About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for the U.S. Department of Justice Federal Bureau of Prisons. The Bureau seeks to award a sole-source, firm-fixed-price contract to HealthStream for a comprehensive clinical reference, education, and competency assessment software program system for Nursing and Advanced Practice Providers. The contract will have a 12-month base period from September 1, 2025 to August 31, 2026, with two additional 12-month option periods, and a total estimated value not to exceed $571,475.00.

Market research conducted through GSA, NASA SEWP V, and the Small Business Administration confirmed HealthStream as the only contractor authorized to provide the required services. The justification notes that HealthStream's initial contract was awarded in 2022 but experienced stand-up issues, with a phased introduction beginning in March 2025 and expected nationwide functionality by July 2025. The sole-source award is intended to preserve three years of partner experience and avoid disrupting the ongoing development of the clinical assessment platform. The Contracting Officer will publish the Sole Source Justification within 14 days on the Government-wide Point of Entry (GPE) in accordance with Federal Acquisition Regulation requirements.

NATIONAL ACQUISITIONS SECTION

JUSTIFICATION FOR OTHER THAN FULL

AND OPEN COMPETITION

Pursuant to the Federal Acquisition Regulation (FAR) Subparts 13.106-1(b)(2), the U.S Department of Justice (DOJ), Federal Bureau of Prisons (Bureau) has determined there is only one source reasonably available. The following is supporting documentation in accordance with FAR Subpart 6.303-2.

1. Identification of the Agency and the Contracting activity:

U.S. Department of Justice (DOJ) Federal Bureau of Prisons (Bureau) National Acquisitions Section 320 First St. N.W., Room 901-5 Washington, DC 20534

2. Nature and/or Description of Action being approved:

This action will be a firm-fixed price award with a base period plus two-year award to provide a comprehensive medical, mental health, and opioid/other use disorder skills improvement and assessment platform for use by Nursing and Advanced Practice Providers.

3. Description of Supplies/Services required to meet the Agency’s Needs including the estimated value:

The scope of this acquisition is an online clinical reference, education, and competency assessment software program system for assessing, providing, maintaining and monitoring ongoing knowledge, skills, and continuing clinical education of a professional practitioner. It will ensure a high level of expertise, competence, and appropriate ethics in performing the job. An online clinical reference, education, and competency assessment software program is an important component in ensuring that each health care profession is credible, useful, and respected within the health care field, and trusted by the public

The estimated value for the 12-month base period, September 1, 2025- August 31, 2026, and two, 12-month option periods, is not expected to exceed $571,475.00.

4. An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) per FAR 6.302-1(a)(2) - Only one responsible source and no other supplies or services will satisfy agency requirements.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The HealthStream contract was initially awarded in 2022, however, secondary to several stand-up issues, this tool has only reached the point of phased introduction in March 2025. It is expected to be functional nation-wide in July 2025. The current contract with HealthStream ends in August 2025. To procure a new clinical reference, education, and competency assessment software program system through a new vendor would circumvent three years of partner experience and information technology (IT) development to reach the current product launch. All IT issues have now been resolved and the HealthStream vendor has been fully onboarded which will allow them to continue to provide this valuable tool without any loss of service to the Bureau.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies.:

A notice of the Bureau’s intent to issue a sole source award to HealthStream, will be posted to the sam.gov in accordance with FAR Subpart 13.105 (a). The sole source justification will be made available on sam.gov as required by FAR 13.501(a)(1)(iii).

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The contracting officer (CO) examined historical data, commercial catalog pricing, and previously prices of similar purchases of this type, as well as the Independent Government Estimate. Based on the information stated above, the Contracting Officer anticipates the price will be fair and reasonable.

8. A description of the market research conducted and the results or a statement of the reason market research was not conducted.:

Market Research was conducted through GSA FSS and NASA SEWP V contract holders to determine if there were authorized contractors eligible to provide the required services. The search revealed there are no contractors authorized to provide the required services. A search was also conducted through the Small Business Administration Dynamic Search which revealed there are no small business that have been granted reseller authority for the required services. Market Research through GSA, SEWP and the SBA revealed that HealthStream is the only contractor available to fulfill this requirement.

9. Any other facts supporting the justification:

N/A

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition

Healthstream 500 11th Avenue North Suite 1000 Nashville, TN 37203

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:

For the reasons stated previously, no actions are available to the Bureau which could remove competition barriers before subsequent acquisition of the required services. In addition, the Contracting Officer will publish the Sole Source Justification within 14 days on the GPE, in accordance with Federal Acquisition Regulation (FAR) 13.501(a)(1).
