RFQ 15B50421Q00000005 FPC Bryan Cosmetology Instructor
1. I previously asked if there was an incumbent contractor that was currently providing Cosmetology Vocational Training Instructor services to FPC Bryan. The incumbent's information was provided, but it appears that the last task order (15B50420FVG310006) issued under the incumbent's (Glocums, Inc.) Contract Number DJBP050400000036 was for the performance period of 10/01/2019 to 04/30/2020. Thus, it seems that no actual performance of this contract has occurred since at least 4/30/2020, almost a year ago. This seems to be supported by the fact that per the Texas Department of License and Regulation website, no FMC Carswell student-inmate has taken a cosmetology exam since March 13, 2020.
Answer: FPC Bryan is not active at this time. There is no task number.
Please advise whether the incumbent is currently actually performing and presently teaching a Cosmetology Vocational Training Instructor class?
Answer: No performance. No instructor teaching at this time.
If yes, please provide the task order number under which services are presently being provided. N/A
2. Please advise what affect the COVID pandemic has had on the performance of this contract. For example, per the RFQ, 80% of the cosmetology program consists of live work, so has the incumbent been prohibited from entering the facility to perform the cosmetology instructor services for certain periods of time?
Answer: Yes If yes, please specify the period/s of time when performance was prohibited due to COVID.
Answer: April 2020 to present Has the number of inmates who are permitted to be enrolled in the class been decreased due to COVID?
Answer: NA no classes held at this time.
Has the BOP permitted any aspects of the classroom training, which represents 20% of the cosmetology program, to be taught off-site (remotely)? If yes, please explain how this is done.
Answer: NA no classes held at this time.
3. Please advise what, if any COVID safety protocols have been put in place at FPC Bryan in the work area where the Cosmetology Vocational Training Instructor is to provide services. For example, will the inmates who are enrolled in the class be required to wear masks, must the inmates test negative for COVID prior to enrollment, are the inmates screened for temperature checks and recent signs or symptoms of possible COVID before entering the cosmetology class area, is the class/work area clean and sanitized on a regular basis, and does the class/work area allow for social distancing?
Answer: FPC Bryan is currently following the Center for Disease Control (CDC) Guidelines for COVID-19 and will continue adhering to the guidelines upon award. FPC Bryan intends to make the classroom environment safe for all staff and inmates. All areas of the institution are required to wear a mask. We can provide a thermometer for the instructor to take temperatures upon entering and exiting the cosmetology building. Inmates enrolled in classes will be required to wear masks and follow CDC Guidelines.

4. Which type of background investigation is applicable (High Risk - Background Investigation (5 year scope); Moderate Risk - Limited Background Investigation (LBI) or Minimum Background Investigation (MBI); Low Risk - National Agency Check with Inquiries (NACI) investigation? See RFQ Page 13 of 45. Answer: High Risk
5. Which Questionnaire for Sensitive Positions is applicable (SF-85 for Low Risk or SF-85P for above low risk)? See RFQ Page 9 of 45 Answer: 85P
6. How many weeks or months does it generally take FPC Bryan to complete contractor background investigations?
Answer: Estimated three months
7. It is my understanding that the BOP has specific Guidelines for Acceptability with regard to the contractor credit check. Why won't the Human Resource Department release the guidelines so that the contractor will know what financial qualifications standards must be met in order to pass the background investigation/credit check that is required to access the institution? Can you cite a BOP or DOJ regulation that prohibits the release of this information?
Answer: No. The Human Resource Department will not share that information outside of the department. Refer to the RFQ DOJ clause 52.24.403-70 Notice of Contractor Personnel Security Requirements (OCT 2005) page 13 of 45 and Contract Security Investigative Requirements procedures and forms page 10 of 45.
8. The SOW at page 4 of 45 states that the Contractor's instructors will need to be at the institution at least fifteen (15) minutes prior to the start of their classes in order to be processed for entrance and escorted to the program area. Can the contractor bill the BOP for this processing time?
Answer: Amendment #4 remove verbiage from RFQ
9. The RFQ states that the award will be a non-personal contract, i.e., the service does not constitute an employer/employee relationship and the Contractor will not be subject to Government supervision except for security related matters. However, the SOW at page 4 of 45 states that the Contractor must submit a leave slip for documentation of absence for time & attendance purposes. Why is this required for a non-personal contract when matters regarding absences and time & attendance are the purview of the contractor?
Answer: Amendment #4 remove verbiage from RFQ
10. Amendment 0001 states that photocopies of documents evidencing accreditation must be provided with the quote, but the RFQ does not include language that requires that the Contractor be an accredited school/institution. Please explain what accreditation documents are required.
Answer: Amendment #4 remove verbiage from RFQ
11. Will the BOP issue and pay for the Certificates of Completion referenced on RFQ Page 5 of 45?
Answer: The Texas Department of Licensing and regulation is responsible for licensing the inmates as a cosmetologist in accordance with requirements set by the Texas Advisory Board of Cosmetology. They test the inmates and upon passing the test, they are licensed. FPC Bryan pays for the test and when release from prison, all inmates may request and receive their licensing. Inmate are not allowed to receive licensing, while in prison.
Question #13
The RFQ at Page 5 of 45 includes a section entitled Supplies and Equipment, which states that, "Classroom equipment, books, and other related supplies will be provided by FPC Bryan, Texas. However, the very next sentence states that, "Equipment not provided by the Education Department will be provided by the contractor".
Exactly what equipment, books, and other related supplies will be furnished by the BOP? What equipment does the BOP anticipate that the Contractor will have to furnish?
Answer: Amendment #4 remove verbiage from RFQ
Question #14
Per the RFQ, there may be times when performance is delayed due to inclement weather, electrical or mechanical problems, or other security matters. If the BOP requests that the Contractor remain at the institution for eventual performance, it is clear from the RFQ that the Contractor will be paid for the sessions that actually eventually performed.
However, it is unclear whether the Contractor will be paid for the time the Cosmetology Instructor waits to begin performance.
Please advise if the Contractor may bill the BOP at the hourly session rate for the "wait time" when the Cosmetology Instructor is asked to remain at the institution for eventual performance.
Answer: Yes, the contractor may bill for the wait time.
