About this file

This document contains questions and answers regarding a Request for Information for the National Cryptocurrency Contract for Class 3 and 4 assets. The Marshals Service is seeking proposals for the storage, management, and disposal of seized and forfeited cryptocurrency. Specifically, they require solutions for cold storage of assets, separation of accounts based on seizure events, extraction of private keys from wallet files, auction services for cryptocurrencies that cannot be exchanged for fiat, and commission structures for liquidation of assets to fiat currency. Additional clarification is provided on classification of cryptocurrencies and handling of changes between classes during the period of performance. No other details such as pricing terms or response dates are included in this questions and answers document.

REQUEST FOR INFORMATION

NATIONAL CRYPTOCURRENCY CONTRACT – CLASS 3 & 4

NOTICE ID NO.: 15M50023RA44_TBD 3-4

QUESTIONS AND ANSWERS

.Q1: If you could kindly forward to us (or point us to) the following appendices:

• Appendix A: USMS Cryptocurrency Classification List

• Appendix B: Security of Information and Information systems DOJ Procurement

Guidance Document (PGD) 15-03

• Appendix C: Cloud Service Provider Requirements

• Appendix D: USMS Standards and Compliance Requirements

• Appendix E: Corporate Non-Disclosure Agreement

• Appendix F: DOJ USMS Non-Disclosure Agreement

• Appendix G: Rules of Behavior, DOJ Rules of Behavior 2021 General Users

• Appendix H: Personnel and Property Contractor Compliance Requirements

A1: Not available with the RFI.

Q2: For adhering to "USMS lifecycle compliance requirements", this is a catch-all phrase --correct? And not another specification document? Just to be certain.

A2: This is a catch-all phrase.

Q3: For the PWS documents Paragraph 2.4.3 "Standard Return to Third Party and/or USMS": is this an extraordinary circumstance -- as the pricing spreadsheet has a field for "Sales Commission" for estimated liquidations/disposal. Therefore, if you have any more context around when a commission for a liquidation is -or- is not applicable -- that would be great.

A3: Commissions for liquidations are only applicable when an asset is liquidated, and fiat currency is received. If an asset is to be returned, the contractor would not be eligible for commission as proceeds are not received.

Q4: Can you explain more about what kind of auction and auctioneer services you anticipate needing?

A4: In the event specific cryptocurrencies and/or tokens are not able to be exchanged for fiat we would like an option for auctioning them in batches like we’ve done in the past.

Industry best practices for auction processes and procedures are to be proposed by industry and evaluated/approved by the USMS.

Q5: Can you expand on what situations and the extent of private key recovery services you are looking for?

A5: Extracting private keys from wallet.dat files.

QUESTIONS AND ANSWERS

Q6: Is it safe to assume you are looking for storage space for servers, desktops, laptops, hard drives etc? Approximately how much space do you currently need or anticipate needing in the future?

A6: The space and equipment required is whatever the contractor would need to hold the assets in cold storage, segregated, as mentioned in the PWS.

Q7: How will USMS handle the scenario where Class 3 or 4 or 5 cryptos suddenly are capable of being managed as Class 1 or 2 cryptos. Or vice versa. Does one contract get de-scoped and another contract amended?

A7: How to handle the change of crypto classification during the contract period of performance will be clarified within the RFP posting.

Q8: Is a detailed list of the individual currencies and units of quantity available to review?

A8: Not at this time.

Q9: Will all assets be commingled into one separate account or will separate accounts be required based on the event that created the seizures and forfeitures?

A9: Assets will need to be separated from assets that are not part of the Government’s portfolio. Industry best practices for holding and separating assets are to be proposed by industry and evaluated/approved by the USMS.

Q10: Is an extension to respond permissible?

A10: Not for the RFI.
