market research indicates that there are mulitple small businesses capable of providing the required services as explained in the Request for Proposal. |
L.7 Section 4 a 2 Job Corps contracts are now Firm-Fixed Price (FFP). FAR 32.403 discusses the Applicability of Advance payments. Will the government allow Advance Payment for Non-commerical items as referenced in FAR 32.403, in light of the following:
-- FAR 32.403 (b) Contracts solely in the management and operation of Government-owned plants?
-- FAR 32.403 (e) Contracts entered into financially weak contractors whose technical ability is considered essential to the agency?
-- FAR 32.403 (f) (2) Loans with reasonable interest rates or finance charges are not available to the contractor?
-- FAR 32.403 (g) Contracts with small business concerns, under which circumstances that make advance payments appropriate?
-- FAR 32.403 (h) Contracts under which exceptional circumstances make advance payments the most advantageous contract financing method for both the Government and contractor? The offeror may propose advanced payments in their proposal, which may then be considered in the Government's evaluation of the offeror's proposal.
Attachment J-2 Job Corps contracts are now Firm-Fixed Price (FFP). Sections D and E of the ETA 8554 make reference to Advance Payment. Will the government accept "Estimated Amount for Advance Payment" as an acceptable response to demonstrate financial capability of covering one-month's cost of the contract? The Government cannot assess the acceptability of such a comment as part of an advanced evaluation of a potential offeror's proposal. Such a statement would be evaluted in the proper context of the proposal to determine if sufficient financial capability is demonstrated.
B.2 Please confirm that the Option 2 Period of Performance should read “June 1, 2023 – May 31, 2024” That is correct and will be addressed in an amendment to the solicitation.
B.2 According to the RFP CLINs XXX6, XXX7 and XXX8 will typically be FFP, but at times may be cost-reimbursable. A contractor is required to expend extensive resources in the procurement and management of these items, specifically for CRA projects.
Please confirm the contractor will be allowed to allocate G&A and fee to the costs of the items in these CLINs. At a minimum, the contractor should be allowed a management fee to assume the risk associated with these costs.
Will contracts be provided emergency CRA B1b funds for emergency situations that occur on center?
G&A and fee will not be permitted on CLINS XXX6, XXX7 and XXX8.
Contracts will be provided emergency CRA money in one of the first established service orders.
G.9 Will the government consider the OBS price adjustment not take effect until the OBS drops below 98%, consistent with the cost reimbursable calculation found on the 2110? Per Section G.9, the calculation is requried for any OBS less than 100%.
H.21 Please explain how the Limits on Compensation is applicable to this FFP contract.
In addition, as FFP Contract, why are Limits of Compensation applicable?
Refer to Section H.21 for an explanation of how the Limits of Compensation will apply to this contract. As the clause states, funds shall not be provided to pay for compensation at a rate in excess of the Executive Level pay. Limits of Compensation are appliable because the Limitation on Compensation is based on public law, DOL's appropriations act.
J Attachments When does the government expect the J attachments will be released? The attachments are included in the solicitation. Please click on the "paper clip" icon in Adobe to view the attached files.
Attachment J.1 Please confirm that contractors are only required to complete the evaluated price tab in Attachment J-1. Offerors are required to complete both tabs (Evaluated Price and Contract Award) in Attachment J-1.
Attachment J.8 Please confirm that Attachment J-8 (Standard Form 1413) is for use after the award of the contract and does not need to be included as part of the submission. This form is required to identify any subcontractors included in an offeror's proposal.
L.6.H The proposal format section does not specify a file type, except for the Attachment J-1 in Microsoft Office Excel. Is a PDF format acceptable for all other proposal sections?
On that note, should the J-6 be submitted as its own attachment (Like the J-1) as well as within the body of the BMP as was required in previous procurements? And if so, would the government prefer it in excel or Word?
PDF is acceptable for all other proposal sections.
A subcontracting plan is not required for small businesses. However, when required, the government will accept either excel, word or PDF and should be submitted in the body of the BMP.
Section L.7 - Section 4 BMP – a. Business Management Data Part 10 of Section a. of the Business Management Data requires the offeror to provide “a full copy of every report) of the Office of Inspector General of the DOL which mention the offeror, an affiliate or predecessor of the offeror, or any contract that the offeror or an affiliate or predecessor of the offeror performed.”
How far back is the above request? 1 year? 2 Years? 3 years? Etc.
Please advise as there may be substantial reports required depending on the timeline required.
Offerors need to submit all known reports regardless of the date of the report.
Section L.7. Section 4. Business Management Proposal
b. Pricing Detail Under Pricing Detail, it mentions that Offerors included a completed J-1 only.
In the recently issued FFP_RFP Questions and Answers document, there is a response that reads, “In the business management proposal, narrative detail is not required.”
Please confirm that a pricing narrative detail is not required for this submission.
See L.7, Section 4a, Business Management Plan. A narrative of cost is not required.
