STATEMENT

Office of Workers’ Compensation Programs Resource Center Operation and Managerial Support

Part 1 – General Information

1. GENERAL: This is a non-personal services contract to provide operational and managerial support for each of the Department of Labor’s Office of Workers’ Compensation Program’s Division of Energy Employees Occupational Illness Compensation (DEEOIC)’s eleven stationary Resource Centers located nationwide. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the operational and managerial support for each of DEEOIC’s eleven stationary Resource Centers located nationwide as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in the resulting contract.

1.2 Background: Public Law 106-398, the Energy Employees Occupational Illness Compensation Program Act of 2000 (EEOICPA), established a program to compensate nuclear weapons program workers who suffered adverse effects from exposure to beryllium, ionizing radiation, and other hazards in the course of their nuclear weapons program-related work. The Fiscal Year 2005 National Defense Authorization Act, signed by President Bush on October 28, 2004, amended the EEOICPA by creating a new system of federal compensation called Part E. Part E is administered by the Department of Labor and affords coverage to U.S.

Department of Energy contractors and subcontractors and certain individuals potentially covered by the Radiation Exposure Compensation Act for exposures to an array of toxic substances and chemicals.

Since many EEOICPA claimants are expected to be elderly, in poor health, or survivors of deceased nuclear weapons program workers, the Department of Labor’s Division of Energy Employees Occupational Illness Compensation (DEEOIC), which administers the EEOICPA, operates 11 Resource Centers nationwide to relieve potential and existing EEOICPA claimants of as much of the initial burden to submitting EEOICPA claims as possible. DEEOIC’s 11 Resource Centers are located in the following cities and states where potential EEOICPA claimants are expected to be concentrated: Dublin, California; Westminster, Colorado;

Espanola, New Mexico; Richland, Washington; Idaho Falls, Idaho; Las Vegas, Nevada; Amherst, New York;

Oak Ridge, Tennessee; Paducah, Kentucky; Portsmouth, Ohio; and North Augusta, South Carolina. The Government is responsible for procuring Resource Center office space through the U.S. General Services Administration. Resource Center office locations may change at any time if the Government requires a location change. The new location will be determined by the Government and only by the Government.

Resource Center locations may change if required by the Government and only if required by the Government. The amount of contactor staff/labor categories located at each facility provided/procured by the Government may not exceed the amount of space that facility accommodates. For example, if a facility (Resource Center) provided/procured by the Government only allows space for 5 desks, the contractor may not hire 6 staff/labor categories at the location and then place an extra desk into the facility (Resource Center) and/or request that the Government change the facility’s (Resource Center) location to accommodate the additional staff/labor categories. The contractor must abide by the space allotted at each facility (Resource Center) provided/procured by the Government and then staff each facility (Resource Center) with the amount of staff/labor needed to perform and accomplish all the tasks stated in this Performance Work Statement working within the limits of the provided space. Technical Exhibit 3 includes the location of all eleven stationary Resource Center premises.

Resource Center staff assist potential and existing EEOICPA claimants by assisting in the completion and filing of EEOICPA claim forms; completing Part E Occupational History Questionnaire (OHQ) interviews;

providing claimants with status updates on their existing EEOICPA claims, gathering pertinent employment and medical documentation whenever necessary, assisting in interactions with the Department of Labor and the Department of Energy, and by providing assistance to claimants and their medical and service providers to resolve payment issues relating to medical bills and travel reimbursement. Each regional Resource Center is expected to establish appropriate working relationships with local Department of Energy field elements and site contractors and state and executive agencies that assist DEEOIC with the adjudication of claims under the EEOICPA. The Resource Center staff also conducts outreach activities that consist of any and all activities deemed necessary by DOL to provide information to the public and solicit EEOICPA claims. Outreach activities also include establishing and maintaining relationships with state and local organizations in an effort to keep the public informed about the EEOICPA including all current policy and developments.

1.3 Objectives: The primary objectives of DEEOIC’s Resource Centers are:

(1) Complete and submit EEOICPA claim forms either via telephone or in-office appointment. This will involve preparing claim forms for the claimant’s review and signature.

(2) Complete and submit all additional OWCP/EEOICPA forms needed in support of EEOICPA claims either via telephone or in-office appointment. This will involve preparing the forms for the claimant’s review and signature.

(3) Complete initial OHQ interviews for Part E cases whenever necessary either via telephone or in-office appointment.

(4) Answer claimant questions regarding Parts B and E of the EEOICPA via telephone or in-office appointment. This will include ensuring Resource Center staff have experience with the EEOICPA, the EEOICPA’s governing regulations, all versions of the Federal EEOICPA Procedure Manual, all transmittals that describe the specific revisions to the Federal EEOICPA Procedure Manual, and all EEOICPA Final Bulletins and Circulars.

