Schedule of Items Please complete the above information when preparing your quote for the base year and options years. Any resulting contract will be firm-fixed price. As such, quantities listed are estimates only and are not a representation to an quoter or contractor that the estimated quantities will be required or ordered or that conditions affecting requirements will be stable or normal (FAR 16.503(a)(1)). Quotes shall be evaluated for award based on price and price related factors, technical evaluation, and past performance.

All scheduled work shall be performed during the core operating hours of 6:30 A.M. to 3:00 P.M., Monday through Friday excluding federal holidays, unless mutually scheduled in advance with the Facility Manager and/or the COR.
The contractor shall respond to service calls 7 days per week, 24 hours per day as a part of this contract. Services Calls made after the core operating hours shall be considered After Hours Emergency Call-Back Service and shall be billed at the hourly rate specified in the contract. Please see further details in the attached Statement of Work.
NOTE: Award shall be made to the responsive/responsible quoter submitting the lowest TOTAL QUOTED AMOUNT. Rate of remuneration will be based on monthly and annual inspections for each equipment item being serviced. This price will include all overhead, profit, administrative costs, etc., being charged by the Contractor. Terms of the contract will be for a base period of May 1, 2024, award through April 30, 2025, with four 12-month option years for renewal.
Price Methodology Services are required to be provided in accordance with the Statement of Work of this solicitation. Quoters are required to submit a completed copy of the above quote forms as well as any other documents specified in this solicitation. Pursuant to FAR 17.203(b), the Government’s evaluation shall be inclusive of options. Pursuant to FAR 17.203(d), Quoters may submit varying quote prices for options, depending on the quantities ordered and the dates when ordered.
Ordering Official In accordance with FAR 52.216-18, request for services will be made via issuance of individual task orders. Task orders may be issued only by the Contracting Officer, Administrative Contracting Officer, or an ordering official of the institution with an appropriate certificate of appointment or delegation of authority for utilizing the purchase card program.

4 Hydraulic Elevator –
3.1 Statement of Work
1.1 DESCRIPTION OF SERVICES
It is the purpose of this specification that the elevators identified in the contract are properly maintained such that at the end of the contract period it will be substantially in the same condition with respect to performance, cleanliness, safety, wear, and appearance as at the beginning of the contract period. This maintenance agreement shall be for four elevators located at the Metropolitan Detention Center Guaynabo. Three of the elevators are electric traction type and one hydraulic. The awardee will acquire the equipment as they are. These elevators were manufactured and installed by Dover Elevator Services in 1992.
1.2 LOCATION OF SERVICE
The Metropolitan Detention Center (MDC) is a Federal Bureau of Prisons administrative facility located at the corner of Highway 165 and Road 28 in Guaynabo, Puerto Rico. MDC Guaynabo houses prisoners of all security levels in the custody of the Attorney General of the United States. The main structure is approximately 476,000 square feet consisting of twelve housing units, administrative and support facilities.
1.3 HOURS
1.3.1 All scheduled work shall be performed during the core operating hours of 6:30 A.M. to 3:00 P.M., Monday through Friday excluding federal holidays, unless mutually scheduled in advance with the Facility Manager and/or the COR.
1.3.2 The contractor shall respond to service calls 7 days per week, 24 hours per day as a part of this contract. Services Calls made after the core operating hours shall be considered After Hours Emergency Call-Back Service and shall be billed at the hourly rate specified in the contract.
1.4 CONTACT INFORMATION
1.4.1 Contracting Officer (CO) is authorized to take actions on behalf of the government to modify the contract terms, conditions, requirements, specifications, details and/or delivery schedules. However, the CO may delegate, in writing, certain responsibilities to an authorized representative.
1.4.1 Contracting Officer’s Representative (COR). The COR is designated by the Contracting Officer at the time of award to be responsible for the day-to-day administration of the contract.
1.5 STAFFING REQUIREMENTS
1.5.1 LABOR REQUIREMENTS
The contractor is not required to provide a 0n-site elevator mechanic for the specified duty hours. However, the contractor shall provide qualified elevator mechanics, work crews, supervisory personnel in such numbers, places, and times as may be required to fully meet the contract requirements.
1.5.2 CONTRACTOR SECURITY
No later than fifteen (15) calendar days before the contract start date, the contractor shall submit to the COR the following completed documents:

