Page/Section (if cited by contractor) Question(s) Answer(s)
63 The instructions in J-4 indicate “For positions not needed on the contractor's staffing chart, the contractor shall eliminate the row for that position. Where more than one of the same position is needed, the contractor shall insert a new row.” In prior solicitations, offerors were advised not to remove rows. Please confirm preference. Please follow the instructions in J-4 for this solicitation, which specifically notes that the contractor shall eliminate the rows for positions not needed.
66 Please clarify the application of “(i) 52.203-2, Certificate of Independent Price Determination. Is it correct this provision applies to solicitations when a firm-fixed-price contract or fixed-price contract with economic price adjustment is contemplated” in section K? FAR 52.203-2 is a required provision of the subject RFP.
80 Please clarify the page limitation of the Technical Approach. Recent RFPs have shifted to a 43 page limit in consideration for the fonts desired. The table in Section L.6, paragraph H Page Limitation for the Technical Approach is hereby changed from 40 pages to 43 pages.
n/a Are offerors required to bid SCA wages for every position they propose in their organizational chart? If not all, then which positions must comply? In accordance with Section H.6 of the RFP, SCA is applicable. It is up to the offeror to determine which position(s) SCA is applicable to.
n/a Since offerors are not required to provide individual salaries in their bid, how would the Government know if an offeror is not complying with SGA wages and benefit requirements? Will there be a post award salary audit to verify compliance? 41 U.S.C. chapter 67, Service Contract Labor Standards (also known as the McNamara-O’Hara Service Contract Act or SCA), the regulations at 29 CFR part 4, FAR subpart 22.10, FAR Clause 52.222-41, and all other applicable SCA FAR clauses, are applicable to contracts for the operation and management of Job Corps Centers with Outreach and Admissions and/or Career Transition Services. Any complaints or suspected violations of the laws will be thoroughly investigated by the U.S. Department of Labor. The SCA(s) and DBA(s) must be posted on the work site in a public area where employees can easily access the information.
n/a If there is a post award salary and benefit audit, who conducts the audit, what is the audit protocol, and what types of information must the awardee be prepared to provide the Government to demonstrate compliance? Any audit will be conducted by the Wage and Hour Division, U.S. Department of Labor.
J-8 Attachment Please confirm that attachment J-8 is not required to be submitted as the information would not be determinable at the time of the proposal. This form is required to identify any subcontractors included in an offeror's proposal.
20, F.5 Will the government please provide the Wage Determinations for all the counties identified in the NEAP for the Penobscot JCC. Additional SCAs for all counties identified in the NEAP are attached as J-16s with Amendment 0002. In addition, please note that the SCA attached to the original RFP is also updated and is attached.
n/a Will DOL please confirm that SCA wages and H&W rate should increase by a minimum of 3% every year of the proposal? Escalation of pricing between the base and option periods of 3% is a recommendation from DOL. However, the Department of Labor Wage and Hour Division sets the SCA Wages and Health and Welfare rates in the applicable Wage Determinations.
36, H.5 Please confirm if the CLIN reference in this paragraph should be to CLIN xx08? Yes, this is in reference to CLIN XX08 for Special Projects/Initiatives as directed by the Government.
36, H.6 From reading, Reg. 29 CFR 4.173., for vacation accrual purposes, contractors are required to recognize previous hire dates for work performed on the contract regardless of which contractor operated the center. In addition, the WD states 2 weeks paid vacation after 1 year of service with a contractor or successor. Is this regulation applicable to this implementation and should the hire/vacation accrual date be when the employee originally was hired on the contract (regardless of which contractor operated the center) or should the hire/vacation accrual date be when the employee was hired with the current contractor? Vacation pay is determined based on the total length of time an employee has been in the employer’s service (commercial work and federal contract)AND the total length of time the employee has been employed in any capacity in the continuous service of any predecessor contractor who carried out similar contract functions at the same facility. The sum of these two conditions = total service time which is what should be used to determine the numebr of paid vacation weeks an employee is entitled to. 29 CFR 4.173(a)
63, J-4 To be consistent with Attachment J-4 staffing chart can unused positions be deleted from Attachment J-28? Yes, the J-28 can be made consistent with the J-4 by removing unused positions.
n/a There is uncertainty about future costs to FFP contracts, especially in the current environment where inflation or CPI is 8.5%. Contractors try to include risk premiums in their bids to ensure viability through these unprecedented circumstances, causing overall higher bid prices. In accordance with FAR 16.203-1, will the government consider adding an Economic Price Adjustment (EPA) or Price Adjustment Clause to the contract? By minimizing long term unknown inflationary risks factors from the contractor, the need for inflationary risk contingency costs is eliminated, resulting in a more realistic and competitive overall bid price. The government is not including 52.216-4 at this time.
80, H.b Restricting the type of font to Times New Roman or Arial significantly reduces the proposal response space (up to 3 pages depending on font type). -Would DOL consider accepting “Garamond” type font for this proposal? The table in Section L.6, paragraph H Page Limitation for the Technical Approach is hereby changed from 40 pages to 43 pages.
C.2.I Failure to maintain staffing levels states damages will begin on the first month of operations. Will the Government consider revising this language to state “Beginning the fourth month of operations” which is similar to other FFP contracts awarded? In accordance with the Statement of Work, C.2.I. Failure to Maintain Staffing Levels: Beginning the first month of center operations, if the contractor’s vacancy rate exceeds 4% (as reported in the monthly Wage Comparability Tool submitted during the following month), the contractor shall reduce its invoiced price by an amount equal to the sum of the monthly salary(ies) for all vacant positions over the permitted 4%.
G.9 The Executive Order and SCA requirement has significantly increased wages. The OBS payback calculation assumes 15% of the contract value is a group of select non-personnel lines. There has been no consideration for increases in personnel expenses and the dilution of non-personnel expenses. Will the Government consider a CLIN structure that breaks out personnel, nonpersonnel and non-personnel expenses subject to the 15% OBS price adjustment? Offerors shall propose in accordance with the J-1 and Schedule B CLINs.
J-28 The first step of the J-4 Staffing Chart Instructions includes “For positions not needed on the contractor's staffing chart, the contractor shall eliminate the row for that position.” Will the Government allow offerors to remove any unused rows/positions, to align with the instructions of the J-4 Staffing Chart? Yes, the J-28 can be made consistent with the J-4 by removing unused positions.
n/a The previous RFP ( 2018 ) required prevailing wages be paid to the following positions. Should offerors consider these wages for personnel cost development? The previous RFP does not apply to the current RFP for the Penobscot Job Corps Center. It is the operator’s responsibility to be familiar with the local labor market and the prevailing wages and benefits in the area, to include SCA prevailing wages.
