About this file

This is a Questions and Answers document from a Department of Justice (DOJ) solicitation for cafeteria operations services. The document addresses clarifications regarding proposal submission requirements, facility operations, competitive eligibility, and technical system constraints.

Key clarifications include: the cafeteria is currently open and operating; the DOJ owns all onsite equipment; the coffee shop operates independently from the cafeteria; historical catering revenue data cannot be provided. Regarding competitive eligibility, the solicitation was corrected from a small business set-aside to full and open competition. For technical requirements, the use of cloud-based point-of-sale (POS) systems is acceptable provided the application is not hosted on the DOJ network; data transfer through the DOJ network to communicate with cloud-based POS systems poses no restrictions. Administrative corrections were made to the solicitation, including: reducing the Statement of Qualifications submission from three separate PDF files to two; and uploading the Past Performance Questionnaire form to Appendix 1, which was initially missing from the solicitation documents.

Question/Comment

Is the cafeteria currently closed?

Can you provide historical catering revenue or spend?

Does DOJ own all equipment onsite?

Is the coffee shop connected to the cafeteria?

This RFP is marked as a total small-business set-aside (see pdf pg. 30 of Attachment 2, marking FAR 52.219-6). It is possible that this marking was in error, because the cover page says the acquisition is “full and open.”. Do we need to be a small business to provide a proposal?

There are also restrictions on the use of cloud computing, which could implicate the use of a POS system. The POS system is not FedRAMP certified.

All modern POS use cloud computing, is this a non starter?

(b) All Statement of Qualifications shall contain the three separate volumes (and sections) identified in the chart below and be submitted as three (3) separate PDF files, subject to the quantities and page limits as specified below:

The table only showed 2 Volumes below

Offerors shall submit the “Past Performance Questionnaire” (PPQ) form Appendix 1. There is no PPQ questionnaire form available in the Appendix 1 (page 15)

DOJ Response

The Cafeteria is currently open and operating This data cannot be provided Yes, the DOJ owns all on site equipment.

The coffee shop is not connected to the cafeteria.

This was in error, that error has been corrected in the admend solicitation. This is a full and open competition not a small business set aside.

No, it is not a non starter, it would be acceptable to use that POS system. There are no cloud computing restrictions if the app/program is not being hosted/used by the DOJ network. If it is data being transferred through the DOJ network to communicate with the cloud computing using POS system, there is no issue. The use of a POS system that uses cloud computing through the internet is acceptable.

This was in error, it should only be 2 separate PDF files.

The Attachment 5 - Evaluation Criteria has been corrected.

The PPQ has been uploaded to the solicitation, please see the attachment Appendix 1 - Past Performance Questionnaire
