This solicitation is being issued as a Request for Quote (RFQ), to provide services of labor and materials to clean, repair, remove/replace two light transmitting wall panels, and paint Mine Simulation Laboratory per Statement of Work for National Mine

Health & Safety Academy (NMHSA) located in Beaver, WV.

The U.S. Department of Labor, Mine Safety and Health Administration (MSHA), intends to establish a Fixed Price contract with a Contractor to complete all required work as set for the details provided in the attached Statement of Work (SOW). It is the responsibility of the Contractor to ensure that they build into their quoted price the entire project. If any part of the work will be subcontracted, the quote must reflect the tasks to be performed by both the prime and subcontractor.

NATIONAL MINE HEALTH AND SAFETY ACADEMY

STATEMENT OF WORK

1.0 BACKGROUND

The mission of the Mine Safety and Health Administration (MSHA) is to protect the safety and health of the nation’s miners. The National Mine Health and Safety Academy was constructed on 74 acres in the early 1970s with the intent to provide a self-contained training facility for the Agency and the mining industry. Mining professionals from across the United States and many foreign countries come to the Academy for health and safety training. The Academy complex, which opened in 1976, consists of 9 buildings, seven of which are inter-connected, making up 347,410 square feet and includes classrooms and laboratories accommodating 600 students, a residence hall of 174 lodging rooms, a cafeteria, a library, auditorium, and wellness facilities.

The Mine Simulation Laboratory is located on the Mine Academy’s property. It is an above-ground simulated mine building that provides hands-on training for MSHA inspectors and mining industry personnel. The facility has a simulated coal mine with an indoor burn room on the lower level and a simulated metal/nonmetal mine on the second floor level.

1.1 OBJECTIVES

The objective of this procurement is to clean, make necessary repairs, prepare the surface, remove and replace two (2) light transmitting wall panels located on the upper portion of two sides of the building, and paint the exterior metal on the Mine Simulation Laboratory building and clean and paint other designated high exterior concrete areas of the Academy. Upon completion, the exterior walls of the Mine Simulation Laboratory and Academy will be more aesthetically pleasing to students, visitors, and staff.

1.2 SCOPE

The scope of this project has two parts as listed below:

The Contractor will provide all personnel, paint, painting tools, materials, supervision, other items and non-personal services, and any equipment needed to clean, make necessary repairs, prepare the surface, remove and replace two (2) light transmitting wall panels located on the upper portion of two sides of the building, and paint the exterior metal on the Mine Simulation Laboratory building (Building K on attached map), one (1) garage door, eleven (11) entry doors, and guttering and downspouts per specifications in Section 5.1. The area to be painted is approximately 13,236 square feet but must be verified by Contractor prior to bid. The measurement for the light transmitting wall panels is approximately 520’ x 55 ½” but must also be field verified.

The Contractor will also provide all personnel, painting tools, supervision, other items and non-personal services, and any equipment needed to clean and paint designated high exterior concrete areas of the Academy per this Statement of Work. Most of the high exterior concrete areas are on the 2nd and 3rd level of the residency hall (Building A on the attached map). The area to be cleaned and painted is approximately 8,448 square feet but must be verified by Contractor prior to bid. (The Government will provide paint for the designated high exterior concrete areas.)

It is expected that the Contractor may need to attend a site visit for the purpose of this contract in order to conduct an overall assessment to determine appropriate steps.

Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract is awarded.

1.3 SPECIAL QUALIFICATIONS

The Contractor shall provide evidence that he has obtained all licenses and permits required by law to engage in the activities that are required in connection with the Statement of Work. Contractor must engage an experienced painter with at least 5 years’ experience.

1.4 PERIOD OF PERFORMANCE

The period of performance for this contract shall begin upon date of award. Work shall commence upon receipt of Notice to Proceed and be completed within 90 days.

All work must be scheduled to complete within this timeframe. The Contractor must keep a record of inclement weather delaying work on the project. Any modifications or extensions due to inclement weather will be requested through the Contracting Officer’s Representative (COR) and approved by the Contracting Officer.

1.5 RECOGNIZED HOLIDAYS

The Contractor is not required to perform services on the following holidays:

1.6 HOURS OF OPERATION

The Academy operates between the hours of 8:00 a.m. and 4:00 p.m. Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings.

1.7 PLACE OF PERFORMANCE

The work to be performed under this contract will be at NMH&S Academy, 1301 Airport Road, Beaver, Raleigh County, WV.

1.8 SECURITY REQUIREMENTS

Contractor staffs are required to conform to MSHA's security and privacy requirements as described below.

1.8.1 As a condition of employment with the U.S. Department of Labor (DOL), Mine Safety and Health Administration (MSHA), all employees must complete paperwork for a short e-QIP background investigation as needed.

1.8.2 Identification Badge. Contractor employees visiting Government facilities shall wear an identification badge provided by on-site security. Visiting Contractor employees shall comply with all Government escort rules and requirements. All Contractor employees shall identify themselves as Contractors when their status is not readily apparent and display all identification and visitor badges in plain view above the waist at all times.

