RFP 1605JW-24-R-00004 St. Louis Questions for Clarification (OCM)
Soliciation Section (when cited by contractor) Question(s) Answer(s)
Section B.3 Disclosure of the Rough Order of Magnitude
Is the rough order of magnitude range between $118,000,000 and $130,000,000 considered to be the total evaluated price or the total contract award?
The Rough Order of Magnitude includes all CLINs identified in Section B.2 of the solicitation, but does not include pricing associated with a six-month Option to Extend Services (52.217-8).
RFP, Page 67 The Statement and Acknowledgment (Attachment J-8) is included, but no direction provided in the submission.
Please clarify expectations. Attachment J-8 should be submitted with the Offeror's Business Management Plan (Volume 5).
Section B.3 Please confirm the Rough Order of Magnitude (ROM) for this procurement includes all proposed costs to include compliance with the Service Contract Act, $17.20 federal minimum wage (Executive Order), and not-to-exceed (NTE) amounts.
The Rough Order of Magnitude (ROM) includes all CLINs identified in Section B.2 of the solicitation, but does not include pricing associated with a six-month Option to Extend Services (52.217-8). In addition, the ROM takes into consideration the the Service Contract Act, $17.20 federal minimum wage (Executive Order).
Minimum Salary Threshold for federal contractors
On April 23, 2024, DOL finalized the rule setting the standard salary for exempt employees to $844/week and $1,128/week on July 1, 2024 and January 1, 2025, respectively. Should offers include these new minimum salary requirements in their proposals?
It is up to offerors to determine how applicable laws and regulations impact their proposal.
Minimum Salary Threshold for federal contractors and ROM
Please describe how the Rough Order of Magnitude factors in the new wage requirements, resultant compression, and BLS data that has been provided.
The ROM is for informational use only; offerors are expected to do their own due diligence when developing their price proposal.
Page 9 and 100, B.3 Disclosure of the Rough Order of Magnitude & M.1, Factor 5
Does the range of $118,000,000 to $130,000,000 include the NTE amounts for CRA, Equipment, CTST, Special Projects/Initiatives, and Reasonable Accommodations? Evaluation Factor 5 references a Total Evaluated Price that excludes the NTE amounts. Please clarify.
The Rough Order of Magnitude includes all CLINs identified in Section B.3 of the solicitation, but does not include pricing associated with a six-month Option to Extend Services (52.217-8).
The total Evalauted Price that the Government will calculate will include the total of CLIN prices for CLINs XX02, XX03, XX04, XX05, and XX10 for the base period and all option periods at the 100% OBS, and CLIN 3012 Phase-Out. However, the CLIN 0001 price will not be included in the offeror’s Total Evaluated Price. The amounts in the Not to Exceed (NTE) Line Items XX06, XX07, XX08, XX09 and XX11 in Schedule B are provided by the Government and will not be included in the calculation of the offeror’s Total Evaluated Price. The Government did not intend for there to be a direct equivalency between the Evaluated Price and the ROM.
DOL Wage Data Please confirm if the successful awardee will be able to receive equitable adjustments upon DOL revisions to BLS minimum salary requirements.
DOL does not allow REAs based on BLS minimum salary requirements but will allow REAs to be submtited as a result of a new Wage Determination incorporated into the contract.
Section H.26 & Attachment J-20 (Sample Invoice)
Section H.26 and the sample invoice do not agree. H.26 states deductions will apply for all vacant positions, except those that became vacant during the month for which the report is submitted. The section of the sample invoice form pertaining to staff vacancies indicates a prorated reduction must be taken based on the number of days vacant for the month when the vacancy occurs. Please confirm vacancies that occur during the current month are not included in the reduction.
Please see revised J.20, Sample Invoice
ALL vacancies are included in the takeback calculation once the 4% vacancy rate is exceeded.
Attachment J-1 (Evaluated Price) The quantity for Phase Out states “12”. Can the offeror update the file to quantity of “1”? Please see the revised J-1 (Evaluated Price) Attachment J-1 (Contract Award) The cell for Phase In Cost is hard-coded. Can offerors update the cell to reflect Quantity x Unit Price? Please see the revised J-1 (Contract Award) Attachment J-4 (Staffing Chart) Can offerors delete unused positions? No.
Attachment J-28 (Staff Compensation Plan) Can offerors delete unused positions? No.
Attachment J-4 (Staffing Chart) & Attachment J-28 (Staff Compensation Plan)
Should National Training Contractor (NTC) instructors be listed on Attachments J-4 and J-28? If so, should the full-time equivalents (FTEs) be listed in the “Prime Contractor” or “Subcontractor” column? No. NTC staff are accounted for under a separate contract.
