About this file
This is a Question and Answer document for BOP RFI Solicitation No. 15BRRC26R00000016 for Residential Reentry Center Services and Home Confinement Services located within Raleigh, North Carolina.
The document addresses a single clarification question regarding the Bureau of Prisons' requirements for segregating proprietary or confidential information in RFI responses. The Bureau clarified that respondents do not need to submit proprietary information in a separate attachment or document from the main response. Instead, respondents must clearly mark each page containing proprietary information with an indication that it should be exempt from disclosure under FOIA Exemption 4. This marking approach will assist the Bureau in identifying and protecting proprietary information without requiring physical or document separation within the submission.

Question and Answer
1. BOP RFI, Page 5, Disclaimer: This section states, in part: "If you intend for the information to be exempt from disclosure under FOIA Exemption 4, please indicate this in your response and on each page, you want exempt. Furthermore, indicate that your response is proprietary information that may not be used, reproduced, or disclosed to any other parties for any purpose without expressed written permission…Interested parties are responsible for adequately marking proprietary or competition sensitive information contained in their response. To aid the Bureau, please segregate any proprietary information."
Q. Please clarify the Bureau’s expectation regarding the segregation of proprietary or confidential information within an RFI response. Specifically, does the Bureau prefer that proprietary information be submitted in a separate attachment/document from the main response, or may respondents include proprietary information within the response itself provided that the applicable pages are clearly marked as confidential/proprietary?
A. Segregating any proprietary information is by indicating your response in each page you want exempt from disclosure under FOIA Exemption 4, which will assist the Bureau identifying any proprietary information. For any proprietary information, the response does not need to separate the attachment/document. It must indicate your response on each page that you want it to be exempt from disclosure under FOIA Exemption 4.
