About this file
This is a Determination to Solicit from a Single Source document for the U.S. Department of the Interior's Bureau of Reclamation. The Bureau seeks peer review services from Evapotranspiration Plus for a Revised Klamath River Natural Flow Study, with a total estimated procurement value of $55,000.00. The specific requirements include hiring a professional with a doctoral degree in water resources engineering, expertise in METRIC and ET-Demands modeling, and prior experience working in the Klamath River Basin.
Market research determined that Dr. Rick Allen is the only vendor capable of providing the required peer review services. The study is classified as a Highly Influential Scientific Assessment (HISA) requiring an external, independent reviewer with no conflicts of interest. Making the procurement publicly known would potentially delay the project by at least one year and require additional resources to re-confirm stakeholder approvals. The Contracting Officer will conduct standard price analysis techniques to ensure the quoted price is fair and reasonable, with market research performed across multiple federal procurement platforms.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity.
U.S. Department of the Interior, Bureau of Reclamation.
2. Name and Address of Single Source.
Evapotranspiration Plus 3496 N 2500 E Twin Falls, Idaho 83301-0244
3. Description of Supplies/Services and Estimated Cost.
Reclamation’s Technical Service Center is requesting services to review an evapotranspiration modeling and analysis of the Klamath River Basin in support of the Revised Klamath River Natural Flow Study. This Study will leverage current science, methods, and tools to develop new naturalized streamflow estimates for certain locations in the Klamath River basin.
The estimated total value of this procurement is $55,000.00
4. Description of Circumstances, including why only one source is reasonably available.
The provider must:
- Hold a Doctor of Science of Philosophy degree in water resources engineer or in civil engineering with a focus in water resources.
- Have known expertise with METRIC and the ET-Demands model through 2+ recent publications.
- Work on previous projects within the Klamath River Basin and has an understanding the local hydrology, geology, consumptive use, and water operations.
IAW FAR 13.106-1(b)(1), Market research showed that Dr. Rick Allen of Evapotranspiration Plus is the only vendor that can provide the Bureau of Reclamation with the peer review of their Klamath River Natural Flow Study.
The above criteria were identified during the scoping phase of the Klamath Natural Flow Study. During this time, external peer reviewers were identified. These individuals’

(11/2020) credentials and affiliation were reviewed and approved by local stakeholders. Making this request for proposals public would have significant impacts to the study, resulting in a schedule delay of at least one year and additional resources to gain confirmation from local stakeholders. Furthermore, this study has been identified as a Highly Influential Scientific Assessment (HISA), which require external peer review. External reviewers must be independent of the study and hold no conflict of interest with the published results. Based on the criteria listed above, the proposed contractor is the only individual who can perform the required work requested.
5. Determination of Fair and Reasonable Price.
The Contracting Officer will perform necessary price analysis techniques such as a comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13 .106-3 (a)(2)(ii)), market analysis for similar items in the industry (FAR 13.106- 3(a)(2)(i)), and other determinations listed in FAR 13.106-3(2) if the information is available to determine if the quoted price is fair and reasonable.
6. Description of Market Research.
Market research was performed by searching for vendor information on GSA Advantage, UNICOR, AbilityOne, SAM.gov, the Federal Procurement Data System (FPDS), and SBA’s Dynamic Small Business Search (DSBS). It has been determined through these searches that Dr. Rick Allen is the only vendor who can provide Reclamation with the required peer review services of the Klamath River Revised natural Flow Study.
