MEMORANDUM FOR ALL CONCERNED

FROM: Patrick Ford, Contract Specialist

SUBJECT: Acceptance of Late Bid 15BFA024B00000015- FCI Herlong- Boiler Re-Tube

The bid opening for the referenced solicitation occurred on June 20, 2024, at 11:00 a.m. The bids were submitted to the established file sharing box on the Justice Enterprise File Sharing (JEFS) system. At 11:00 a.m. the URL for the file sharing box was disabled. The box was then refreshed to ensure bids submitted prior to the deadline were present. At that time, two bids were present from Grainger Contracting and Services, LLC and NBT Construction and Supply LLC. The bid opening was completed via Microsoft Teams with these two bids.

After completion of the bid opening, the JEFS file sharing box was closed and reopened due to connection issues via the Government VPN connection. When JEFS was reopened, it contained documents for a third bid received from R.F. MacDonald Company.

The properties of the file provided the bid was received by the JEFS system on June 20, 2024, at 10:58 a.m.

Per Federal Acquisition Regulation 14.304, acceptable evidence is present to establish the Government had received the bid documents prior to the time set for receipt of bids. Based on these facts, the bid was allowed and is included on the bid abstract and will be considered for the requirement.