1.5.2.1 These documents shall be provided to the contractor by the government and are required for all individuals who will need access to the secure perimeter of the facility.
1.5.3 CONTRACT MANAGER
The contractor shall provide a Contract Manager (CM). The CM shall work directly with the CO and the COR and shall be responsible for the management of the contract and for scheduling all work. The CM shall be the point of contact for any problems the government encounters when they cannot be resolved at the local level.
1.5.4 CONTACT INFORMATION
The CM shall provide the COR with a list of telephone numbers for all key personnel involved with this contract within 15 calendar days prior to the start of the contract.
1.5.5 QUALIFICATIONS OF CONTRACT EMPLOYEES
1.5.5.1 SUPERVISOR
A supervisor is a person designated in writing by the contractor to make decisions for the contractor on a day-to-day basis. The contractor shall employ competent supervisory personnel. The supervisor shall be always available by telephone while the contract is being performed.
1.5.5.2 ELEVATOR MECHANICS AND HELPERS
Qualifications: The personnel employed by the contractor shall be capable employees, trained and qualified in elevator maintenance and repair work. Elevator maintenance mechanics performing contract work shall have journeyman status as recognized by the industry.
1.5.5.3 LICENCES
The contractor shall be licensed by the proper agencies of the Commonwealth of Puerto Rico and local government agencies as required to perform these services. The contractor shall provide a copy of each employee’s license to the COR.
1.6 SCOPE OF WORK
1.6.1 ACCEPTANCE OF EXISTING EQUIPMENT
1.6.1.1 In accordance with standard elevator industry practice, this is a full maintenance contract. The contractor shall inspect, maintain, repair, replace parts and test all the elevators, chair lifts and elevator equipment listed in Exhibit 1.
2.0 PERFORMANCE

2.1 All elevator operations, tests, inspections, maintenance, alterations, and repairs performed under this contract shall comply with the latest editions of the American Society of Mechanical Engineers (ASME) publication A17.1, “Safety Code for Elevators,” referred to herein as A17.1.
2.2 The contractor shall be responsible for correcting violations of applicable codes (A17.1, NEC, NFPA, BOCA) and complying with requirements of all applicable public agencies having jurisdiction at no additional cost provided that the violation or requirement dose does not necessitate any additions or changes to the present elevator equipment or parts, or its method of operation. Requirements of public agencies shall include, but not limited to, periodic witnessing of, an elevator contractor, performed testing.
2.3 The contractor is responsible for all lighting installed in the hoist way, pit, and car top. The contractor shall furnish and install all lighting components including fixtures, ballast, bulbs, lamps, and tubes.
2.4 The contractor shall be responsible for all factory installed appurtenances mounted in or on the car, i.e., fans, etc.
2.5 The contractor shall make regular and systematic monthly inspections and adjustments to maintain the efficiency, safety, speed, and operating characteristics as originally designed and installed by the manufacturers of the equipment, including acceleration, deceleration, contact speed with or without a full load, floor to floor time, door opening and closing time and leveling accuracy.
2.6 The contractor shall make repairs and replace the operating parts of the elevator system at no additional cost to the Government.
Operating parts shall be considered as those having a cost of $1000 dollars or less in the quantity normally used to repair or replace a specific component, e.g., one coil for a relay; a set of contacts and carbons; or a set of linings to reline one brake unit. Replacement of major parts, e.g., the controllers, drive motors, brakes, machine bearing coils, gears, rewinding of motors, renewal of worm and gear combinations and generators shall be provided to the Government at the lowest price available. For any such parts which are customarily supplied by the contractor, such prices to the Government under this contract shall not exceed the contractor’s current list price less Government discount. The labor and installation of major parts shall be accomplished under the provisions of this contract at no additional cost to the Government.
2.6.1 In the event certain repairs or adjustments are specified in the reports following any of the elevator inspections, such repairs or adjustments shall be accomplished by the contractor under the terms and limits delineated in the preceding paragraph.
2.7 Should it be determined during the servicing of the equipment that replacement of major parts is required, such shall be reported to the CO for approval prior to proceeding with the contemplated work.
2.8 SCHEDULE
2.8.1 PREVENTIVE MAINTENANCE
No later than fifteen (15) calendar days before the contract start date, the contractor shall submit to the COR a schedule indicating the planned schedule of Preventive Maintenance activities.
2.8.1.1 All preventive maintenance scheduled for each month must be completed during that month. Request by the contractor for deviations from the approved schedule must be submitted with appropriate justification to the COR for approval.
2.8.2 TRACTION ELEVATORS
The contractor shall regularly and in accordance with the time intervals in the original manufacturer’s requirements and in ANSI A17.1, systematically examine, clean, lubricate, adjust and when conditions warrant, repair, or replace the following using genuine original manufacturers’ parts or equal:

