Questions to Solicitation 15BCTS24R00000001

1. Cover Letter, p. 2 & Section 4, 3.1 Instructions To Offerors - Commercial Services, p. 38 of 41— Section 4 requires Offerors to submit a Business Proposal Information Packet to avoid exclusion from consideration. In addition, the Cover Letter requires that a “Completed Business Proposal Information Sheet” be submitted as a separate file attachment in the proposal.

a. Please confirm the Business Proposal Information Packet is the same item as the 6-page Business Proposal Information Sheet.

Response: Yes, these two documents are one in the same. This was a clerical error in reference to the verbiage used.

2. Section 4, 3.1 Instructions To Offerors - Commercial Services, p. 38 of 41—This section states “Electronic copies of proposals shall be submitted via Justice Enterprise File Sharing (JEFS) system by the date and time specified in this solicitation in Adobe Acrobat (PDF) format.”

a. Please confirm if the BOP wants the Technical Proposal Information Packet (also known as the Technical Proposal Information Packet Telehealth MAT Workbook) to be submitted as a PDF only or should offerors submit in its original Excel format as well.

Response: The Technical Proposal Information Packet and the Technical Proposal Information Packet Telehealth MAT Workbook are two separate documents. Please submit the Technical Proposal Information Packet in PDF format and the Technical Proposal Information Packet Telehealth MAT Workbook in Excel format.

3. Cover Letter, p. 2 & Section 4, 3.1 Instructions To Offerors - Commercial Services, p. 38 of 41— The Cover Letter is the only location in the solicitation that notes a copy of the Professional Liability Insurance must be submitted as a separate file attachment. This requirement was not reflected in Section 4, 3.1 Instructions to Offerors.

a. Please confirm the Professional Liability Insurance is to be submitted as a separate file attachment in proposals.

Response: Yes, please submit a copy of your Professional Liability Insurance as a separate attachment.

4. Section 4, 3.1 Instructions To Offerors - Commercial Services, p. 38 of 41 & Business Proposal Information Packet, p. 1—Section 4 requires that a Small Business Subcontracting Plan be submitted as a separate file attachment in the proposal. However, the Business Proposal Information Packet notes that a “Completed FBOP Subcontracting Plan” is required. Likewise, a template for the FBOP Subcontracting Plan was provided in the solicitation.

a. Please confirm the FBOP Subcontracting Plan and the Small Business Subcontracting Plan are the same item.

Response: The Business Proposal Information Packet requires the Offeror to indicate whether a Small Business Subcontracting Plan has been submitted. The Business Proposal Information Packet and the Small Business Subcontracting Plan are two sperate documents that will need to be submitted.

5. Technical Proposal Information Packet, Decision Rule Criteria Matrix, Subfactor (b) Licensure & DEA Registration, p. 5 & SOW 3.4.4, p. 60—The matrix states that, “(v.) The Offeror shall also submit a Drug Enforcement Agency (DEA) Controlled Substance Registration Certificate for key personnel to provide MAT services in the state where services will be rendered” and “(vi.)

Offeror must clearly provide evidence of key personnel’s professional license and accompanying DEA Certificate for each state in which services will be rendered and must correspond to the MAT Requirements by State worksheet.”

a. Per SOW Section 3.4.4, under the exceptions granted by the COVID-19 DEA waiver, a DEA-registered practitioner is not required to obtain additional registration(s) with DEA in the additional state(s) where the practitioner’s prescribing occurs if the practitioner is authorized to prescribe controlled substances by both the state in which the practitioner is registered with DEA and the state in which the prescribing occurs. Please confirm that the COVID-19 DEA waiver is considered applicable for this solicitation through the extension date.

Response: The Bureau is aware of this Second Temporary Rule issued by the DEA, which extended the COVID-19 Telemedicine Flexibilities for Prescription of Controlled Medications through December 31, 2024. The Bureau recognizes that the DEA waivers extended under this rule included DEA registrations in individual states as well as the in-person evaluation requirement and flexibilities in prescribing of buprenorphine. As such, the current DEA rules and regulations will apply for this solicitation. Upon award, the contract shall also follow the DEA rules and regulations that are currently in place now and in the future, given that the DEA has stated they are working to promulgate new standards or safeguards by the fall of 2024. The Bureau has planned for any changes by requesting the Offeror also submit evidence of their ability to provide in-person sessions, if needed or required.
