About this file
This amendment to a request for proposals provides clarification regarding the operation of two Puerto Rico Job Corps Centers. The amendment answers questions about wage determinations, prevailing wages, incumbent employee information to be provided, training slots and trades, facility conditions and projects, and other policy requirements. Clarification is provided that advanced training slots, off-the-job training health care slots, and certain career technical training slots must be operated on a 1:1 basis. Facility project updates indicate that redevelopment of the Arecibo Center is in final design, while Phase II of the Ramey Center project will add new vocational training areas.

Soliciation Section Question(s) Answer(s)
I There have been significant, unprecedented shifts in inflation over the past two years. To equitably balance the risk of inflation between the Government and contractor and in accordance with FAR 16.203-3 and 4, will the government consider including FAR 52.216-4, Economic Price Adjustment- Labor and Material Clause in the clauses incorporated by reference. The government is not including 52.216-4 at this time.
I Currently, when a contract is awarded to a non-incumbent, the incumbent contractor pays the employee vacation time earned but unused as part of the final paycheck received. Title 29, Part 4 of the Code of Federal Regulations, Section 4.173 indicates that the vacation time continues, as long as there is no break in service. The contractor by whom a worker is employed at the time the vacation right vests (i.e. on the employee's anniversary date of employment) must provide the full benefit required by the wage determination which is applicable on that date, whether or not it is the predecessor or the successor contractor. o Will the successor contractor be entitled to this information in the list of incumbent service employees required to be provided by the CO/incumbent contractor at the time of transition (along with names, date of hire and position) along with a listing of active employees vacation utilized in current year?
o Will DOL modify new contracts that are awarded to the nonincumbent with funding to absorb the unknown vacation balances to be assumed and paid out under the new contract?
DOL will not modify new contracts to provide funding to absorb vacation balances, as the expectation is that balances would be paid out by the end of the predecessor contract. See FAR 52.222-41(n) regarding the successor contractor receiving data pertinent to incumbent personnel.
J Wage determinations do not list all job titles typically utilized on a JC contract.
Will DOL create non-standard wage determinations by locale or a nationwide industry specific wage determination? If a prospective offeror seeks a conformance, please refer to the process identified at: https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/Tab15.pdf.
L Section L.6, D. Site Visit: Offerors are directed to visit the center virtually in lieu of a site visit due to Covid. The JC Market Place does not include virtual campus tours for the Ramey and Arecibo Centers. Please provide an alternative option if a site visit is not appropriate at this time. Please see the following links to visit each center virtually: https://arecibo.jobcorps.gov/ https://ramey.jobcorps.gov/. In addition, the following links for photos: The Arecibo photos can be found here: https://www.dropbox.com/sh/z7qaagb8qrhczq7/AACn45X1GSnowlTjpxwVaVwQa?dl=0 The Ramey photos can be found here: https://www.dropbox.com/sh/867g4vv0hgxvs25/AAD4uXG1W8IDn_Ttc5fYevOna?dl=0
I The 2017 RFP which resulted in award included the minimum prevailing wage clause. Please provide the current average wage, by position category, to ensure key staff retention at contract start. DOL will not provide this information, as it can be considered proprietary to the incumbent. This RFP does not specify a minimum wage for positions not subject to the SCA or DBA.
| I | To ensure adequate costs are captured for vested vacation, please provide years | |
| of service and anniversary dates for current SCA employees. | See FAR 52.222-41(n) regarding the successor contractor receiving data pertinent to incumbent personnel. |
| G | G.9 Price Adjustment for less than 100% OBS: Please confirm the price | |
| adjustment will be assessed on the combined OBS of both centers. | This is correct, the price adjustment formula will be based on the combined OBS of both centers. |
| B/J | Please confirm that the submission of one cost estimate/proposal and J-1 | |
| Attachment is sufficient to meet the requirements of this RFP. | This is correct One covering both centers is sufficient. |
| Vacancy Damages: Please confirm the vacancy damages will be assessed on the | ||
| combined vacancy rate for both centers. | The vacancy reduction methodoly will be assessed on the combined vacancy rate. |
H.6 Are contractors required to pay student workers on center SCA rates and H&W benefits? The SCA applies to all persons who actually perform the service work called for by a covered contract, “regardless of any contractual relationship that may be alleged to exist between a contractor or subcontractor and such person,” except those persons expressly exempted from the definition of “service employee.” If a person is engaged in performing any service work called for under a covered contract, such person must be paid the wage and FBs provided under the Act, irrespective of any alleged “independent contractor” or non-employment relationship.
H.6/J Which wage determination should contractors use for satellite locations such as OA/CTS offices? Will DOL include those wage determinations in the RFP? The government does not know where contractors will choose to locate OA/CTS offices. Please refer to 52.222-49 for information concerning the process of incorporating WDs when the location is not known by the government.
H.6 What if the position fits within a position on the wage determination but also supervises student workers? Is the position required by the SCA to be paid more? If an offeror has determined that a position is subject to SCA, then the position that is on the applicable SCA wage determination should be used as positions do not distinguish as to which classifications/positions are being supervised. When the classification doesn’t fall within the scope of any other classifications listed on the wage determination, then a conformance is needed. Also, if the position is exempt under the Fair Labor Standards Act under 29 CFR Part 541 as executive, administrative, or professional exempt then they are not subject to the SCA.
H.6 For the positions which are seniors or lead workers, does the SCA require them to be paid more than the lower position? For example, Senior RA and RA. If the applicable SCA wage determination has various levels for a classification/position, as a business decision, it is up to the offeror to select the appropriate level(s) for that position
H.6 What if the position does some work in more than one position on the wage determination? The offeror should reflect a position where the work will be performed in more than one position on the applicable wage determination. For example, if there is a secretary that will also perform as a file clerk in a 50/50 capacity, the offeror would reflect secretary .5 and clerk .5 to show that the FTE is performing in both positions of the wage determination.
H.6 Is a conformance required for positions, such as Residential Advisor, that are not on the wage determination? If a prospective offeror seeks a conformance, please refer to the process identified at: https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/Tab15.pdf.
H.6 Can a contractor just select the lowest level position in the job families that have levels I, II and III, such as Accounting Clerk, Secretary and General Clerk?
Can a contractor just select the lowest level position in the job families that have levels I, II and III, such as Accounting Clerk, Secretary and General Clerk?
The offeror should reflect a position where the work will be performed in more than one position on the applicable wage determination. For example, if there is a secretary that will also perform as a file clerk in a 50/50 capacity, the offeror would reflect secretary .5 and clerk .5 to show that the FTE is performing in both positions of the wage determination.
H.6 Are all nonexempt employees entitled to health and welfare benefits, regardless of how many hours they work? Yes
H.6 Are substitute or on-call nonexempt employees entitled to the health and welfare benefits? Yes
H.6 Are any of the employees represented by a union? If so, can we get a copy of the agreement and how does this affect the SCA wages? The contract does not have any associated bargaining agreements.
H.6 In reviewing the Wage Determination listed in this RFP, most pay rates listed have a rate of less than $15. Does the minimum wage apply to the Puerto Rico Job Corps Centers? If yes, will an updated wage determination be issued? The minimum wage applies to Puerto Rico and thus the contractor must pay at least the minimum wage or the prevailing wage, whichever is greater.
H.6 From reading Reg. 29 CRF 4.173, for vacation accrual purposes, contractors are required to recognize previous hire dates for work performed on the contract regardless of which contractor operated the center. In addition, the WD states 2 weeks paid vacation after 1 year of service with a contractor or successor. Is this regulation applicable to this implementation and should the hire/vacation accural date be when the employee originally was hired on the contract (regardless of which contractor operated the center) or should the hire/vacation accrual date be when the employee was hired with the current contractor? If this does apply for contractors who did not recognize time with the contract during the transition how should this date be obtained? We want to obtain the proper date to avoid our employees missing out on a higher vacation amount where applicable. See FAR 52.222-41(n) regarding the successor contractor receiving data pertinent to incumbent personnel.
L.6.H Since the contract requires the operation of two centers (Ramey and Arecibo), will the Government grant additional pages (more than 40) for the Technical proposal? The page limit for the Technical Proposal is changed from 40 to 45 pages.
J To be consistent with Attachment J-4 staffing chart, can unused positions be deleted from Attachment J-28? Yes
J-9 The executive summary notes the preventive maintenance could use improvement. Can the contractor assume that these are to be fixed through CRA funding, Equipment, and/or CTST funding rather than through Operational funding?
If some of the above issues are to be fixed through Operational dollars, can the Government identify which items those will be and provide further insight for contractors?
Items identified in poor condition in the survey will be covered under CRA. Preventative maintenance shall be included in the Operational dollars.
N/A Is there an incumbent contractor? If so who is it, and will the government provide the value of the contract? The incumbent contractor is Res-Care, Inc. and the value of the contract is $60,828,566.00.
Are there incumbent personnel and if so can we get their positions and date of hire? See FAR 52.222-41(n) regarding the successor contractor receiving data pertinent to incumbent personnel.
If this is a new requirement is it a consolidation of other existing contracts? It is a follow-on contract.