Section L.6 (Instructions) Do the Gantt charts done in Excel format need to comply with page size and font type/size requirements? All Gantt Charts must comply with the page size and font type/size as specified in Section L.6 of the solicitation.
Section L.6 (Instructions for Proposal Submission)
Please confirm that there are no page limits regarding the Career Preparation Period and Career Counseling & Readiness Gantt Charts.
Page limitation for the Technical Approach volume excludes the Gantt charts which are separately submitted in excel format.
10 & 30, Attachment J-20, B.2 Pricing Schedule G.2 Fees and Profit Sample Invoice
CLIN X010 is expected to include G&A and 1% management fee. Please clarify the 1% management fee. Is it fixed based on the proposed amount? Please clarify if G&A is allowed. Where in the contract will the 1% fee be detailed? Section G does not include a section to detail the annual fees for CLINs x010.
CLIN x010 is a cost plus fixed fee CLIN, with a fee (management fee) not to exceed 1%. The fee is fixed at 1% of the proposed estimated cost for utilities. Section G.2 is amended as follows:
G.2 FEES
Payment of Management Fees:
The contractor will earn a 1% Management Fee for Center Operations (CLIN XX02 and CLIN XX03), in accordance with WIOA. The contractor shall include this 1% Management Fee in the Center Operations CLINs (XX02 and XX03).
The contractor will earn a 1% Fixed (Management) Fee for Utilities (CLIN x010).
Price Adjustments to the contract price resulting from new Wage Determinations (in accordance with contract clause 52.222-41) or increases to the Federal Minimum Wage (in accordance with contract clause 52.222-55) shall not include G&A or Profit, to include the 1% Management Fee.
Sections B.2 (Pricing Schedule) and G.2 (Fees and Profit); Attachment J-20 (Sample Invoice)
CLIN X010 (Center Operations Utilities and Facility Maintenance) is expected to include G&A and 1% management fee. Please clarify the 1% management fee. Is it fixed based on the proposed amount? Please clarify if G&A is allowed. Where in the contract will the 1% fee be detailed? Section G does not include a section to detail the annual fees for CLIN X010.
Section H.20 (Limits on Compensation) Is this section irrelevant as the wages in the contract are under the fixed price line items? These limits remain in effect.
Is the new salary exempt threshold that takes effect July 1, 2024 and increases to $43, 888 from $35,568, and then again Jan 1, 2025 increase to $58,656 from $43,888 factored into "The Government rough order of magnitude (ROM) estimate for the work required to operate the Job Corps Center, including Center Operations, Outreach and Admissions services, and Career Transition Services, is in the range?
Yes.
USDOL wage and hour division released a final ruling, effective July 1, 2024, the FLSA salary threshold will increase to the equivalent of an annual salary of $43,888 and increase to $58,656 on Jan. 1, 2025. Please confirm offerors are required to comply with this final ruling in their proposal submissions.
Yes, Offerors are required to comply with all applicable laws and regulations.
Do the J28 department lines totals need to match the J1 labor lines totals? No.
Does CLIN 10 include internet/wireless costs? Yes. Refer to G.18 Utilities and Facilities Mainteannce
Section B.3 Please confirm the ROM range for this procurement includes all proposed costs to include SCA compliance, $17.20 federal minimum wage (EO), increased FLSA Salary Threshold and NTEs Yes.
H.26
Section H.26 and the sample invoice do not agree. H.26 states deductions will apply for ‘all vacant positions, except those that became vacant during the month for which the report is submitted.’ The section of the sample invoice form pertaining to staff vacancies indicates a prorated reduction must be taken based on the number of days vacant for the month when the vacancy occurs. Please confirm vacancies that occur during the current month are not included in the reduction.
Please see revised J.20, Sample Invoice
ALL vacancies are included in the takeback calculation once the 4% vacancy rate is exceeded.
H.26 FAILURE TO MAINTAIN
STAFFING LEVELS (pages 51 & 52) under EXAMPLE #1, the Center had 10 vacancies and 2 of these became vacant during the reporting month, thus leaving 8 vacancies subject to takeback. However, the Example should allow for the 4 positions that are due to the Vacancy Rate required in the RFP and for which the cost reduction has already been affected in the Cost proposal through Attachment J-1. As such, the salary takeback should be for 4 vacant positions/FTEs only.
No; the salary take back is for the 8 positions in this example. Once salary vacancy is more than 4%, the entire vacancy take back is included in the reduction except for those vacancies that became vacant during the month of reporting.
J-1 Please confirm the quantity in the evaluation tab for Phase -Out can be changed from 12 to 1. Please see the revised J-1 (Evaluated Price)
Attachment J-1 Contract Award Tab CLIN 0001 has a hard-coded value. Are Offerors allowed to update the formulas to match the other CLINs? Please see the revised J-1 (Contract Award)
Attachment J-4 Can offerors delete unused positions? No.