2.8.2.1 The contractor shall keep guide rails properly lubricated except where roller guides are used.
2.8.2.2 The contractor shall replace guide shoes or rollers when conditions warrant, to provide smooth and quite operation.
2.8.2.3 The contractor shall repair or replace control cables when conditions warrant.
2.8.2.4 The contractor shall re-lamp signals, as required, during the regular examinations.
2.8.2.5 The contractor shall furnish lubricant compound to original manufacturers’ specifications.
2.8.2.6 The contractor shall keep the exterior of the machinery and other parts of the equipment subject to rust, properly painted and presentable always. The motor windings and controller coils are to be periodically treated with proper insulating compound.
2.8.2.7 The contractor shall periodically examine, clean, lubricate, adjust and when conditions warrant repair, or replace the following safety devices:
Interlocks and door closers Buffers Overspeed governors, car, and counterweight safeties Limit, landing and slowdown switches Door protective devices Alarm bells
2.8.2.8 The contractor shall periodically equalize the tension in all hoisting ropes and shall replace all wire ropes and fasteners when conditions warrant.
2.8.2.9 The contractor shall examine and when conditions warrant re-groove or replace all sheaves and sheave assemblies including drive sheaves and governor tension compensating sheaves.
2.8.2.10 The contractor shall periodically examine, lubricate, adjust and when conditions warrant repair, or replace the following accessory equipment:
Car and corridor operating stations Car and corridor hangers and tracks Door operating devices Door gibs Car fan
2.8.2.11 The contractor shall periodically clean elevator hatch equipment, including rails, inductors, hatch door hangers and tracks, relating devices, switches, buffer, and car stops.
2.8.2.12 The contractor shall periodically dismantle brake plunger assembly, examine, replace worn parts, clean, lubricate, reassemble, and adjust as required for proper operation.

2.8.2.13 The contractor assumes no maintenance responsibility for the following items which are not included under this Statement of Work:

2.8.3 HYDRAULIC ELEVATOR
The contractor shall regularly and in accordance with the time intervals in the original manufacturer’s requirements and in ANSI A17.1 systematically examine, clean, lubricate, adjust and when conditions warrant repair or replace the following, using genuine original manufacturer’s parts or equal:

Bearings Windings and coils Rotating elements Contacts and relays Resistors and contactors Packing and seals Drive belts Strainers and mufflers Above ground piping
2.8.3.1 The contractor shall keep guide rails properly lubricated except where roller guides are used.
2.8.3.2 The contractor shall replace guide shoe gibs or rollers when condition warrants to provide smooth and proper operation.
2.8.3.3 The contractor shall furnish lubricants and hydraulic system oil compound to original manufacturer’s specifications.
2.8.3.4 The contractor shall re-lamp signals as required during regular examinations.
2.8.3.5 The contractor shall periodically examine, clean, lubricate, adjust and when conditions warrant repair, or replace the following safety devices:

