About this file

This is Amendment 0003 to Solicitation 1605C2-26-R-00004 issued by the U.S. Department of Labor, Office of Contracts Management. The amendment, effective April 28, 2026, incorporates FAR clause 52.222-90 "Addressing DEI Discrimination by Federal Contractors" (April 2026 Deviation) into Section 2 of the solicitation. The clause prohibits contractors from engaging in racially discriminatory diversity, equity, and inclusion (DEI) activities, defined as disparate treatment based on race or ethnicity in recruitment, employment, contracting, program participation, or resource allocation. Contractors must provide requested information and reports for compliance verification, report any subcontractor violations to the Contracting Officer, and inform the Contracting Officer if a subcontractor challenges the clause's validity. Noncompliance may result in contract cancellation, termination, suspension, or contractor ineligibility for future Government contracts. Compliance with this clause is material to the Government's payment decisions under 31 U.S.C. § 3729(b)(4).

Contractors must acknowledge receipt of this amendment prior to the specified deadline through one of three methods: completing items 8 and 15 and returning the form, acknowledging receipt on each copy of the offer submitted, or submitting a separate letter or electronic communication referencing the solicitation and amendment numbers. Failure to acknowledge receipt at the designated location by the specified hour and date may result in offer rejection. The clause must be included in all subcontracts at any tier, including those for commercial products and services, except where delivery or performance occurs outside the United States. All other terms and conditions of the original solicitation remain unchanged.
