(2) The Contractor shall adjust the minimum wage paid, if necessary, beginning January 1, 2023, and annually thereafter, to meet the applicable annual E.O. minimum wage. The Administrator of the Department of Labor’s Wage and Hour Division (the Administrator) will publish annual determinations in the Federal Register no later than 90 days before the effective date of the new E.O. minimum wage rate. The Administrator will also publish the applicable E.O.
minimum wage on https://www.sam.gov (or any successor website), and a general notice on all wage determinations issued under the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, that will provide information on the E.O. minimum wage and how to obtain annual updates. With respect to workers covered by the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, the Contractor may meet this requirement by posting, in a prominent and accessible place at the worksite, the applicable wage determination under those statutes.
With respect to workers whose wages are governed by the FLSA, the Contractor shall post notice, utilizing the poster provided by the Administrator, which can be obtained at www.dol.gov/agencies/whd/government-contracts, in a prominent and accessible place at the worksite. Contractors that customarily post notices to workers electronically may post the notice electronically provided the electronic posting is displayed prominently on any Web site that is maintained by the contractor, whether external or internal, and customarily used for notices to workers about terms and conditions of employment.
(e) Payroll Records.
(1) The Contractor shall make and maintain records, for three years after completion of the work, containing the following information for each worker:

(3) The Contractor shall make a copy of the contract available, as applicable, for inspection or transcription by authorized representatives of the Administrator.
(4) Failure to comply with this paragraph (e) shall be a violation of 29 CFR 23.260 and this contract. Upon direction of the Administrator or upon the Contracting Officer's own action, payment shall be withheld until such time as the noncompliance is corrected.
(5) Nothing in this clause limits or otherwise modifies the Contractor’s payroll and recordkeeping obligations, if any, under the Service Contract Labor Standards statute, the Wage Rate Requirements (Construction) statute, the Fair Labor Standards Act, or any other applicable law.
(f) Access. The Contractor shall permit authorized representatives of the Administrator to conduct investigations, including interviewing workers at the worksite during normal working hours.
(g) Withholding. The Contracting Officer, upon his or her own action or upon written request of the Administrator, will http://www.dol.gov/agencies/whd/government-contracts withhold funds or cause funds to be withheld, from the Contractor under this or any other Federal contract with the same Contractor, sufficient to pay workers the full amount of wages required by this clause.
(h) Disputes. Department of Labor has set forth in 29 CFR 23.510, Disputes concerning contractor compliance, the procedures for resolving disputes concerning a contractor’s compliance with Department of Labor regulations at 29 CFR part 23. Such disputes shall be resolved in accordance with those procedures and not the Disputes clause of this contract. These disputes include disputes between the Contractor (or any of its subcontractors) and the contracting agency, the Department of Labor, or the workers or their representatives.
(i) Antiretaliation. The Contractor shall not discharge or in any other manner discriminate against any worker because such worker has filed any complaint or instituted or caused to be instituted any proceeding under or related to compliance with the E.O. or this clause, or has testified or is about to testify in any such proceeding.
(j) Subcontractor compliance. The Contractor is responsible for subcontractor compliance with the requirements of this clause and may be held liable for unpaid wages due subcontractor workers.
(k) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (k) in all subcontracts, regardless of dollar value, that are subject to the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, and are to be performed in whole or in part in the United States.

Integrated Vegetation Management (IVM) for Bonneville Unit Mitigation Lands
Utah Reclamation Mitigation and Conservation Commission Salt Lake City, UT
2025 IVM Weed Control for Jordan River, Salt Lake County, Utah.
1.0 SCOPE
1.1 OBJECTIVE
The objective of this contract is to order contractor services to control noxious and invasive weeds on Jordan River lands administered by the Utah Reclamation Mitigation and Conservation Commission (Commission). These lands are shown in attached Maps 1-4.
1.2 BACKGROUND
Titles III and IV of Pub. L. 102-575 as amended (Central Utah Project Completion Act; or CUPCA) establish and authorize the Commission to complete the fish, wildlife and recreation mitigation and conservation program for the Bonneville Unit of the CUP. The Commission has made substantial progress with land and water right acquisitions constituting a substantial portion of the mitigation program. The acquired lands require management, development, and operation and maintenance to provide effective long-term mitigation and conservation. Noxious weed and invasive species plant control is key to achieving the desired fish and wildlife habitat outcomes and improved biological diversity and productivity of native ecosystems. Management of the vegetative community towards desirable species composition is a key component of the acquired lands, particularly in wetland and riparian areas. Weed control and related vegetation management will help to maintain the habitat values being conserved. This approach is referred to as an Integrated Vegetative Management Plan (IVM Plan).

The Contractor must comply with State and local authority, laws and associated regulations and chemical labels and Material Safety Data Sheet (MSDS) information and requirements as associated with any chemical applications.
The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA): No chemicals that are banned or severely restricted under FIFRA will be used under the scope of this contract. All chemicals will be utilized in compliance with their labeled uses and precautions.
Attachment 1 – 2025 Jordan River Invasive Vegetation Management (IVM)
Invasive and noxious weed control on the Commission properties along the Jordan River is shifting to more of a mechanical approach in 2025. The Commission will separately use local students with shovels to pull out the thistles in the spring. This will be followed by aggressing seeding with native and desirable grasses and planting of “habitat patches” with containerized riparian and wetland plant species in specific areas where weeds have been controlled in the past. The contractor will have no role in this effort.
The following guidelines provide the basis for a reduction in chemical use and will be discussed on site with crews prior to any treatments occurring. There are four maps included that provide the specific locations for proposed treatments. No treatments outside of these areas will be conducted in 2025 due to the desire to seed and plant in the other areas across the properties.
Treatment timing
Spring - April to May – depending on plant phenology [flowering stage or pre-seed development] – apply herbicides to treat hoary cress (LEDR), poison hemlock, and Scotch/musk thistle (ONAC) on the Jordan River Migratory Bird Refuge and areas south of 12300 South in Draper on the Colby Property, as indicated on Maps 1-4.
Late Summer – August – mowing Russian thistle (SATR) on Jordan River Migratory Bird Refuge (JRMBR).
Focal species and herbicides
The focus for spring 2025 [April to May] will be hoary cress, poison hemlock, and Scotch/musk thistle rosettes using Opensight™ and surfactant with blue dye. Locations for these applications are shown on Maps 1 and 2. No chemical treatments will occur on either site in fall.
One day of mowing will also be completed south of 10600 South on the JRMBR for Russian thistle in August.
Specific indications
To keep volunteers and students apart from the locations of herbicide applications, treatment locations will be limited to those areas identified on the attached maps. Herbicide spraying by crews will not be allowed in the remaining areas of the properties. If crews have recommendations for additional treatments as they traverse the sites, they should contact the Contracting Officers Representative, and these recommendations will be considered for treatment using Utah Conservation Corps Crews separate from this task order.
No Imazapyr or 2-4,D will be used on the project in 2025. All treatments using non-aquatic approved herbicides will be at least 10 yards from open water and care will be taken to not allow drift into water.