1.8.3 Employee Conduct. Contractor employees shall comply with all applicable Government regulations, policies and procedures (e.g., fire, safety, sanitation, environmental protection, security, “off limits” areas, wearing of parts of military uniforms, and possession of weapons) when visiting or working at Government facilities.

The Contractor shall ensure contractor employees present a professional appearance at all times and that their conduct shall not reflect discredit on the United States, the Department of Labor or MSHA.

1.8.4 Removing Employees for Misconduct or Security Reasons. The Government may, at its sole discretion, direct the Contractor to remove any Contractor employee from MSHA facilities for misconduct or security reasons. Removal does not relieve the Contractor of the responsibility to continue providing the services required. The Contracting Officer (CO) will provide the Contractor with a written explanation to support any request to remove an employee.

1.9 SAFETY REQUIREMENTS

The Contractor shall ensure that fall protection and safety requirements are adhered to at all times and must follow all MSHA, OSHA, and Academy safety requirements.

1.10 CONTRACTING OFFICER REPRESENTATIVE

The Contracting Officer Representative (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting

Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract.

1.10.1 The Contractor will in the performance of this requirement immediately notify the COR or the MSHA Point of Contact if the time and/or service obligations of this contract cannot be met due to inclement weather, civil disturbances, equipment failure, illness, etc. MSHA recognizes the obligation of the Contractor to provide for the safety and well-being of personnel engaged in providing services under this contract. The Contractor shall notify the MSHA COR or other MSHA designated point of contact no later than 9:00 a.m. on the day the services were scheduled to be provided if any circumstances prevent timely performance.

PART 3

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.0 GOVERNMENT FURNISHED ITEMS AND SERVICES

Knowledgeable NMH&S Academy personnel will be made available to assist Contractor personnel in obtaining all information pertinent to this project. Utilities are available at the work site at no cost to the Contractor. Government will provide any available drawings related to this project. The Government will provide paint for the high exterior concrete areas.

3.1 CONTRACTOR USE OF PREMISES

The Contractor will be performing this work on the grounds of the National Mine Health and Safety Academy. The grounds have controlled access and as such the Contractor shall comply with Academy security procedures.

The Contractor will be provided a storage / staging area for equipment and materials in an area determined by the COR. The Contractor is responsible for restoring the area to its original condition at the completion of work and repairing any damages incurred to the area as a result of Contractor activities.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4.0 CONTRACTOR FURNISHED ITEMS AND SERVICES

The Contractor will provide all personnel, paint, painting tools, materials, safety equipment, supervision, permits, licensure, other items and non-personal services, and any lift equipment needed to perform the work at the Mine Simulation Laboratory.

Contractor will also provide all personnel, painting tools/supplies, safety equipment, supervision, permits, licensure, other items and non-personal services, and any lift equipment needed to perform the work on designated high exterior concrete areas.

The Contractor is responsible for the removal and disposal of waste that is a result of this project and must comply with all federal, state and local regulations pertaining to the transport and disposal of waste.

PART 5

REQUIREMENTS AND SPECIFICATIONS

5.0 REQUIREMENTS

All labor, planning, documents, materials, safety and lift equipment, supervision, incidentals, permits, licensure, and cleanup shall be provided by the Contractor to complete the following tasks.

5.0.1 Mobilization

• Mobilize personnel and equipment to job site storage/staging area

5.0.2 Clean and Prepare Surface

• Remove loose paint or rust by scraping all affected areas with a wire brush

• Clean by washing the entire surface with a steam power washer

• Repair/patch any cracks or dents in the siding

5.0.3 Apply Paint

• Apply two (2) coats of a water based acrylic paint designed for baked on finishes to all surfaces per manufacturer’s specifications and allow to dry

5.0.4 Remove/Replace Two (2) Light Transmitting Wall Panels

• Remove old light transmitting wall panels

• Re-install new light transmitting wall panels

• Ensure proper overlap and sealing to prevent water leakage

5.0.5 Cleanup and Disposal of Debris

• Cleanup, remove, and properly dispose of waste products generated during work on this contract

PAINT HIGH EXTERIOR CONCRETE AREAS

5.0.6 Mobilization

• Mobilize personnel and equipment to job site storage/staging area

5.0.7 Clean Surface

• Pressure wash all designated areas to remove loose paint, dirt, and grime

5.0.8 Apply Paint

• Apply (2) two coats of paint to all designated areas (Paint will be provided by the

Government)

5.0.9 Cleanup and Disposal of Debris

• Cleanup, remove, and properly dispose of waste products generated during work on this contract

5.1 SPECIFICATIONS

Paint for Mine Simulation Laboratory must be a water based acrylic paint designed for baked on finishes with color to match existing color of building. Paint color and wall panel color must be approved by the Government prior to purchase. Wall panels should be of equal or greater thickness as the existing panels. Contractor must follow all manufacturer’s specifications for applying paint products.