H.26 FAILURE TO MAINTAIN
STAFFING LEVELS (pages 51 & 52) the contractor is to calculate the vacancy takeback for positions vacant above the 4% and became vacant NOT during the reporting month; and that the takeback includes, among other things, the “profit”. Please define “Profit.”
The vacancy take back calculates the entire salary amount (only G&A is excluded) for that individual position that is reported vacant. Amounts assessed are based on the contractor's submission in their J.28.
The ROM on page 13 appears to be insufficient to support successful operations given the changing economic conditions of: increase in the non-exempt minimum wage, the increase in the exempt minimum wage, increase in SCA wages and H&W rates, current and compounded inflationary factors since the prior award. We are requesting a re-evaluation of the stated ROM given these significant factors.
The ROM remains the same. However, offerors must use their own business judgement when developing their price, understanding the requirement, applicable laws and regulations, as well as risk in a fixed price environment.
Page 26 states that “Price Adjustments to the contract price resulting from new Wage Determinations (in accordance with contract clause 52.222-41) or increases to the Federal Minimum Wage (in accordance with contract clause 52.222-55) shall not include G&A or Profit, to include the 1% Management Fee.” However, included in the staff vacancy takeback on the J-28, fee is taken back as noted on page 52 of this RFP. Please explain the rationale for taking back fee if the fee is not allowed to be included in the price when an increase in the minimum wage occurs.
When an increase in the contract price is provided due to an increase in employee minimum wage, the government will finalize a new J.28 with rates for each impacted positions that will re-establish the rate applicable to that position for the purpose of vacancy takebacks. The re-establishment of the J.28 vacancy takeback rate will take into consideration that the contractor did not receive compensation for G&A and fee.
Page 51, H.20 - Limits on Compensation Is this section irrelevant as the wages in the contract are under the Fixed Price CLINs? These limits remain in effect.
J-4/J-28 Should NTC instructors be listed on Attachments J-4 and J-28? If so, should the FTE be listed in the “Prime Contractor” or “Subcontractor” column? No. NTC staff are accounted for under a separate contract.
Please provide a copy of the facilities survey Refer to the Attachment J-9 (Vol 1 and Vol 2) in the solicitation.
Section B.3 (Disclosure of the Rough Order of Magnitude) & Section M.1 (Factor 5)
Pleaes clarify if the Rough Order of Magnitude (ROM) with ranges between $118,000,000 and $130,000,000 include the not-to-exceed (NTE) amounts for Construction, Rehabilitation, and Acquisition (CRA), Equipment, Career Technical Skills Training (CTST), Special Projects/Initiatives, and Reasonable Accommodations? Is the ROM the evaluated or contract award price?
(52.217-8).
Section B.3 Disclosure of the Rough Order of Magnitude
Does the rough order of magnitude range estimate include the NTE CLINS 0006, 0007, 0008, 0009, and 0011 amounts?
(52.217-8).
Page 34-35, G.10 Not to Exceed Contracting Line Items
Please provide examples of what types of services would be included in Reasonable Accommodations. Are these for student accommodations? If so, please clarify why this cost category excludes G&A and fee as it would be a change in scope of work, is related to center operations, and requires additional corporate resources to support the effort.
Some examples of Reasonable Accommodations are equipment, learning devices or special classroom chairs for the students. The Government's experience is that procuring reasonable accomodations does not require intensive corproate resources and therefore does not warrant inclusion of G&A.
Facility Survey and Pre-Proposal Conference
Several areas appear under construction. Will the construction be completed at the new performance period?
What program areas and/or departments are impacted by the construction
Phase I of the National Office's Center Redevelopment Plan is slated for completion 09-Sep-24 (Substantial Completion) and 09-Oct-24 (Final Completion). This phase primarily impacted the Welcome Center and Medical/Dental Center.
Facility Use - Lindell Campus What Career Technical Training programs are administered at the Lindell Campus? Currently, the only CTTs at Lindell are TCU and pharmacy technician.
Attachment J-12 (Utilities) and J-23 (Utility Cost Trend)
The values between the J-12 and J-23 are confusing and appear to be inconsistent. Please clarify and provide trends over the last 3-5 years. Are there any costs for utilities outside of electricity, natural gas, and water?
The breakdown from 2023 onward comes from the current operator, who is only required to report actual expenses in aggregate on the Utilities & Fuel line of the monthly 2210 report. An additional worksheet with those monthly totals has been added to the Utility Cost Trend report.
Attachement J-22 Please advise which vehicle(s) on Attachment J-22 are used for Driver's Education. Additionally, please advise if the vehicle(s) is equipped with dual brakes. The Center has two 2024 Hyundai Elantrass equipped with dual brakes.
J-14 Performance Report Cards