Please confirm that the contractor will be reimbursed for expenses incurred as a result of an interruption (hurricane, tornado, ice storm, flood, etc.) to the normal course of business. For example, additional costs (lodging, transports, meals, staff overtime, etc.,) would be incurred if students had to be relocated. If the students do not need to be relocated as a result of the interruption, additional costs (staff overtime, meals, etc.) could be incurred to ensure the safety and security of the students. Additionally, please confirm that OBS will not be impacted by a change to the student status that is driven by the interruption. If the OBS will be impacted, how will the contractor be penalized for a low OBS that is driven by the interruption? Such circumstances may be subject to FAR Clauses 52.222-2, 52.233-1, and 52.237-2 and potentially additional clauses. Although the OBS calculation would remain in effect, an equitable adjustment may be warranted depending upon the nature of the interuption. FAR Clause 52.249-14 lists events that may be considered beyond the Contractor's control.
M.1 Factor 2 In reference to this sentence “Projects identified should include work experience within the three (3) years preceding the submission of this proposal, and for at least one year in duration.” Can the prime and subcontractor submit a listing of projects as an appendix that is not included in the 5 page limit for Section 2 Past Performance? All projects submitted are considered the Narrative portion of the Past Performance portion of the Proposal and will be subject to the applicable page limit. Refer to Section L.6 for additional information. The page limiation applies the the offeror's entire proposal, prime contractors and subcontractors included.
L.7 Section 3 Subsection 3D Can Phase-In/Phase-Out schedules not be included in the 10 page limit for staff resources and provided as an appendix? The Phase-In/Phase-Out schedules are a required part of the Staff Resources Proposal, and are subject to the applicable page limitations.
G.5 Is the Student Per Day Calculation Chart required to be completed as part of the BMP submission? This is not a requried submission and will be completed at the time of award.
Section B.2 Are the pricing forms on pages 5-9 required as part of the BMP? No. Attachment J-1 serves this purpose.
L.7 Section 3 Subsection 3D "incumbent contractors shall provide a Phase-Out plan and Only provide a Phase-In plan if the incumbent contractor will be performing new work not currently defined in the incumbent contract statement of work such as new Outreach and Admissions activities. The Phase-In plan for incumbent contractors should only address the new work to be phased-in. All non-incumbent contractors shall submit Phase-In and Phase-Out plans." As this provides the incumbent contractor a page advantage, will the government consider allowing the plans to be an appendix or make an increase in page allowance for non-incumbent contractors? Any such page advantage is considered negligible. The Government will not allow any additional pages for nonincumbent offerors.
| C.2.H | We acknowledge the importance of maintaining adequate staffing levels. | |
| -Will the government consider revising the # of days to fill positions for some of the areas? Some vacancies take 60-90 days, depending on the position. | No, staff vacancies for the position identified in the RFP shall be filled within the identified number of calendar days in the RFP. |
C.2.H Will the government consider other coverage provided via substitutes or overtime when reviewing the vacant positions and the contractor’s coverage of the positions? No, a position is considered vacant until an employment offer is made, accepted and the individual reports for duty.
C.2.H This listing includes line-level staff (food service, maintenance, etc.). If the contract is allowed a vacancy rate up to 4%, then it is reasonable to expect some of these positions will be vacant for periods of time. Will the government consider clarifying the titles to include only management-level positions? No. At this time, adjustments will not be made.
C.2.H Please clarify the term “hired”. Can an accepted offer from a candidate be interpreted to be a “hired” employee and not considered a position vacancy? No, a position is considered vacant until the candidate accepts the position and reports for duty on the Job Corps center.
F.5 The annual arrival amounts for the three centers listed seems high for the current OBS at each respective center. Please confirm these goal amounts are correct. The arrival goals are based upon the National Enrollee Assignment plan which is required by statute.
H.8 Would the government please provide minimum wages for specific positions (academic and CTT managers, academic and CTT instructors, residential advisors, security officers, counselors, etc.)? No, it is the operator’s responsibility to be familiar with the local labor market and the prevailing wages and benefits in the area.
As the offeror is responsible for insuring center vehicles, please provide a current list of GSA and center-owned vehicles. See Attached List marked GSA Vehicles
Attachment J.12 Please confirm that the utilities at the center (Electric, Water, & Gas) are the only utilities they have. Please confirm that we do not include costing for sewage or some other utility not included in the reports provided. Yes, the utilities identified in the report are accurate.
L.7 Section 3 Subsection 3B In reference to this sentence “Describe your approach to staffing the center by schedule, demonstrating that the appropriate number of qualified staff will be available at the appropriate times so as to provide coverage of critical functions, such as residential living, career preparation, academic and career technical training, counseling, health services staffing, and security,…” Is the list provided the definitive list of “critical functions” or is the Department of Labor anticipating the proposer to include any function they believe as critical? No, this is not a definitive list. The critical functions are those deemed necessary in order to maintain safety and security of staff and students and to provide an optimal learning environment. Please follow the instructions in Attachment J-4.
Will all Center equipment be operational at the time of award? The Government expects all available equipment to be operational.
Does the Center have sufficient snow removal equipment to maintain Center Operations? This is a matter of opinion; offerors are free to provide thoughts on this matter as part of their submitted offer. Future weather conditions may result in differing equipment demands.
