About this file

This document is a Questions and Answers amendment to Solicitation 140R6026Q0144, addressing contractor inquiries regarding riprap stone delivery and acceptance requirements.

The amendment clarifies four key areas: (1) Material acceptance procedures require final visual inspection at the delivery location with certified independent lab results submitted three days prior to delivery; no specific tolerance is defined against Table 1, and material must be well-graded and conform to general requirements; unacceptable material will be rejected per FAR 46.407 with opportunity for correction or replacement; (2) ASTM D6473 is accepted as an alternative to ASTM C127 for bulk specific gravity testing, maintaining the 2.65 minimum acceptance threshold; (3) Delivery routes are along Dawson County Road 303 with maintenance and snow removal performed by Dawson County, while the supplier is responsible for maintaining the haul route on Government property from County Road 303 to the stockpile site and repairing any contract-related damage; delivery hours are flexible and can be adjusted for weather and road conditions; (4) No bid guarantee, performance bond, or payment bond is required for this supply contract per FAR 28.101-1.

Solicitation 140R6026Q0144 Amendment No. 0001

QUESTION 1: Acceptance of delivered material - SOW paragraph 1.04.B.6 states that the acceptability of the stones will be determined by Reclamation as delivery is made. Paragraph

1.04.B.5 states that the listed gradations for use as general guidelines. Material for this project will be hauled approximately 290 miles to the stockpile site. Please clarify:

a. The sampling and testing frequency Reclamation will use to determine acceptability at the stockpile.

b. The allowable tolerance against Table 1, given that the gradations are described as general guidelines.

c. The disposition of, and responsibility for, any load determined to be unacceptable after arrival at the stockpile.

ANSWER:

a. Final acceptance will take place at the delivery location, and this acceptance will be visual.

Please submit certified independent lab results for approval three days prior to delivery, as specified in SOW/Specifications Section 1.03A.

b. No allowable tolerance is identified in Table 1. The riprap must be well-graded and conform to the general requirements outlined in Table 1. Please submit the actual gradation of the product, certified by the independent lab, for approval three days prior to delivery in accordance with

SOW/Specifications Section 1.03A.

c. Material arriving at the stockpile that does not conform with the certified test results submitted and approved under SOW/Specification Section 1.03A will be rejected by the

Contracting Officer (CO). FAR 46.407 – Nonconforming Supplies or Services, will apply, including:

1. Opportunity for correction or replacement, and 2. Conditional acceptance with adjustment if permitted by the CO.

QUESTION 2: Bulk specific gravity test method - SOW paragraph 1.03.A.2 requires bulk specific gravity determined in accordance with ASTM C127, as modified. Will Reclamation accept results determined under ASTM D6473, Standard Test Method for Specific Gravity and

Absorption of Rock for Erosion Control? D6473 is written specifically for erosion-control stone, reports bulk saturated surface-dry specific gravity and absorption, and uses sample and particle sizes consistent with the modifications stated in 1.03.A.2. The acceptance threshold of 2.65 minimum would be unchanged.

ASTM D6473 is an acceptable alternative to ASTM C127 for this contract.

Solicitation 140R6026Q0144 Amendment No. 0001

QUESTION 3: Delivery route maintenance and delivery hours – the SOW requires the vendor to dress the stockpiles and the delivery route as needed if impassable conditions develop, with no separate pay item. Please clarify:

a. The extent of the delivery route the vendor is responsible for, by mileage and limits.

b. The standard by which conditions will be considered impassable.

c. Whether Reclamation, the county, or another party performs any winter maintenance on that route.

d. The delivery hours that will apply, which the solicitation currently lists as TBD.

The means and methods of delivery are not defined; the supplier will determine the hauling vehicles’ capacity and ensure compliance with hauling restrictions and regulations. Delivery routes are along Dawson County Road 303. Maintenance and snow removal are the responsibility of Dawson County; for seasonal or load restrictions, please contact Dawson

County directly.

Delivery hours are not specified and can be adjusted to accommodate weather and road conditions (for example, hauling at night when roads are frozen and not muddy). The haul route on Government property must be returned to its original condition after deliveries. No

Government maintenance is provided from County Road 303 to the stockpile site, so it is the supplier’s responsibility to maintain the route for deliveries and repair any damage resulting from this contract.

QUESTION 4: Bonding - We note that the solicitation does not include a bid guarantee, performance bond, or payment bond requirement. Please confirm that no bond or other surety is required for this acquisition.

Per FAR 28.101-1, a bid guarantee shall not be required unless a performance bond or a performance and payment bond is also required. As this is a supply requirement / contract, neither performance bonds nor payment and performance bonds are required. Therefore, no bid guarantee is required either.
