About this file

This document contains an amendment to a solicitation for operation of the Milwaukee Job Corps Center. The amendment extends the proposal due date to August 21, 2023 at 2:00pm EDT, responds to vendor questions that were inadvertently omitted from a previous amendment, and updates pricing terms to clarify adjustments for average monthly enrollment below 100%. The solicitation is for operation of the Milwaukee Job Corps Center to provide career technical training and academic programs to at-risk youth. The period of performance is from December 1, 2023 through November 30, 2028. The Department of Labor is the contracting agency. Pricing is fixed-price based on achieving and maintaining a 100% average monthly enrollment level. Adjustments to the fixed monthly price will be made for any months where average enrollment is below 100% according to the pricing formula included in the amendment.

G.9 PRICE ADJUSTMENT FOR LESS-THAN-100% ON BOARD STRENGTH

The total contract value at the time of award will be based on Section B.2, Pricing Schedule, which is based on attaining and maintaining an average monthly OBS of 100% of the planned OBS. The Contract requires the Contractor to undertake every effort necessary to attain and/or maintain 100% average monthly OBS.

(The contractor will be permitted a grace period of three (3) months, for which the contractor can bill at the 100% OBS price, regardless of the actual average OBS for the month billed. The three month period shall begin during the first full month of center operation). Does not apply to incumbent contractor.

After the three month grace period, should the average monthly OBS level be less than 100% in any month, the Contractor’s price for the month will be adjusted downward based on the actual average OBS during that month. “Average OBS” means the OBS as established for the (CIS- >Accountability->Reports->Center Reports->Center On Board Strength Report->Select Reporting Period).

The reduction of the price pursuant to this clause is in addition to, and does not constitute a waiver by the Government of, other remedies available under the contract for the contractor’s failure to achieve 100% OBS.

The adjusted monthly price for less than 100% OBS shall computed based on the following formula:

Adjusted Monthly Price = CLIN XX02 Monthly Price x Adjustment Percentage Adjustment Percentage = 100 – [(100 – “Average OBS”) / 100 x 15]

The following hypothetical examples are provided solely for the purpose of illustrating how the formula operates. Suppose that for the base period of the contract, the CLIN 0002 unit price per month is $1 million. In the fifth month of contract performance, the Average OBS for the Center was reported to be 64%. In that case, the Adjusted Monthly Price for that month, which is the amount that the Contractor would be entitled to receive is $946,000, calculated as follows:

Adjustment Percentage = 100 – [(100 – “Average OBS”) / 100 x 15] 100 – [(100 – 64) / 100 x 15] 100 – [(36 / 100 x 15] 100 – 5.4%

Adjusted Monthly price = $1,000,000 x 94.6% $946,000

At the end of each contract period, the Government will adjust via modification, the contract value for that period, to reflect the total price paid during the contract period.

RFP 1605JW-23-R-00008 Milwaukee JCC Questions for Clarification

Soliciation Section (when cited by contractor)

Question(s) Answer(s)

Will the govt allow Past Performances to be within the last 5 years? The Government will not consider a five-year period for past performance.

There is uncertainty about future costs to FFP contracts, especially in the current environment where inflation or CPI is 8.5%. Contractors try to include risk premiums in their bids to ensure viability through these unprecedented circumstances, causing overall higher bid prices. In accordance with FAR 16.203-1, will the government consider adding an Economic Price Adjustment (EPA) or Price Adjustment Clause to the contract?

The Government will not be including any type of economic price adjustment clause in the solicitation at this time.

B.2 Please confirm the current contract end date. Is it November 30, 2023? The current contract end date is November 30, 2023.

How many current FTE? Offerors are expected to be able to develop their own FTE requirements without regard to the incumbent’s current FTE count when submitting a proposal

Would the government please share the current staffing vacancy rate? Does the center currently have significant staffing vacancies?

This information will not be provided by the Governement. The government's expectation is that the new contractor will begin operations fully staffed.

G.9 The price adjustment example conflicts with the narrative. Please clarify if the example given results in $955,460 or $946,00. See Amendment 0002 for revised G.9 Price Adjustment.

To be consistent with Attachment J-4 staffing chart can unused positions be deleted from Attachment J- 28? Yes, the J-28 can be made consistent with the J-4 by removing unused positions.

The requirement in the Business Management Proposal (BMP) to provide assurance of compliance with basic health and safety codes, including disciplinary measures is similar to the requirement for Technical Approach, Safety and Security. Will the Government clarify their expectations for this requirement in the BMP? What is required in the BMP response that is not provided in the Technical Approach? Rather than repeat a lengthy narrative from the Technical Approach, will a statement acknowledging compliance constitute “assurance” to satisfy the requirement?

This section of the BMP shall acknowledge compliance with the basic health and safety codes in accordance with the disciplinary measures described in section 152(b) of the Workforce Innovation and Opportunity Act of 2014.

We understand the Attachment J-8 is to be used to identify any subcontractors. If submitting a proposal without any subcontractors or when subcontractors may not be known until after award (e.g., medical, dental, construction), is the J-8 required to be submitted with the proposal and, if so, in which volume?

This form is required to identify any subcontractors the contractor has alredy identified and included in Factor 4 of an offeror's proposal. If an offeror intends to subcontract an area out but has not yet identified a subcontractor, the offeor should provide this information in section J-8 and any other area of the proposal where those positions/services would be required to be described. If an offeorr does not intend to use any subcontractors, the offeror shall state this in attachment J-8 so that the government has a full understanding of the offeror's proposal.

J.9 The Facility Survey cites that a lack of proper drainage has caused water to pond and freeze in front of the Gymnasium /Recreation Building 107. Has the drainage issue been corrected? If not, are there plans to do so prior to the new contract start?

This issue was abated on August 22, 2022. Water does not pond currently in front of the gymnasium building.

How many current students There are currently 115 students enrolled.

Does any of the facility equipment (boilers, heating or ventilation) require the maintenance workers to have a certain certification or license to work on them? If yes, would the government please provide a list of certifications/license so the maintenance workers can be classified correctly?

Generally speaking, yes. The systems are newer and were sophisticated technology at the time when the center was built. As a result, HVAC repairs and maintenance have only been provided by select vendors. The vendors are listed below in response to question #16. Please note that there are a range of certificates and licenses that meet the relevant experience to repair the center's systems.

Will the government please list all leased equipment? The washers, dryers, copy machines, and GSA vehicles are leased.

Please confirm if small businesses will be able to invoice the government bi-monthly? All operators are required to invoice monthly.

How many gates/entrances are there @ the Milwaukee Job Corps Center? There is one main point of entry.

Will the government please provide the current providers for the leased equipment?

The list of vendors for leased equipment and rentals includes: Select Container, Matheson Tri-Gas, Inc., Gunderson Inc., Capital Coffee & Water Service, Quadient Finance USA Inc., WASH Multifamily Laundry Service, and James Imaging (copiers).

Will larger businesses with small businesses teaming partners be evaluated more favorably? No.