2.8.4 HOUSEKEEPING
2.8.4.1 The contractor shall maintain all building space assigned to the contractor, and any government-owned equipment the contractor is authorized to use, in a neat, clean, orderly, and working condition always.
2.8.4.2 The contractor shall take all necessary precautions, to safeguard and protect all Government property with which the contractor comes in contact while performing the contract work.
2.8.4.3 All machine rooms, hoist ways, pits, elevator equipment, and landing sill grooves shall be kept free of dust, dirt, grease, oil, and foreign debris.
2.8.4.4 The contractor shall keep Material Safety Data Sheets (MSDS) on file with the COR.
2.8.4.5 The contractor will use reasonable care to minimize the generation of waste and will properly dispose of all waste that is generated.
2.9 REPAIRS
“Repairs” are defined as the process of rehabilitation or replacement of parts that are basically the same as the original for the purpose of ensuring performance in accordance with applicable A17.1 requirements.
2.8.4.1 The contractor shall complete all repairs within twenty-four (24) hours after discovering the problem or of receiving notification that corrective action is required. If the contractor cannot complete the repairs within twenty-four (24) hour period, the contractor shall present within in one working day, a written plan for completing the work to the COR.
2.8.4.2 The CO shall, whenever necessary, decide whether a repair is within the scope of this contract. The contractor may dispute the Contracting Officer’s decision and file a claim, under the “Disputes Clause” of this contract. However, pending a resolution, the contractor shall perform the work.
2.8.5 NORMALL SERVICE CALL
A “Normal Service Call” is a report of malfunction made by the government and the contractor’s subsequent response to, and correction of.
2.8.5.1 Whenever a “Normal Service Call” is received (6:30 A.M - 3:00 P.M.), the contractor shall respond within two (2) hours. Within 15 minutes of receiving a Normal Service Call from the Government, the contractor shall call back and provide an estimated time of arrival.

2.8.6 EMERGENCY SERVICE CALLS
“Emergency Service Call” is a report of malfunction made by the government and the contractor’s subsequent response to, and correction of.
2.8.6.1 Whenever an “Emergency Service Call” is received outside of the core working hours of (6:30 A.M - 3:00 P.M.), the contractor shall respond within two (2) hours. Within 15 minutes of receiving an Emergency Service Call from the Government, the contractor shall call back and provide an estimated time of arrival.
2.8.6.2 ELEVATOR ENTRAPMENTS
The contractor shall use the procedures contained in the ASME A17.4, Guide for Emergency Evacuation of Passengers from Elevators in all such instances.
2.10 TEST REQUIREMENTS
The contractor shall test all safety devices, governors and other related equipment at regular intervals as required by Rule 1002.1 through 1002.3F and 1005.1 through 1005.4 inclusive of the latest editions of the Safety Code for Elevators and Escalators, ANSI 17.1. Any defect noted shall be corrected as soon as practicable. If inspection reveals unsafe operational conditions, the elevator will be locked out of service.
2.11 SPARE PARTS
The contractor must be able to provide spare parts for repair of each type of equipment. Materials and parts to be used must be original manufacturer’s renewal parts or equal. A list of attainable replacement parts, by part number shall be furnished if requested by the Bureau of Prisons prior to the awarding of the contract. The contractor shall maintain an up-to-date inventory of commonly replaced spare parts by part number.
2.11.1 The following replacement parts are to be stocked at each job site or be available in a service van or truck for each type of elevator covered by these specifications:
Coils; minimum of one for each type of relay.
Contacts minimum of three of each type used.
Motor brushes minimum of three sets of each type used.
Supply of lubricants and hydraulic oil for each requirement.
Supply of fuses.
Interlock rollers and contacts; minimum of three of each type used.
Car and hoistway door hanger rollers minimum of three sets of each type 0 used.
Car and hoistway door gibs; minimum of three sets of each type used.
Car and hoistway door closer parts (springs, sprirators, etc.) minimum of three sets.
Door operator belts, chains and brushes, minimum of three sets for each type used.
Door operator drive blocks, clutch rollers and fingers, minimum of three sets for each type used.
Photo electric tubes, minimum of one set for each type used.
Landing switch equipment and magnetic inductors, minimum of three sets for each type used.
Solid state timers and printed circuit regulators boards, minimum of three sets for each type used.
Safety edge pivot arm assembly and switch, minimum of three sets for each type used.
Signal fixture lamps, minimum of five sets for each type used.
Selector cams and contacts assemblies, minimum of three sets of each type used.
Brake contact, minimum of two sets of each type used.
Normal renewal parts peculiar to equipment covered by this specification.
2.11.2 The following parts will be available within two hours:
Supply of selector tapes to handle highest rise.