(5) Answer claimant questions regarding all facilities covered under the EEOICPA and the toxic exposure that may have occurred during their employment at these facilities.

(6) Provide claimants with status updates on their existing EEOICPA claims either via telephone or in-office appointment.

(7) Transmit all documents submitted by a claimant to the Government timely. Including, but not limited to, all new claim forms, all additional OWCP/EEOICPA forms, Part E OHQ interviews, employment and medical records, and all other supplemental documentation.

(8) Establish and maintain relationships with Department of Energy field elements and site contractors and with state and executive agencies that assist DEEOIC with the adjudication of claims under the

EEOICPA.

(9) Answer both claimants and medical providers’ questions regarding EEOICPA medical benefits. This may include researching various Government systems for information regarding the status of a claimant’s medical reimbursement and/or travel claim.

(10) Conduct and coordinate outreach activities both independently and with/supporting the Government. The purpose of the outreach activities being to solicit new claims and provide the public with information about the EEOICPA. All independent outreach activities must be approved by the Government.

(11) Answer phone calls placed to the Government using the Government approved phone system (these phone calls are in addition to answering phone calls placed directly to the Resource Centers – all phone calls need to be answered timely)

1.4 Scope: The contractor shall provide all administrative, professional, and technical support necessary to maintain all 11 existing DEEOIC Resource Centers.

1.5 Period of Performance: The period of performance shall be for one (1) Base period of 12 months with four

(4) 12 month option periods.

1.6 General Information

1.6.1 Quality Control: The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The Contractor will provide their Quality Control Plan (QCP) as part of the Contractor’s proposal with a final version reviewed and accepted by the Government within 90 days after contract award. The approved comprehensive written QCP shall be submitted to the CO (Contracting Officer) and COR within 5 business days when changes are made thereafter.

After acceptance of the quality control plan the Contractor shall receive the CO’s acceptance in writing of any proposed change to his Quality Control system.

In any instance where the Contractor has knowledge that any actual or potential situation may delay or threaten to delay the timely performance of the resulting contract, the Contractor shall immediately notify the COR, in writing, via email. This notice shall include all relevant information and corrective actions that are being taken. The Government reserves the right to hold the Contractor fully accountable for problems incurred as a result of such delays, including denial of delivery time extensions, if such notification is not provided.

The Contractor shall be fully responsible for all loss or damage to materials associated with this PWS while in the Contractor’s care and custody

1.6.2 Quality Assurance: The government shall evaluate the Contractor’s performance under the resulting contract in accordance with the Quality Assurance Surveillance Plan. This plan is focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

The Government will evaluate the Contractor's performance, and assure quality services and deliverables, as specified in the Performance Requirements Summary (PRS, Technical Exhibit 1) and the Quality Assurance Surveillance Plan (QASP). The plan will detail what the Government will do to ensure successful Contractor performance. The PRS details how performance standards will be applied, surveillance frequency, and the minimum acceptable defect rate. The Government will measure quality by regularly meeting with the Contractor employee and Project Manager, at which time the Government and the Contractor will review weekly/monthly progress reports, assigned tasks, and contract deliverables (as required). The Government’s sample QASP is provided in the “Attachments” section.

1.6.3 Recognized Holidays: The contractor is not required to work the following holidays:

New Year’s Day Labor Day Martin Luther King Jr.’s Birthday Columbus Day President’s Day Veteran’s Day Memorial Day Thanksgiving Day Independence Day Christmas Day

1.6.4 Hours of Operation: The contractor is responsible for conducting business, between the hours of 8:30 a.m.

thru 5:00 p.m., Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.6.5 Place of Performance: The work to be performed under the resulting contract will be performed at facilities provided/procured by the Government. Reference Technical Exhibit 3 which states the location of each stationary Resource Center. Resource Center office locations may change if required by the Government and only if required by the Government.

The new location will be determined by the Government and only by the Government. The contractor must be able to relocate at no additional cost to the Government, if required. Although not guaranteed, the location will be within the state of current operations. Technical Exhibit 3 includes the location of all eleven stationary Resource Center premises.

Telework by Resource Center staff is not permitted.

1.6.6 Type of Contract: The government contemplates the award of a Firm-Fixed-Price Contract.

1.6.7 Security Requirements: All contractor employees proposed to perform under the resulting contract at a government facility or proposed to access Department of Labor information or other sensitive information require background investigations. The Office of Personnel Management will conduct background investigations of contractor employees. Since the Office of Personnel Management only accepts requests from Federal agencies to conduct background investigations, the DOL Contracting Officer or designee will make arrangements with the contractor to send the contractor employee’s completed investigation papers to the DOL Agency for submission to the Office of Personnel Management.

