About this file

This is an amendment and Questions and Answers document for RFQ 15B10126Q00000012 concerning the painting of two water storage tanks.

The project involves painting a 400,000-gallon ground tank (46'6" diameter, 32' tall) and a 100,000-gallon elevated tank (199' tall, diameter not yet specified). Both tanks were constructed in 2005. Bidders must assume negative results for lead and chromium testing that will occur prior to work commencement; a change order may be issued if testing reveals contamination. The work scope is painting only with no anticipated repairs. The ground tank can remain out of service for unlimited duration, while the elevated tank cannot exceed 72 hours of downtime. Liquidated damages are set at $902.15 per day, though they will only be applied in specific circumstances where timely performance is critical and will not be assessed immediately following a missed deadline. Water access is available at the 400,000-gallon tank but not at the elevated tank. No antennas are present on either tank. Notice to Proceed issuance is contingent upon receipt of all required bonds per FAR 28.103-1(b). This amendment does not extend the solicitation closing date or provide proposal extensions.

Text version

This amendment is being posted as a Notice to RFQ 15B10126Q00000012. The RFQ is re-attached and answers to a Request for Information is below. The Amendment of this RFQ does not delay the closing time of the solicitation nor grant any extensions for proposals.

1.It is stated that the contractor is to perform lead/chromium testing prior to beginning work. Since testing will not be done until the start of work, please confirm that we are to bid both tanks as if they do NOT contain lead and a change order will be issued if lead/chromium are found.

YES - CONFIRM BIDS ARE TO EXPECT NEGATIVE RESULTS AND A CHANGE ORDER MAY BE

ISSUED IF TESTS REVEAL OTHERWISE. BIDS WITH POSITIVE RESULT EXPECTATIONS WILL

NOT BE GIVEN PREFERENCE.

2.What month/date will the notice to proceed be issued and work on the project begin?

Per FAR 28.103-1(b), we must received all bonds before a Notice to Proceed will be issued. This NTP is dependent upon those circumstances.

3.How many days can the tanks be out of service? Is there a date that they need to be back in service by?

in regards to the ground tank, we will be able to bypass for as much time as needed. When it comes to the elevated tank it can't be down more than 72 hours.

4.Is there an amount for liquidated damages or retainage for this project?

We do anticipate Liquidated Damages for this project in the amount of $902.15/day;

however, under the Revolutionary FAR Overhaul, Liquidated Damages are not intended to be punitive in nature or used as a negative performance measure (see FAR 11.401(b)). In practice, LDs are only applied in very specific circumstances where timely performance is critical and where actual damages would be diƯicult to determine. Additionally, we take all reasonable steps to mitigate any potential damages, and they are not assessed immediately following a missed deadline.

5.Confirm that we are only painting the tank and that there are no repairs being done.

There are no anticipated repairs to the tank(s).

6.What years were the tanks built?

The tanks were built in 2005.

7.What is the diameter and height of both tanks?

The 400,000 gallon tank - the diameter is 46'6" and it is 32' tall. The 100,000 gallon tank - it is 199 feet tall and we do not have a diameter at this time.

8.Please confirm that there is access to water at both sites.

There is access to water at the 400,000 gallon tank but not the elevated 100,000 gallon tank.

9.Please confirm that there are no antennas on the tanks.

There are no antennas on the tanks.