2.11.3 The following replacement parts will be available within 24 hours:
Rotating electrical elements of each type and size used.
Stator of each type and size used.
Break coils of each type and size used.
AC/DC motors of each type and size used.
Line contactors of each type and size used.
2.12 RECORDS
The contractor shall maintain a complete, orderly, and chronological file including drawings, parts list, specifications, and copies of all reports as required by these specifications. A record of all call backs and repairs shall be kept by the contractor indicating any difficulty experienced and the corrective measures taken to eliminate these difficulties. This file shall be available for inspection, and a copy shall be forwarded to the Bureau of Prisons immediately upon request.
3.0 CONDITIONS OF SERVICE
3.1 The Bureau of Prisons will provide the contractor with full access to the equipment to render service thereon.
3.2 The contractor has the responsibility to make those replacements, adjustments, and repairs required under this specification which are necessary due to ordinary wear and tear. The contractor is not responsible for repairs caused by accidents, vandalism, or negligence.
3.3 When new or additional tests are required and when new devices or equipment become mandatory, the contractor will be directed by the Bureau of Prisons to perform the tests or install the equipment at a price to be negotiated between the Bureau of Prisons and the contractor.
3.4 INSPECTIONS
The Government may, from time to time make reasonable inspections of the services to be performed under this contract. The contractor without additional charges shall provide all reasonable equipment and assistance for the safety and convenience of the Government Inspectors in the performance of their duties. Any inspection by the Government does not relieve the contractor from any responsibility regarding defects or other failures to meet the contract requirements. Defective work shall be satisfactorily corrected without delay.
3.5 CONTRACTING RESPONSABILITY
The contractor shall be responsible for any damage to the Government buildings or private property while rendering the services. At no time shall the service operations interfere with the operations of the Bureau of Prisons. All service operations will be coordinated with the Bureau of Prisons representative.
3.6 SAFETY REGULATIONS
The contractor shall comply with all safety regulations as set forth by OSHA and BOP 4200.9, copies of which may be obtained through normal distribution channels.

