On page 7 of 45, remove the following language from Section K - Institution Security: "and random drug screening may be conducted". On page 10 of 45, replace the Schedule of Required Insurance with the following verbiage: "In accordance with FAR 52.212-4(q), the Contractor shall comply with all applicable Federal, State, and local laws for the requirements of maintaining applicable insurance coverage." On page 30 of 45, in the documentation to be submitted with quote section, add item #6. Quoters must specifically identify the individual that will be performing these services under any subsequent contract award. The quoter must provide proof that their candidate meets all qualifications. The candidate’s name and qualifications must be submitted at the time the quote is submitted. All Contractors must submit with their quote a resume, photocopies of documents evidencing accreditation, education, and training. All other terms and conditions shall remain the same.

RFQ 15B50421Q00000005 FPC Bryan Cosmetology Instructor

1. Is there an incumbent contractor that is currently providing Cosmetology Vocational Training Instructor services to FPC Bryan? If yes, please provide the contractor's name, address, DUNs along with the contract number and amount.

Glocums, Inc.

40 E. Chicago Ave. #200 Chicago, IL 60611 Contract Number: DJBP050400000036

DUNS: 192867690

Amount: $275,587.20

2. If there is no incumbent contractor presently performing, when was the last time a contract was awarded for Cosmetology Vocational Training Instructor services to FPC Bryan? Please provide the contractor's name, address, DUNs along with the contract number and amount.

N/A

3. The Statement of Work, Section K. INSTITUTION SECURITY states, "The contractor, as well as all employees of the contractor, must undergo a security clearance process prior to being permitted to enter the institution." Also, Section H of the Statement of Work states that "Quoters must specifically identify the individual that will be performing these services under any subsequent contract award".

What are the BOP's Guidelines for Acceptability with regard to the contractor security background investigation/credit check that is required to allow access into the institution?

The Human Resource Department will not share that information outside of the department. Refer to the RFQ DOJ clause 52.24.403-70 Notice of Contractor Personnel Security Requirements (OCT 2005) page 13 of 45 and Contract Security Investigative Requirements procedures and forms page 10 of 45.

4. The Statement of Work, Section K. INSTITUTION SECURITY states, " The Bureau of Prisons requires all non-employees to sign in and out of the institution for security reasons and random drug screening may be conducted".

The FAR clause § 52.223-6 “Drug Free Workplace” is not included in the RFQ and BOP Program Statement 3735.04, Drug-Free Workplace (June 30, 1997) is not applicable.

Indeed, BOP Program Statement 3735.04 is only applicable to Bureau employees IF such employees are identified as being in Test Designated Positions for which it has been determined that an incumbent's use of illegal drugs would pose a significant threat to national security, public safety, patient care, or fellow employees . Given the above, please explain why terms regarding random drug testing are included in the RFQ.

Amended: The wording “random drug screening may be conducted” is removed.

5. The RFQ includes FAR 52.228-5 entitled “Insurance – Work on a Government Installation,” and requires the Contractor to provide Workers Compensation & Employer’s Liability;

Comprehensive General Liability; and Automobile liability.

None of the above listed insurance is required in the state of Texas where all services will be performed and the RFQ does not require the use of Contractor furnished automobiles in performance of the contract. Please explain why the decision was made to include FAR 52.228-5 along with the above listed insurance.

Amended Schedule of Insurance: In accordance with FAR 52.212-4(q), the Contractor shall comply with all applicable Federal, State, and local laws for the requirements of maintaining applicable insurance coverage.

6. The Statement of Work, Section H states that, “The quoter must provide proof that their candidate meets all qualifications. The candidate’s name and qualifications must be submitted at the time the quote is submitted”.

The RFQ at page 30 of 45 includes a list of the documentation that must be submitted with Quote, and candidate credentials are not included. Why is there a difference between these two sections of the RFQ with regard to documents that must be submitted with the quote?

Amended

On page 30 of 45, add to items to be submitted with quote:
