RFP 1605JW-23-R-00008 Milwaukee JCC Questions for Clarification

Soliciation Section (when cited by contractor) Question(s) Answer(s)

Q1: On page 43 of the previous Milwaukee RFP dated 4/20/18, the RFP included a table of the Prevailing Wage/Minimum Required to be offered under that solicitation # 1630J4-18-R-00002.

The positions and minimum annual wage amounts required to be proposed are shown in the table below: Is it the government’s expectation that the offer for this solicitation include pricing for these positions that equals or exceeds 2018’s required minimum wage shown on that solicitation?

It is the offeror's responsibility to ensure that all covered positions are paid at least the minimum amounts in accordance with the minimum wage rate indentified in Executive Order 14026 and Service Contract Act (Service Labor Contract Standards).

If it is not the government’s expectation that the offer for this solicitation includes pricing for these positions that equals or exceeds 2018’s required minimum wage as shown on page 43 of solicitation # 1630J4-18-R-00002, then this will likely result in staff turnover for these positions since the Prevailing Wage/Minimum Required wages in 2018 exceed the current prevailing wage for some of these positions in 2023. Given this reality, will the successful offeror have a 90-day period to achieve the 4% vacancy rate?

There is not a 90 day grace period regarding vacancies.

During 2017-2018 Job Corps’ procurement cycle, required minimum wages for certain positions were referenced within the respective RFP. Subsequent to this, Job Corps rescinded its policy and requirement to employ "Residential Counselors" and allowed operators to propose prevailing wages for Residential Advisors. This policy revision can be found on ePRH Change Notice # 18-06 dated 12/17/18.

If it is not the government’s expectation that the offer for this solicitation includes pricing for these positions that equals or exceeds 2018’s required minimum wage as shown on page 43 of solicitation # 1630J4-18-R-00002, then this will likely result in staff turnover for these positions since the Minimum Required wages within 2018’s RFP exceed the current prevailing wage for some of these positions in 2023. Given this reality, will the successful offeror have a 90-day period to achieve the 4% vacancy rate for the positions specifically impacted by this Job Corps policy that was subsequently rescinded?

There is not a 90 day grace period regarding vacancies.

If it is the government’s expectation that the offer for this solicitation include pricing for these positions that equals or exceeds 2018’s required minimum wage, then will the government share the wages currently being offered for these positions to level the playing field and avoid staff turnover for these positions?

It is the offeror's responsibility to ensure that all covered positions are paid at least the minimum amounts in accordance with the minimum wage rate indentified in Executive Order 14026 and Service Contract Act (Service Labor Contract Standards).

In our experience, some states do not fully recognize the sales tax exemption that should be available to DOL contractors. (a) Should bidders include sales taxes in their pricing or (b) will DOL allow an REA in the event the State of Wisconsin requires the winning bidder to pay sales tax on purchases made in the course of contract performance?

(a) The Government will not advise offerors on how to price their proposals. (b) An REA will not be authorized for sales tax.

Page 63, J-16 The RFP has WD 2015-4899, dated 6/14/23; however, there is a more recent WD, dated 6/30/23 on sam.gov. Will DOL update the RFP to reflect the most revision of 2015-4899? See Amendment 0001 for updated J-16 Wage Determination.

64, Attachment J-16 Will DOL please provide Wage Determinations for all counties in the NEAP zone?

The WD for the center is identified. DOL will not provide the wage determination for all counties within a recruitment zone, because it is not DOL's requirement that an OA office be located in every county. It is up to the offeror to identify the location of each OA office and to provide the list to the CO, if the offeror so chooses.

Page 37, 63, H.6 and J-16 Which wage determination should be used for satellite locations such as OA/CTS offices or remote workers? Please clarify and provide those wage determinations as appropriate.

Contractors must identify to the CO the locations they intend to have staff working (other than on center where the WD is already includued) and the Government will incorporate the corresponding WDs via amendment. Contractors shall refer to Clause 52.222-5 in the solicitation for directions on this topic.

Page 63, J-17 Attachment J-17 is marked NA. Please clarify if there are any employees represented by a labor union?

If yes, please provide a copy of the collective bargaining agreement and the associated wage determination.

Not Applicable to this Center - no Collective Bargaining Agreement.

Page 77, L.6.H Please clarify that the page limitation for the technical proposal is 43. Yes. The page limitation for the technical proposal is 43 pages.

Page 60, I.10 Will the government provide the “classes of service employees expected to be employed under the contract” as indicated in Clause I.10 FAR 52.222-42 Statement of Equivalent Rates for federal Hires Refer to Attachment J-28 for employee positions.

Page 62, J-15 The RFP indicates the Construction Wage Determinations will be incorporated upon issuance of a CRA project. Previously, we have had specific construction wage determinations included with the RFP. Please verify this will not be addressed until post-award.

Upon issuance of a CRA project, a Wage Determination will be incorporated into the contract.

C.2.I: In recent procurements, the Government has allowed a 3 month grace period for vacancy reductions.

Will the Government reconsider grace period in this section? There is not a 90 day grace period regarding vacancies.

J-16:

The RFP states that offerors are to use WD 2015-4899, Dated 6/14/2023. SAM.gov is showing the latest WD for Milwaukee is 2015—4899 Revision 22, Dated 6/30/2023. Which Wage Determinations should offerors use?

See Amendment 0001 for updated J-16 Wage Determination.

J-8 Please confirm that the J-8 is not to be included in the proposal response. The Attachment J-8 should be included in the proposal response.

The RFP includes 25 Nonresidential Students (10 Male and 15 Female) as part of the Milwaukee Center’s Total Planned Average On-Board Strength. This number is not reflected in Section F.5, which shows 0 Nonresidential Students for the Milwaukee Center within the Annual Arrival by Center table.

Please clarify how many Nonresidential students the operator will be expected to annually arrive at the Milwaukee Center.

See Amendment 0001 for updated Section F.5.

Page 36, H.6

From reading, Reg. 29 CFR 4.173., for vacation accrual purposes, contractors are required to recognize previous hire dates for work performed on the contract regardless of which contractor operated the center. In addition, the WD states 2 weeks paid vacation after 1 year of service with a contractor or successor. (a) Is this regulation applicable to this implementation and (b) should the hire/vacation accrual date be when the employee originally was hired on the contract (regardless of which contractor operated the center) or should the hire/vacation accrual date be when the employee was hired with the current contractor?

a) Yes, 29 C.F.R. 4.173, Meeting Requirements for Vacation Fringe Benefits, is applicable to SCA-covered contracts, including Job Corps contracts.

b) You are correct that, as explained in 29 C.F.R. 4.173, a service employee’s eligibility for vacation benefits is based on the total length of time the employee has been in the contractor’s service (commercial work and federal contract) and, where applicable, the total length of time the employee has been employed in any capacity in the continuous service of any predecessor contractor and has been carrying out similar contract functions at the same facility. Thus, where a WD specifies, for instance, 2 weeks of paid vacation after 1 year of service, an employee becomes eligible for 2 weeks of vacation after 1 year of continuous service with either the contractor or any predecessor contractor while carrying out similar contract functions at the same facility

Page 78 The RFP states “When submitting attachments J.1 and J.28, offerors shall use Microsoft Office Excel.”

Please clarify if the J.4 should also be submitted using Microsoft Office Excel. Yes. The J-4 Staffing Chart should be submtitted using Microsoft Excel.

Attachment J-28: Are offerors permitted to remove unused positions as instructed in the Attachment J-4 Staffing Chart? Please follow the instructions in J-4 for this solicitation, which specifically notes that the contractor shall eliminate the rows for positions not needed.