DOJ-02 Contractor Privacy Requirements (JAN 2022)
A. Limiting Access to Privacy Act and Other Sensitive Information
(1) Privacy Act Information
In accordance with FAR 52.224-1 Privacy Act Notification (APR 1984) and FAR 52.224-2 Privacy Act (APR 1984), if this contract requires Contractor personnel to have access to information protected by the Privacy Act of 1974, the contractor is advised that the relevant DOJ system of records notices (SORNs) applicable to this Privacy Act information may be found at https://www.justice.gov/opcl/doj-systems-records.[1] Applicable SORNs published by other agencies may be accessed through those agencies’ websites or by searching the Federal Digital System (FDsys) available at http://www.gpo.gov/fdsys/. SORNs may be updated at any time.
(2) Prohibition on Performing Work Outside a Government Facility/Network/Equipment
Except where use of Contractor networks, IT, other equipment, or Workplace as a Service (WaaS) is specifically authorized within this contract, the Contractor shall perform all tasks on authorized Government networks, using Government-furnished IT and other equipment and/or WaaS and Government information shall remain within the confines of authorized Government networks at all times. Any handling of Government information on Contractor networks or IT must be approved by the Senior Component Official for Privacy of the component entering into this contract. Except where remote work is specifically authorized within this contract, the Contractor shall perform all tasks described in this document at authorized Government facilities; the Contractor is prohibited from performing
15B30624Q00000010 Page 18 of 46 these tasks at or removing Government-furnished information to any other facility; and Government information shall remain within the confines of authorized Government facilities at all times. Contractors may only access classified materials on government furnished equipment in authorized government owned facilities regardless of remote work authorizations.
(3) Prior Approval Required to Hire Subcontractors
The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (Subcontractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under or relating to this contract. The Contractor (and any Subcontractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.
(4) Separation Checklist for Contractor Employees
The Contractor shall complete and submit an appropriate separation checklist to the Contracting Officer before any employee or Subcontractor employee terminates working on the contract. The Contractor must submit the separation checklist on or before the last day of employment or work on the contract. The separation checklist must verify: (1) return of any Government-furnished equipment; (2) return or proper disposition of personally identifiable information (PII)[2], in paper or electronic form, in the custody of the employee or Subcontractor employee including the sanitization of data on any computer systems or media as appropriate; and (3) termination of any technological access to the Contractor’s facilities or systems that would permit the terminated employee’s access to PII or other sensitive information.
In the event of adverse job actions resulting in the dismissal of a Contractor or Subcontractor employee before the separation checklist can be completed, the Prime Contractor must notify the Contracting Officer within 24 hours and confirm receipt of the notification. In the case the Contractor is unable to notify the Contracting Officer, then the Contractor should notify the Contract Officer’s Representative (COR).
Contractors must complete the separation checklist with the Contracting Officer or COR by returning all Government-furnished property including, but not limited to, computer equipment, media, credentials and passports, smart cards, mobile devices, Personal Identity Verification (PIV) cards, calling cards, and keys and terminating access to all user accounts and systems. Unless the Contracting Officer requests otherwise, the relevant Program Manager or other Key Personnel designated by the Contracting Officer or COR may facilitate the return of equipment.
B. Privacy Training, Safeguarding, and Remediation
(1) Required Security and Privacy Training for Contractors
The Contractor must ensure that all employees take appropriate privacy training, including Subcontractors who have access to PII as well as the creation, use, dissemination and/or destruction of PII at the outset of the employee’s work on the contract and every year thereafter. Training must include procedures on how to properly handle PII, including heightened security requirements for the transporting or transmission of sensitive PII, and reporting requirements for a suspected breach or loss of PII. These courses, along with more information about DOJ security and training requirements for Contractors, are available at https://www.justice.gov/jmd/learndoj.
The Federal Information Security Modernization Act of 2014 (FISMA) requires all individuals accessing DOJ information to complete training on records management, cybersecurity awareness, and information system privacy awareness. Contractor employees are required to sign the “Privacy Rules of Behavior,” acknowledging and agreeing to abide by privacy law, policy, and certain privacy safeguards, prior to accessing DOJ information. These Rules of Behavior are made available to all new users of DOJ’s computer network and to trainees at the conclusion of DOJ-OPCL-CS-0005.
The Contractor should maintain copies of certificates as a record of compliance and must submit an email notification annually to the COR verifying that all employees working under this contract have completed the required privacy and cybersecurity training.