5.2 WORK SCHEDULE

All work shall be performed during the periods of time established by the U.S.

Government’s Contracting Officer’s Representative (COR) so there is no disruption in training that is scheduled at the Academy.

5.3 QUALITY CONTROL

The Contractor shall develop and maintain an effective quality control program to ensure the services and products are performed/delivered in accordance with this SOW.

The Contractor’s quality control program is the means by which they assure themselves that their work complies with the requirement of the contract. The Government reserves the right to inspect work at any time during the project.

5.4 INSPECTION AND ACCEPTANCE

For this project, the acceptance of all tasks will belong with National Mine Health & Safety Academy management and the Contracting Officer’s Representative (COR) in accordance with the contract. The selected Contractor must ensure it has adequate resources for completing work described in this SOW.

Once project tasks have been completed, the COR will make an inspection of the work.

The approval of this final inspection by the COR will acknowledge acceptance of all project deliverables and that the Contractor has met all assigned tasks.

Any discrepancies involving completion of tasks or disagreement between NMH&S Academy management or the COR and the chosen Contractor will be referred to both organizations’ Contracting offices for review and discussion.

5.5 DELIVERY, STORAGE AND HANDLING

Equipment and materials shall be carefully handled, properly stored, and adequately protected to prevent damage before and during installation, in accordance with the manufacturer’s recommendations and as approved by the COR. Damaged or defective items shall be replaced. All items are restricted to the allowed storage and staging area.

5.6 STOP WORK

All work shall be performed in a safe and professional manner. If work is not performed safely and professionally, the COR shall have the authority to stop work immediately.

This does not in any way affect the U.S. Government’s right to terminate the contract for default or convenience in accordance with the applicable provisions of the contract.

5.7 WARRANTY

Unless specified otherwise, in writing and agreed upon by all parties, all products, labor, and service must be warranted by the Contractor for a period not less than one (1) year from the official date of final Contractor payment.

Warranties imply that if any product or workmanship is not satisfactory during this period, it shall be replaced, adjusted, and/or repaired to the point of satisfactory, at no additional cost to the Government and is the liability of the Contractor to ensure all warranties are upheld. Government will not be liable for any costs associated to travel, lodging and per diem related to warranty repairs during the specified period as stated above.

a) 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. Quoters must comply with all instructions contained in FAR 52.212-1, Instructions to Offerors-- Commercial Items. FAR 52.212-1 is supplemented per following addenda:

Submissions shall be submitted prior to the closing date and include the following: name, address, and telephone number of the contractor, unit price, and overall total price, of the item/services being offered in sufficient detail to evaluate compliance with the requirements.

All quotes shall include the following documentation/information:

1. Quoters shall complete blocks 14, 15,17,20(a)(b)&(c) on the SF1442, page 1. These blocks contain the name and address of the Contractor, signature of the person authorized to sign quotation, and date of quotation. Contractor agrees to hold the prices in its quotation firm for 90 calendar days from the date specified for the receipt of quotations unless another time period is specified in an amendment to the solicitation.

2. The contractor shall also submit completed solicitation provisions and clauses 52.204-24, and 52.204-26.

PLEASE NOTE- All items highlighted in yellow in this RFQ must be completed and returned along with the quote. If these items are not completed and submitted at time of quote, you may be rated technically unacceptable. The Government encourages the quoters to provide discounts from their published pricing.

RFQ EVALUATION METHODS:

a) 52.212-2, Evaluation -- Commercial Items shall be used. The Evaluation as Commercial Items applies to this acquisition and that the Government expects to award a single order resulting from this RFQ to the responsive responsible quoter whose technically acceptable quote conforming to the RFQ will be the most advantageous to the government, price and other factors considered. The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services-Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision- Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.

Nothing in the prohibition shall be construed to-

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to-

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services-

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment-

52.219-1 Small Business Program Representations. (OCT 2014)

(a) Definitions. As used in this provision-"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.

Service-disabled veteran-owned small business concern-

(1) Means a small business concern-

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) "Service-disabled veteran" means a veteran, as defined in 38 U.S.C.101(2), with a disability that is service-connected, as defined in 38 U.S.C.101(16).

Small business concern—

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (b) of this provision.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that-

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by-

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States, and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned small business concern" means a small business concern-

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

"Women-owned small business (WOSB) concern eligible under the WOSB Program" (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

52.215-1 Instructions to Offerors - Competitive Acquisition. (JAN 2017)

(a) Definitions. As used in this provision-

Discussions are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer’s discretion, result in the offeror being allowed to revise its proposal

In writing, "writing," or "written" means any worded or numbered expression that can be read, reproduced, and later communicated, and includes electronically transmitted and stored information

Proposal modification is a change made to a proposal before the solicitation’s closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

Proposal revision is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

Time, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals.

(1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.
