• On Page L-18 of the Solicitation, there is a requirement for a pre-qualification letter from a surety required. The requirement requires the bond to be for the project dollar amount plus $10 million. Please confirm that the Government wants this requirement as part of the proposal.

o Yes, we do require the pre-qualification letter from a qualified surety, but the amount is for the project dollar amount only. This will be corrected in an amended solicitation document.

• On Page L-20, (k) Evaluation Factor 2: Past Performance it discusses CPAR’s. It notes: “The government will review relevant reports contained in the CPARS”. In our experience in past USBR proposals, the Government has accessed our company’s CPAR’s contained in the system on their own instead of us submitting them in the proposal but Section L notes that we should provide three reports. Can you please clarify if the Gov’t will obtain reports on their own or if we need to submit three with our proposal?

o The government will obtain CPAR’s in their own in order to evaluate that portion of past performance, if applicable.

• On Page L-10, (L.10 52.228-17) requires an individual surety pledge of assets. Can you please confirm that the Government wants this requirement as part of the proposal?

o FAR 28.203-4 (a) prescribes the Government to “Insert the provision at 52.228-17, Individual Surety—Pledge of Assets (Bid Guarantee), in solicitations that require the submission of a bid guarantee.” A bid guarantee is required in the solicitation and therefore 52.228-17 is required for this proposal.

• On Page L-21, it notes that there is an Excel spreadsheet of Section B, Price Schedule provided in Section J. Additionally, there is a requirement on Page L-22 to provide a Schedule of Values and extensive breakdown that seems suited for a much larger project. Can the Government please confirm that these are all required for this proposal?

o The reference to the Excel spreadsheet is not required. Numerous changes were made to and is removed from the solicitation as part of Amendment 0002.

Furthermore, the extensive breakdown of the schedule of values listed in L-22 has been removed.

• Is a PIV required as part of this contract or are typical Site Security requirements adequate?

o The government does not anticipate the need for PIV cards so long as the time required onsite for the contractor is under 180 days. Per Section H.3 MB-7 Site Security B, The Government may perform background checks on any or all workers.

Work on site will require background checks due to proximity of which work is being performed.

• In Section L.15, Volume II – Technical Proposal, Evaluation Factor 1: Technical Approach, the RFP states, “The contractor, as part of their proposal submittal, shall inspect the Government Furnished Property (GFP) listed in Section 51 00 00 and provide the https://www.acquisition.gov/far/28.203-4#FAR_28_203_4 https://www.acquisition.gov/far/52.228-17#FAR_52_228_17

Government with a list of all parts and/or hardware that must be procured (in addition to the GFP) in order to complete the scope of work.” Would this be more of a contractual work item because RSN 01 64 40-1 requires a Shortage Report be submitted for Government-furnished products, and Section 05 50 00 1.01.A.1.a.1) requires verification of quantities on site? Completing a Shortage Report/Verification of quantities is likely a multi-day effort. Can inspecting the Government Furnished Property be removed as a requirement from the proposal? And will a C.O. be issued for any missing items or items that do not properly fit that require the Contractor to fabricate and deliver to the site?

o The language above was removed from the solicitation.

• Section 01 30 30, Contract Document Management System requires the use of web-based software to manage contract documents for the project. Would a Microsoft Teams database (or something similar) be acceptable to the Government for the CDMS?

o No – Microsoft Teams does not meet all of the requirements of 01 31 30 for this project

• Section 02 83 33 requires the Containment System Plan to be signed and sealed by a South Dakota PE. In our experience in past USBR projects, the plan must be approved by the CIH for the project (which typically assess airflow calculations, level of containment effort required, etc). Would it be acceptable for the plan to be only approved in writing by the CIH as part of the RSN instead of additionally needing a P.E.?

o Please see the amended section 02 83 33.

• RSN 02 41 07-1, Removal and Disposal of Existing Features Plan requires the plan to be approved by a Professional Engineer. Does this approval apply to just the inspection of the existing landings and structure and suitability as a safe working platform or does the engineer need to approve the whole plan including transportation methods and disposal locations? It is our experience that most engineers will not want to review means and methods of the equipment disposal. Additionally, can the P.E. be from another State?

o The Professional Engineer (PE) does not need to be licensed in South Dakota, but they do need to be licensed in one or more states.

• Drawing 276-600-60000, Metalwork General Notes #8 says to scan concrete for rebar at new anchor locations. Will the results of the scans be approved by the Gov’t in the field or will the results need to be formally submitted and subject to the 21-day review time in 01 33 00? This will affect how we build our schedule for the proposal.

o Contractor will need to notify the Contracting Officer's Representative (COR) prior to the Rebar Scan to facilitate an onsite review. No submittal is required as per Section 01 33 00.

• Drawing 276-651-006 shows electrical equipment in the hoist house and is marked “For Information Only”. Can the Government confirm that no electrical or controls work is required as part of this contract?

o Correct, No Electrical work is required under this contract.

• Section 05 52 20 requires the testing, certification, and training on the Government furnished Fall Restraint system. Were these services from the manufacturer included for in the original purchase by the Government or does the contractor need to contact the manufacturer/supplier to obtain a price for this service as part of our proposal?

o Contractor is to adhere to section 05 52 20 for onsite training; Onsite training shall be presented by the Manufacturer’s Representative.

• In Section 51 00 50, in regards to the Electronic Media Release Document:

o Do we need to sign and return this to you to get additional drawings?

o Do we need to sign and return it to send out the drawings to subcontractors?

o Does each subcontractor need to sign this NDA? So we can track who has the documents.

o Do the drawings and documents need to be password protected?

Answer: In regard to the Electronic Media Release Document, this will be signed after award. It is typically used if the government needs to supply CAD drawings for use by the contractor. However, we have no additional drawings for this project that are not already provided for in the solicitation.