(2) Safeguarding PII Requirements
Contractor employees must comply with DOJ Order 0904 and other guidance published to the publicly-available Office of Privacy and Civil Liberties (OPCL) Resources page[3] relating to the safeguarding of PII, including the use
15B30624Q00000010 Page 19 of 46 of additional controls to safeguard sensitive PII (e.g., the encryption of sensitive PII). This requirement flows down from the Prime Contractor to all Subcontractors and lower tiered subcontracts.
(3) Non-Disclosure Agreement Requirement
Prior to commencing work, all Contractor personnel that may have access to PII or other sensitive information shall be required to sign a Non-Disclosure Agreement (NDA) and the DOJ IT Rules of Behavior. The Non-Disclosure Agreement:
(a) prohibits the Contractor from retaining or divulging any PII or other sensitive information, or derivatives therefrom, furnished by the Government or to which they may otherwise come in contact as a result of their performance of work under the contract/task order that is otherwise not publicly available, whether or not such information has been reduced to writing; and
(b) requires the Contractor to report any loss of control, compromise, unauthorized disclosure, or unauthorized acquisition of PII or other sensitive information to the component-level or headquarters Security Operations Center within one (1) hour of discovery.
The Contractor should maintain signed copies of the NDA for all employees as a record of compliance. The Contractor should also provide copies of each employee’s signed NDA to the Contracting Officer before the employee may commence work under the contract/task order.
(4) Prohibition on Use of PII in Vendor Billing and Administrative Records
The Contractor’s invoicing, billing, and other financial or administrative records or databases is not authorized to regularly store or include any sensitive PII or other confidential government information that is created, obtained, or provided during the performance of the contract without the written permission of the Senior Component Official for Privacy (SCOP). It is acceptable to list the names, titles and contact information for the Contracting Officer, COR, or other personnel associated with the administration of the contract in the invoices as needed.
(5) Reporting Actual or Suspected Data Breach
Contractors must report any actual or suspected breach of PII within one hour of discovery.[4] A “breach” is an incident or occurrence that involves the loss of control, compromise, unauthorized disclosure, unauthorized acquisition, or any similar occurrence where: (1) a person other than an authorized user accesses or potentially accesses PII or (2) an authorized user accesses or potentially accesses PII for an other than authorized purpose.
The report of a breach must be made to DOJ. The Contractor must cooperate with DOJ’s inquiry into the incident and efforts to minimize risks to DOJ or individuals, including remediating any harm to potential victims.
(a) The Contractor must develop and maintain an internal process by which its employees and Subcontractors are trained to identify and report the breach, consistent with DOJ Instruction 0900.00.01[5], Reporting and Response Procedures for a Breach of Personally Identifiable Information.
(b) The Contractor must report any such breach by its employees or Subcontractors to the DOJ Security Operations Center (dojcert@usdoj.gov, 202-357-7000); Component-level Security Operations Center and Component-level Management Team, where appropriate; the COR; and the Contracting Officer within one (1) hour of the initial discovery.
(c) The Contractor must provide a written report to the DOJ Security Operations Center (dojcert@usdoj.gov, 202-357-7000) within 24 hours of discovery of the breach by its employees or Subcontractors. The report must contain the following information:
(i) Narrative or detailed description of the events surrounding the suspected loss or compromise of information.[6] Date, time, and location of the incident.
(ii) Amount, type, and sensitivity of information that may have been lost or compromised, accessed without authorization, etc.
(iii) Contractor’s assessment of the likelihood that the information was compromised or lost and the reasons behind the assessment.[7]
(iv) Names and classification of person(s) involved, including victim, Contractor employee/Subcontractor and any witnesses.

(v) Cause of the incident and whether the company’s security plan was followed and, if not, which specific provisions were not followed.[8]
(vi) Actions that have been or will be taken to minimize damage and/or mitigate further compromise.
(vii) Recommendations to prevent similar situations in the future, including whether the security plan needs to be modified in any way and whether additional training may be required.
(d) The Contractor shall provide full access and cooperation for all activities determined by the Government to be required to ensure an effective incident response, including providing all requested images, log files, and event information to facilitate rapid resolution of sensitive information incidents.
(e) At the Government’s discretion, Contractor employees or Subcontractor employees may be identified as no longer eligible to access PII or to work on that contract based on their actions related to the loss or compromise of PII.
(6) Victim Remediation
At DOJ’s request, the Contractor is responsible for notifying victims and providing victim remediation services in the event of a breach of PII held by the Contractor, its agents, or its Subcontractors, under this contract.
