About this file
This is a Justification and Approval (J&A) document for other than full and open competition submitted by the Federal Bureau of Investigation's Ballistic Research Facility (BRF) under the authority of 41 U.S.C. 3304(a)(1). The procurement seeks to acquire Nightforce Optics riflescopes and mounts, specifically ATACR 1-8x LPVO, ATACR 5-25x, and ATACR 7-35x models with associated mounts. The requirement will be advertised on SAM.gov as a brand name only solicitation, with authorized Nightforce Optics resellers encouraged to submit competitive quotations. The acquisition is structured as a one-time, firm-fixed price award for Fiscal Year 2026, with the anticipated contract dollar value redacted in the document. Prior to award, the Contracting Officer will determine fair and reasonable pricing in accordance with FAR 12.204(a).
The BRF requires these specific optics to support FBI Hostage Rescue Team (HRT), U.S. Marshals Service Special Operations Group (SOG), DEA, Department of Defense, and state and local tactical teams for ballistic performance and precision testing. The justification emphasizes that standardization on Nightforce optics—already operationally fielded by FBI HRT and partner agencies including USSOCOM, EUROPOL, and DoD test facilities—is essential for interoperability and comparability of test results. The technical specifications are highly detailed, requiring a 34mm body tube, first focal plane MRAD reticle with specific hash marks and adjustments, switchable red/green illumination, and capability to maintain zero under recoil from magnum calibers. Market research was conducted through engagements with DoD facilities and partner organizations, which determined that standardized equipment is critical for maintaining investigative integrity and reliability. No other companies have expressed written interest, and the FBI commits to ongoing market research for future acquisitions to identify potential alternative sources and remove barriers to competition.

FEDERAL BUREAU OF INVESTIGATION
FINANCE AND FACILITIES DIVISION | PROCUREMENT
SECTION
Justification and Approval (J&A) for Other than Full and
Open Competition
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (X)
Requisition Number:
Date: 4/1/2026
Estimated Contract Dollar Value:
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Ballistic Research Facility, has prepared this justification for other than full and open competition for Nightforce Optics riflescopes and mounts on behalf of the Ballistic Research Facility, Training Divison.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The proposed action is to acquire Nightforce Optics riflescopes and mounts. This procurement will be advertised on SAM.gov as a brand name only requirement. Authorized resellers of Nightforce Optics products will be encouraged to submit a competitive quotation.
The resultant contract is intended to be awarded as a one-time, firm-fixed price for Fiscal Year (FY) 2026.
3. A description of the supplies or services required to meet the agency’s needs.
The Ballistic Research Facility (BRF) has a need to procure Nightforce Optics riflescopes and mounts to support FBI HRT, USMS SOG, the DEA, DoD, and numerous state/local tactical teams within the US and in allied countries. BRF’s mission is to conduct ballistic performance and precision testing with various types of shoulder-fired weapons to improve and ensure accuracy, consistency, and point-of-impact behavior.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.103-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
BRF requires magnified optics that meet the following technical specifications:
- A 34mm body tube to ensure compatibility with the agency’s existing inventory of scope mounts and rings, and to provide sufficient elevation adjustment for precision shooting at extended ranges, including use with both 0 MOA and 20 MOA mounts.
- A reticle currently in use by USSOCOM, FBI HRT, USMS, SOG, DEA SRT, and EUROPOL partners to maintain consistency across platforms and partner organizations
- Burnished elevation and windage turrets designed to minimize or eliminate adjustment backlash
- Adjustment systems that track true when subjected to repeated box drills and tall-target tests
- A first focal plane (FFP) MRAD reticle
- MRAD-based elevation and windage turrets with .01 MRAD click adjustments
- High-power magnified optics featuring a switchable red/green illuminated reticle
- A reticle design incorporating a .05 MRAD floating center dot and 0.2 MRAD hash marks
- Close-range parallax adjustment capability inside 15m
- The ability to maintain zero and mechanical integrity under recoil generated by magnum calibers such as .375 CheyTac, .338 Norma Magnum, and .338 Lapua Magnum.
As a result of these requirements, BRF is procuring Nightforce Optics ATACR 1-8x LPVO riflescopes, ATACR 5-25x riflescopes, ATACR 7-35x riflescopes, and associated mounts. These optics meet all required performance characteristics and are already in operational use across partner organizations.
Standardizing on these specific riflescopes ensures interoperability of test results between BRF and its partner agencies. This interoperability is critical: without consistent optical systems, test data cannot be reliably compared, validated, or integrated into shared weapons, ammunition, or forensic standards. In precision testing environments, even minor inconsistencies in optical performance can distort and undermine investigative accuracy.
Because these riflescopes are the primary optics used operationally by the FBI’s HRT, it is essential that the agency utilize the same models during testing and evaluation. When BRF conducts examinations or ballistic investigations, using the identical optics employed in the field ensures that results are interpreted accurately and reflect real-world performance. This alignment directly supports investigative integrity, evidentiary reliability, and missional readiness.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.1 and, if not, which exception under 5.101 applies.
This requirement will be posted on SAM.gov as a brand name only, open market requirement.
This announcement will give an opportunity for authorized resellers of Nightforce Optics products to demonstrate their ability to meet the FBI’s specific needs through submission of their quote.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar value of this award is estimated at . Prior to issuing award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 12.204(a).
8. A description of the market research conducted and the results.
Market research was conducted by BRF personnel through engagements with partner facilities, including DoD test facilities at NSWC Crane and Fort Bragg, as well as with US Special Operations Command and various DOJ tactical components such as the FBI’s HRT, USMS SOC, DEA SRT, along with additional partner organizations.
During these meetings, it was determined that it is essential for BRF to utilize the same equipment fielded by DOJ tactical components and partner agencies. Standardizing equipment ensures compatibility and comparability of capabilities, test methodologies, and data collected during evaluations. This alignment is critical for maintaining consistent performance assessments and enabling reliable collaboration across organizations.
9. Any other facts supporting the use of other than full and open competition.
10. A listing of any sources that expressed a written interest in the acquisition.
Since an RFI was not advertised before this RFQ, no other companies have expressed an interest either orally or in writing.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The actions of the BRF to identify potential sources possessing the ability to satisfy this and similar requirements are on-going. The FBI will continue to research the market to obtain as many available sources as possible, to ensure that there are other vendors who may be able to satisfy future requirements. In addition, the program office will ensure that barriers to competition are avoided.