1.6.7.1 Background Investigation Requirements: The Contracting Officer’s Representative will inform the contractor of the investigation requirements for each contractor employee position, as well as the required forms and other documents to be submitted. On or before the contractor employee starts working on the project, the contractor shall submit the following documents completed by the contractor employee: an Optional Form (OF) 306 Declaration of Federal Employment; a DL1-7007 U.S. Department of Labor Previous Investigations Check (PIC) Form; a USAccess Badge Only Form; a current resume; and a Non-Disclosure Agreement (Attachment J.4).

If the DOL Contracting Officer or DOL’s Contracting Officer’s Representative determines that the contractor employee is required to complete any other documents, the Contracting Officer’s Representative will so inform the contractor. The contractor shall make arrangements with the Contracting Officer’s Representative to ensure that the contractor employee is fingerprinted. The forms listed above can be found at the following website:

http://www.opm.gov/forms. All contractor employees proposed to perform under the resulting contract at a DOL facility or proposed to access DOL information or other sensitive information will be fingerprinted at a designated location to preserve chain –of –custody.

1.6.7.2 Payment for Background Investigation: The Government is responsible for the cost of the investigations, unless otherwise specified.

1.6.7.3 Investigation Process: On or before the contractor employee’s first day of work, the contractor shall provide the forms listed in 1.6.7.1 above to the Contracting Officer or designee. If the contractor employee is assigned to Critical-Sensitive or Non-Critical-Sensitive work, the contractor shall ensure that he or she completes the Fair Credit Reporting Act (FCRA) release form. If the contractor employee is assigned to Low Risk work and is employed on http://www.opm.gov/forms a seasonal, daily, or intermittent basis, or for no more than 180 days, he or she does not have to complete the forms listed in 1.6.7.1 above, but the contractor shall ensure that the contractor employee is fingerprinted as directed by the Contracting Officer or designee. Low risk work includes tasks with potential for limited impact (as defined by the Government) to the OWCP programs or mission, or on the integrity and efficiency of services. The contractor shall submit written procedures to the designated DOL Agency official describing the procedures it will follow to satisfy all investigation requirements.

1.6.7.4 Unfavorable Suitability Determination: If a designated DOL official determines that the contractor employee is unsuitable after evaluation of the investigative findings, the Contracting Officer or designee will inform the contractor in writing that the contractor employee is being removed from or denied access to DOL facilities and/or information and information systems. Any removal or denial of access of a contractor employee will not be considered ground for delay or adjustment claim from the contractor. Also, if the contractor employee answers “Yes” to one or more of questions 9 through 13 of the OF-306, the contractor employee will not be permitted to work on a DOL contract without prior DOL approval.

1.6.7.5 Contractor Employee Non-Disclosure Agreement: The contractor shall require each contractor employee to review and sign the non-disclosure agreement, on or before the employee’s first day of work on the DOL contract.

The contractor shall send the signed copy to the Contracting Officer or designee.

1.6.8 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials should be secured.

1.6.9 Information Technology Systems Security: The Contractor shall guarantee strict confidentiality of the information/data that is provided by the Government during the performance of the contract. The Government has determined that the information/data that the Contractor will be provided during the performance of the resulting contract is sensitive in nature.

1.6.10 Privacy: Portions of information disclosed during the performance of this task may be protected by the provisions of the Privacy Act of 1974; therefore, all personnel assigned to the resulting contract shall take proper precautions to protect the information from disclosure. The Contractor shall be responsible for reporting any breach or suspected breach of data within one (1) hour of becoming aware of the incident. The Contractor shall notify the designated points of contact immediately via whatever means (e.g. phone call, email, etc.) satisfactorily accomplishes this requirement. Thereafter, the Contractor shall confirm the breach and gather all necessary facts needed for the Government to complete an Incident Report form. The contractor must notify the Government of all details of the security incident involving Personally Identifiable Information (PII).

In the event of a suspected, potential or PII breach, the Contractor shall notify the following e-mail, zzOWCPSECURITY@dol.gov, and the Contracting Officer’s Representative within one hour of the breach. As additional information becomes known, the Contractor shall update the E-mail group stated above. PII is defined as any and all documents or electronic records containing information of a personal nature which can be searched or retrieved by name, social security number or other personal identifying designation. Once the DOL completes an Incident Report someone within the Government will review the report to make a determination if there was a breach. In the event of a breach, the Contractor is not to notify the claimants and/or their authorized representatives. The Government will perform that notification.

1.6.11 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officer’s Representative, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the Contracting Officer will apprise the contractor of how the government views mailto:zzOWCPSECURITY@dol.gov the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.12 Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the contractor performs the technical requirements of the contract;

perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor contractor's performance and notifies both the Contracting Officer and contractor of any deficiencies; coordinates availability of government furnished property; and provides site entry of contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract.

