Section of the Request for Proposals (RFP) Questions Responses Solicitation B.1 (Backgroud) Pg. 3 Section B.1, 2nd paragraph, identifies this procurement as a total small business set-aside. However, the SAM solicitation notice identifies this as an 8(a) set-aside. Will the Government identify the correct set-aside status?

It is an 8(a) set-aside competitive procurement

Solicitation L.7, Factor 4 (Business Management Proposal) Pg.83

As may be appliable to the Offeror, is a Prime/Sub teaming agreement or Joint Venture Agreement required to be submitted with the proposal?

RFP does not require submission of Prime/Sub Teaming Agreement or Joint Venture Agreement.

Solicitation L.7, Factor 4.a.4 (Staff Compensation Plan) Pg. 83

Offerors are to submit Attachment J.28. Is only the J.28 required or is an associated Staff Compensation Plan narrative also required for submission?

A Staff Compensation Plan narrative is not required.

Solicitation L.7, Factor 4.a.10 (Compliance with Basic Health and Safety Codes) Pg. 84

The requirement in the Business Management Proposal (BMP) to provide assurance of compliance with basic health and safety codes, including disciplinary measures is similar to the requirement for Technical Approach, Safety and Security. Will the Government clarify their expectations for this requirement in the BMP? What is required in the BMP response that is not provided in the Technical Approach? What constitutes “assurance” that will satisfy the requirement?

This section of the BMP shall acknowledge compliance with the basic health and safety codes in accordance with the disciplinary measures described in section 152(b) of the Workforce Innovation and Opportunity Act of 2014.

Solicitation L.7, Factor 4.d (LimitatioLimitations on Subcontracting and the SBA’s Ostensible Subcontractor Rule) Pg. 86

For this section of the Business Management Proposal, the requirement states “Offeror’s should provide a listing of any major subcontracts that are anticipated.” Will the Government define what constitutes a “major” subcontract?

In determining whether a proposed subcontract is for a major or critical aspect of the work, the Government will consider whether the proposed subcontractor will supply 25% or more of the total number of FTEs for the contract effort or, if the proposed subcontractor will be responsible for performing one or more of the following areas: Outreach and Admissions, Academics, Career Technical Training, Health and Wellness, Counseling, Residential Living, Security, or Career Transition Services.

Solicitation M.2 (Basis for Award / Selection Criteria) Pg. 91

Will Technical Approach (Factor 1), Past Performance (Factor 2), and Staff Resources (Factor 3) be adjectively rated (e.g., Marginal, Acceptable/Satisfactory, Very Good) and, if so, what is the criteria for each rating so Offerors better understand what is expected to achieve a higher ratings?

Refer to RFP Section M Evaluation Factors and Selection Criteria, M.2 Basis for Award/Selection Criteria. Offerors will be adjectively rated in these areas, however the government will not disclose its rating system. The evaluation is based on the evalluation criteria in section M. Under those criteria, the panel will identify strengths, weaknesses, significant weaknesses and deficiencies. The definition of these terms is identified in the FAR.

Attachment J-2, ETA 8554 (Statement of Financial Capability)

What financials are required to complete the Attachment J-2/ETA 8554 (e.g., year to date, most recent month/quarter, last annual audited, Offeror’s choice)?

Most recent financial audit report is required in accordance with instrctions required on Attachment J-2.

Attachment J-4 (Staffing Chart) Should NTC personnel be listed in the J.4 Staffing Chart? If so, should they be assigned a “Position Number” and counted under the “Subcontractor” column?

No. NTC staff are accounted for under a separate contract.

Attachment J-4 (Staffing Chart) The J-4 Instructions state not to change position titles in column 1. For CTT Instructors, can we specify just the proposed Instructors by Offering in column 1 and delete the others not being proposed?

Positions not being proposed may not be deleted.

Attachment J-8, SF 1413 (Statement and Acknowledgement) Pg. 1

We understand the Attachment J-8 is to be used to identify any subcontractors. If submitting a proposal without any subcontractors or when subcontractors may not be known until after award (e.g., medical, dental, construction), is the J-8 required to be submitted with the proposal and, if so, in which volume?

The submittal of RFP Attachment J-8 applies only if you have known subcontractors.

Attachment J-28 (Staff Compensation Plan) Should NTC personnel be listed in the J.28 and with an assigned “Position Number?” No.

General For the various forms or documents requiring signature such as the Transmittal Letter, SF33/30, ETA 8554 (Atch J- 2), SF 1413 (Atch J-8), and Statement from the Lending Institution, will the Government accept electronic signatures?

Yes, the Government accepts electronic signatures.

H6C - Issue is the Wage Determination has not been provided.

Can the Government please provide the Wage Determination? Please refer to page 63 of RFP J-15 and J-16 Attachments for the applicable wage determinations.

In DOD’s guidance memorandum dated May 25th, 2022, the agency confirmed a willingness to include EPA clauses in new contracts to combat inflation risk in firm fixed price contracts stating “an EPA clause may be an appropriate tool to equitably balance the risk of inflation between the Government and contractor”. Will DOL consider including FAR 16.3203-2 and consider the following 4 factors: 1. considerations for selecting an index to measure inflation that is linked to cost components that are most unstable;

2. limitations on the scope of the EPA to exclude costs that are unlikely to be affected by inflation;

3. allowance for both upward and downward adjustments in price; and

4. establishing formulas for calculating the new pricing instead of merely reopening price negotiations.

The Government will not be including any type of economic price adjustment clause in the solicitation at this time.
