About this file

This document is a Prevailing Wage Rate Instructions guide issued by Harris County, Texas for the 2025 Road and Bridge construction projects. The guide establishes wage compliance requirements for general contractors and subcontractors working on Harris County projects, including the Channel Erosion Repairs at Little Cypress Creek Watershed for Harris County Flood Control District. Certified payroll submissions must be submitted weekly using Harris County DEEO's Labor Compliance Software, with general contractors responsible for ensuring subcontractor compliance. The Harris County Prevailing Wage Rate poster must be displayed at all job sites throughout the construction period, and Contract Compliance Officers retain the right to conduct unannounced site visits and worker interviews to verify wage rate compliance. Workers performing licensed trades must carry and produce their licenses upon request, and unlicensed workers performing licensed work must be paid journeyman rates. Apprentices may be used only if they are certified through the Bureau of Apprenticeship and Training, U.S. Department of Labor, with proper journeyman-to-apprentice ratios maintained.

Under Texas Government Code Chapter 2258, contractors face penalties of sixty dollars per worker per calendar day or portion thereof for any underpayment of prevailing wages. Contractors and subcontractors must maintain accurate payroll records showing worker names and actual daily wages paid. General contractors must make cancelled checks and check stubs available for comparison upon request by the Contract Compliance Officer. Harris County reserves the right to withhold contractor payments until any wage discrepancies are resolved and proper adjustments are made. Apprentice certification certificates must be submitted with the first weekly payroll in which an apprentice appears; failure to provide certification requires the worker to be paid journeyman wages.

PREVAILING WAGE RATE INSTRUCTIONS

PAYROLL SUBMITTAL INFORMATION

1. One copy of a Certified Payroll of the General Contractor and Subcontractor are to be submitted using Harris

County DEEO’s Labor Compliance Software. The General Contractor is responsible for Sub-Contractor payroll submittals.

2. All Certified Payrolls are to be submitted weekly.

3. If there is a week that no work was performed, a certified payroll must be submitted showing “NO WORK

PERFORMED”.

4. The General Contractor and/or Sub-Contractor are to make available copies of cancelled checks and check stubs for comparisons if requested by the Contract Compliance Officer.

WAGE RATE COMPLIANCE

The Harris County Prevailing Wage Rate poster must be displayed in a location that all workers have access and remain in place until the project is complete.

Harris County reserves the right for the Contract Compliance Officer to visit the job site and to interview the General

Contractor and Sub-Contractor employees on any given date or time during the construction period without prior notification.

The Contract Compliance Officer will ascertain that the proper wage rates are being paid to the employees in accordance with the contract documents. The General Contractor shall not allow work requiring a license to be performed by a worker who does not have the proper license. The General Contractor shall require, and shall require its subcontractors to require, that workers carry their licenses upon their persons while performing work on the Project and that such persons produce their licenses to the Contract Compliance Officer upon request. After being requested to produce a license, a worker is not to be allowed to perform further work requiring a license until the required license is produced. Should work requiring a license be performed by an unlicensed person despite the prohibitions of this paragraph, that person must be paid the prevailing wage rate applicable for a licensed craftsman performing such work.

Harris County will not recognize a worker that holds a journeyman’s license in a trade as eligible for pay at an apprentice rate for work in that trade.

In the event of discrepancy between the services performed and the wages paid, it will be documented, and the General

Contractor will be so notified.

Harris County reserves the right to withhold any payment due the General Contractor until such discrepancy is resolved and the necessary adjustment is made.

Apprentices may be used in any of the crafts listed where noted, if they are currently certified in a program recognized by the Bureau of Apprenticeship and Training, U.S. Department of Labor, providing the proper ratio between journeyman and apprentice is observed. Apprentice certification certificates must be supplied with the first weekly payroll upon which the apprentice’s name appears. If they are not certified as an apprentice, they must be paid as a journeyman and used as an apprentice.

TEXAS GOVERNMENT CODE CHAPTER 2258

The Contractor shall forfeit as a penalty to the County on whose behalf this contract is made, Sixty Dollars, ($60.00) for each worker, employed for each calendar day, or portion thereof, such worker is paid less than the said stipulated rates for any work done under this contract, by him or by any sub-contractor under him.