1.6.13 Staffing: The contractor shall provide on-site contractor employee staff that are fully qualified in their respective labor categories to provide all service requirements specified in the Performance Work Statement. All contractor staff assigned to perform in accordance with the resulting contract are subject to Government review and approval. The Contractor is required to remove any employee whose conduct or performance is such that retention would not be in the best interests of the Government.

1.6.13.1 Key Personnel: The labor categories, Program Director and Deputy Program Director, are considered “Key Personnel.” The Contractor shall provide a Program Director who shall be responsible for the performance of the work. The name of this person and the alternate, Deputy Program Director, who shall act for the contractor when the Program Director is absent shall be designated in writing to the contracting officer. The Program Director or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of the resulting contract. The Program Director or alternate shall be available between 8:30 a.m. to 5:00 p.m., Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons. The contracting office must be notified of any change of key personnel.

Key Personnel may not be removed or replaced without the written consent of the Government. Any replacement candidate must have the same or better qualifications as the person released. The Contractor shall ensure that all employees assigned to Key Personnel positions are retained in those positions for at least 180 days following Government approval of their resumes unless the person leaves the Contractor’s employment or is incapacitated.

Any replacement candidate must have the same or better qualifications as the person released. Resumes of replacement Key Personnel must be provided and the Government must approve the replacement before that person starts work.

Key Personnel - Deputy Program Director

Functional Responsibility: Responsible for assisting Program Director with the delivery of all contracted services as outlined in the Performance Work Statement to ensure that all required performance standards are met.

Experience/Qualifications:

At least 3 years’ experience providing assistance for a federal, private or state workers’ compensation program, or working at or for a Department of Energy facility covered by the program

At least 5 years’ experience with customer service skills, over the phone and in person, with customers and internal departments

At least 1 years’ experience managing a similar size staff, in multiple locations At least 1 years’ experience managing, maintaining, and operating offices of similar size and scope Proven ability to ensure goals are met in areas including customer satisfaction, quality and team member performance Proven ability to produce accurate and timely reporting on program status.

At least 3 years’ experience providing assistance for a federal, private or state workers’ compensation program, or working at or for a Department of Energy facility covered by the program

At least 2 years’ experience with customer service skills, over the phone and in person, with customers and internal departments

1.6.13.3 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.6.14 Contractor Travel: The contractor will be required to travel the Continental United States, Hawaii, and Alaska, during the performance of the resulting contract to attend meetings, conferences, training, and to perform outreach activities with and on behalf of DOL. The contractor will be required to travel off-site to conduct any outreach activities deemed necessary by DOL to support this PWS. The contractor will also be required to ship outreach materials to these off-site locations in support of this PWS. All travel must be pre-approved in writing by the COR at least 15 days prior to travel date.

The contractor may also in some cases have to travel to assist terminally ill claimants to assist them with the completion and filing of their Energy Employees Occupational Illness Compensation Program Act claim and other necessary forms. There is no way to predict when situations involving the travel to a terminally ill claimant will arise. Therefore, the contractor does not need to submit travel to assist a terminally claimant 15 days prior to the travel date given the Government anticipates this type of travel will need to occur shortly after it is scheduled (in most cases on the same day as it is scheduled). Additional instruction regarding travel to terminally ill claimants, will be provided by the COR at the award kickoff meeting where specific travel procedures will be provided.

All travel must be in accordance with Federal Travel Regulations and FAR 31.205-46.

1.6.15 PHASE IN /PHASE OUT PERIOD: To minimize any decreases in productivity and to prevent possible negative impacts on additional services, the contractor shall have personnel on board, during the phase in/ phase out periods. During the phase in period, the contractor shall become familiar with performance requirements in order to commence full performance of services on the contract start date.

Part 2 – Definitions and Acronyms

2.1. DEFINITIONS:

2.1.1. CONTRACTOR. A supplier or vendor having a contract to provide specific supplies or service to the government. The term used in the resulting contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the Contracting Officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered but may include non-physical things such as meeting minutes.

2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the Performance Work Statement. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10. QUALITY CONTROL. All necessary measures taken by the contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.12. WORK DAY. The number of hours per day the contractor provides services in accordance with the contract.

2.1.13. WORK WEEK. Is defined as Monday through Friday, unless specified otherwise.

2.1.14. PERFORMANCE REQUIREMENT: The point that divides acceptable and unacceptable performance of a task according to the Performance Requirement Summary and the Inspection of Services clause.

2.1.15. PERFORMANCE REQUIREMENTS SUMMARY: A listing of the services outputs under the contract that are to be evaluated by the COR on a regular basis, the surveillance methods to be used for these outputs, and the performance requirements of the listed outputs.
