About this file
This is a Questions and Answers document for federal solicitation #15JA0526Q00000017 addressing clarifications on court reporting services for the United States Attorney's Office. The incumbent contractor is Free State Reporting Inc. under contract #15JA05-21-D-00000033. The solicitation involves providing court reporting services for Grand Jury sessions, which occur once monthly on the third Tuesday of each month with dates determinable five years in advance. Contract Line Item Number (CLIN) quantities are estimates based on historical data. Audio recordings must be provided via CD along with reporter's notes including witness names and time stamps, delivered immediately after each session concludes. Keyword indexing is available for either all transcripts or select ones, with quantities specified in the applicable CLINs.
Several requirements clarifications were issued: videotaping capability mentioned in Section 2.3(a) of the Statement of Work will be removed and is not required; exhibit handling and copying will also be removed as exhibit copies are not required; and travel costs (Line Item X010) should be structured separately according to the pricing schedule instructions. Offerors must submit complete pricing with unit prices and total CLIN amounts for each line item, with no asterisks, exceptions, or comments permitted—partial pricing may render proposals non-responsive. A minor typographical error in Section numbering (2.8 followed by 2.10) was confirmed. Past performance evaluation will be based on relevancy of recent efforts accomplished by the offeror. Upon request, unsuccessful quoters will receive a brief explanation of the award decision per FAR Part 12.

Questions & Answers
Solicitation #15JA0526Q00000017
1. We would like to know if this is a brand new contract OR if there is (was) an incumbent performing these services. If not brand new, could you please provide the current / previous contract number?
There is an incumbent. The incumbent contract number is #15JA05-21-D-00000033.
2. On page 9 of 50, Section 2.8 is followed by Section 2.10. Was Section 2.9 intentionally omitted, or is this a typographical error?
Yes, this is a simple typographical error.
3. For Volume 2, Past Performance, is the subcontractor’s past performance sufficient to meet the requirement?
The solicitation states, “The Offeror will be evaluated based on their past performance experience” and “Evaluation will be based on the relevancy of recent efforts accomplished by the Offeror.”
4. Who is the current vendor(s)? What is their contract number? What is their contract value? What are their prices?
See answer to question #1. Incumbent vendor is Free State Reporting Inc. Contract pricing is proprietary and sensitive, and therefore will not be provided.
5. Historically, what has been the average number of pages per witness or per session?
Contract Line Item Number (CLIN) quantities are estimates which are based on historical data. See applicable CLINs (transcription).
6. Historically, what has been the average number of witnesses per session?
Information is not considered pertinent, and therefore will not be provided.
7. Grand Jury sessions "generally occurs once a month on the third Tuesday." How far in advance is the annual calendar known?
It is known in advance that Grand Jury occurs once a month on the third Tuesday of each month. That information can be used to determine dates for the next five years.
8. Historically, how often have the Grand Jury sessions been cancelled.
historical data. See applicable CLINs (cancellation).
9. What percentage of witness testimony is typically requested for transcription versus not transcribed at all?
historical data. See applicable CLINs (transcription).
10. "Immediately after each day's GJ session concludes, the reporter assigned shall provide the day's audio recording and court reporters notes." What format for audio recording is required? (CD, digital file, specific format?)
See Statement of Work, Section 2.2(b)(vii), “GJ Audio Recording & Reporter's Notes:
Immediately after each day’s GJ session concludes, the reporter assigned shall provide the day’s audio recording and court reporters notes prior to departure to a member of the USAO staff. Reporter’s notes shall include witness names and time stamps of testimony, at a minimum. The audio recording shall be provided via CD and the notes shall be provided via hardcopy or USAfx. If hardcopy, a member of the USAO will make a copy of the original and return the original to the reporter. This is a one-time daily fee and does not overlap with the attendance fee.
11. Section 2.3(a) of SOW states: "At the request of the USAO, recording shall also be taken by videotape." However, there is no line item on the pricing schedule. Is this capability required? If so, will it be added to the pricing schedule?
Videotaping will not be requested nor required. This will be removed from the Statement of Work.
12. How should travel (Line items X010) be structured and priced?
See Solicitation Section 7, Addendum to 52.212-1 - Instructions, Conditions and Notices to Offerors (Sept 2023), Volume III Price: “Offerors shall submit a complete price proposal as reflected in Attachment 2 - Pricing Schedule, to be evaluated. Do not include asterisks with exceptions or comments on these pages. Only state the unit price and total CLIN amount for each CLIN item except travel CLINs. Any additions to the pricing page other than the CLIN price in the space provided will not be considered. Quotes providing partial pricing may be considered non-responsive and subsequently, ineligible for award. If a CLIN is no charge, state N/C (instead of stating zero) in Unit Price Column. N/A’s are not acceptable. All CLINs with an estimated quantity must have a unit price or state N/C.”
13. Section 2.4(f) of the SOW states: "Exhibits admitted in evidence...shall be stamped, marked, numbered by the Contractor, and arranged in numerical order...and shall be annexed to the transcript." However, there is no line item for exhibit handling on the pricing schedule. Is this capability required? If so, will it be added to the pricing schedule?
Exhibit copies will not be requested or required. This will be removed from the Statement of Work.
14. What is the typical exhibit volume per session?
See answer to question #13.
15. Is keyword indexing requested for all transcripts or select ones?
Either. See keyword indexing CLIN quantities for estimates.
16. Will you provide a debriefing if we are not selected?
Per FAR part 12, upon request, I will provide a brief explanation of the award decision that explains why the unsuccessful quoter was not selected.