Please clarify the accuracy of the training and slots issued in the J-5. The RFP reflects the correct CTT trades and training slots. The J-5 document shows CTST slots which are different than CTT slots
The CTST slots for Advanced Solar PV and Thermal System Installer are different from Section C.2. Will DOL please clarify if the J-5 is accurate? Section C.2 does not discuss CTST slots but only CTT slots. The J-5 document accurately states the CTST slots. Please refer to the PRH for an explaination of the two.

If yes, please provide a list of the certifications/licensure so that the maintenance workers can be classified correctly. Maintenance workers are not required to have certifications for facility equipment. However, many of the services that are often subcontracted require certified or licensed personnel for plumbing, electricial and HVAC.
Please confirm if there are costs for utilities outside of Electricity, Water, Propane and Oil, such as sewer, etc. Could the government please provide updated utility information if there are additional costs not listed? No additional cost outside of Electricity, Water, Propane and Oil.
PRH Chapter 5, Management Services: Is the contractor expected to address any current or scheduled O&M issues upon contract award. If so, please identify any outstanding O&M projects and projected costs. All current O&M issues are being addressed. Upcoming-arising issues are unknown.
PRH Exhibit 5-6, Center Health Services Staffing, requires that optometry services are provided. Typically, this is provided as a fee-for-service subcontract. Does DOL require this service to be defined with an FTE count in the Organization chart and J-4? Per PRH Exhibit 5-6 Center Health Services Staffing Requirements a Subcontract with licensed optometrist is required.
* Optometrist: The center must have a (sub)contract with a licensed optometrist (or ophthalmologist) to provide optometric services.
