SUBJECT: Pre-Solicitation 2nd Quarter Food Service

The Federal Bureau of Prisons, United States Penitentiary Big Sandy located in Inez, Kentucky, is issuing this pre-solicitation notice for the requirements of: 15B11823Q00000001 QUARTERLY SUBSISTENCE (GENERAL

ITEMS).

Solicitation Date: November 28, 2022, to December 12, 2022, at 4:00 p.m. site local time Anticipated Award Date: December 13, 2022, through December 16, 2022 Government Point of Entry: https://sam.gov/ Set-Aside: 100% Small Business Primary NAICS: 311999 Delivery location: United States Penitentiary Big Sandy, 1197 Airport Road, Inez, KY 41224 Best Value Determination: Evaluation of Price, Technically Acceptable, and Past Performance Site Point of Contact email: BSY-Contracting-S@bop.gov

Deliveries will begin when the Contracting Officer issues a signed Award Document to the Vendor. The Government reserves the right to make single or multiple awards based on Best Value. The Government will award to the responsible quoter(s) whose quote, conforming to the solicitation, is most advantageous to the Government based on Best Value. Awards will be issued with a Purchase Card or through a Purchase Order, SF-1449.

All future information about this solicitation, including solicitation amendments and awards, will be distributed through the Government Point of Entry above. Interested parties are responsible for monitoring this site to ensure they have the most up-to-date information about this solicitation. Refer to the posted solicitation for due date regarding receipt of quotes (page #1, block #8). Offers must be sent electronically to the above mentioned contact on or before the due date specified within the solicitation. The only format in which questions will be answered is by e-mail (no phone calls please). Faith Based and Community Based Organizations have the right to submit quotes equally with other organizations for contracts for which they are eligible.

While we acknowledge COVID-19 is affecting us all and how we conduct business, it must be pointed out the serious nature of delays in our receiving food shipments. Simply put, a lack of food can lead to riots in the prison setting.

Short delays happen, that's why Federal Acquisition Clause 52.212-4 is incorporated into every award.

52.212-4(f) defines acceptable delays, but more importantly in our case, it states that the Contractor is responsible for notification of delays and follow up on those delays. We shouldn't have to reach out and ask where a shipment is, the vendor should be notifying us "setting forth the full particulars in connection therewith."

Every Pre-solicitation, and Solicitation that we post has a letter that explicitly lists our evaluating factors as Price, Technically Acceptable, and Past Performance.
