Statement of Work
Folsom Dam Vessel Exclusion Barrier (VEB) Anchor Repair
1.0 Project Background
The Bureau of Reclamation, Folsom Dam, located approximately 20 miles north-east of Sacramento, CA, has a requirement to repair an existing Harbor Offshore vessel barrier before the beginning of the 2019-2020 flood season. The VEB center section is currently unmoored and being held back from the main dam by the east and west mooring buoys, there is a possibility of the center section being drawn into the radial gates if they’re opened for major flood releases.
2.0 Description of the work
Contractor shall develop two options for the work, one involving complete replacement of the central anchor and one involving repair and reattachment of a line to the current existing anchor. The Government will decide which option to award.
Option 1: Central Mooring Leg Repair
1. Reattach center mooring buoy to center Pearl Harbor anchor located on the lake bottom at elevation 221 feet and return VEB to original location in reservoir. (see attached diagram)
2. Replace 150 feet of 1” wire rope and shackles between the first and second 2000-pound clump anchors (see attached diagram)
3. Replace 200 feet of 1” wire rope and shackles between the first 40-foot section of 1” wire rope and the first 2000-pound clump anchor (see attached diagram).
4. All replacement parts used shall be in new, unused condition and conform to barrier manufacturer specifications.
Option 2: Central Anchor Replacement
1. Place a new anchor unit in position on the Folsom Lake bed to hold the VEB in place.
2. Attach the center mooring buoy to the new anchor unit and return the center section of the barrier to original position.
3. Replace 150 feet of 1” wire rope and shackles between the first and second 2000-pound clump anchors (see attached diagram)
4. Replace 200 feet of 1” wire rope and shackles between the first 40-foot section of 1” wire rope and the first 2000-pound clump anchor (see attached diagram).
5. All parts shall be in new, unused condition and to barrier manufacturer specifications
General Actions
1. Contractor shall dispose of any debris or excess materials in accordance to all applicable laws, rules or regulations.
3.0 Safety:
The contractor will not require any person employed in the performance of this contract (including subcontracts) to work under conditions that are unsanitary, hazardous, or dangerous to the employees’ health or safety. To protect the life and health of employees and other persons; to prevent damage to property, materials, supplies and equipment; and to avoid work interruptions, the contractor will comply with the 2014 edition of Reclamation’s publication “Reclamation Safety and Health Standards”(RSHS) including any up to date errata. The cost of complying with this paragraph shall be included in the delivery order price.
Safety Program: This contract could involve diving operations at depths greater than 200 feet depending on the option chosen by the Government. The contractor will submit a written safety program for review by the Contracting Officer’s Representative. The Contracting Officer’s Representative must accept the safety program before the contractor commences onsite work. Chapter 3 and Appendix B of the Reclamation Safety and Health Standards contain guidance in preparing the safety program. The contractor may access the Reclamation Safety and Health Standards at http://www.usbr.gov/ssle/safety/RSHS/rshs.html. The contractor must designate, in writing, a competent supervisory employee, acceptable to the Contracting Officer’s Representative, to administer the safety program. The contractor must also provide a detailed dive plan conforming to Section 29 of the RSHS.
The Folsom Dam Safety Office will require two weeks before work commences to review the contractor supplied safety plan.
Job Hazard Analysis: A Job Hazard Analysis is required prior to engaging in potentially hazardous work.
The contractor, after consulting with the Bureau site representative, Contracting Officer’s Representative, or inspector, will assess the workplace and work activities to determine if hazards are present or are likely to be present. The contractor will develop a written Job Hazard Analysis for the work per Reclamation Safety and Health Standards, Section 3.3, Required Safety Programs and Section 4.2, Requirements for Job Hazard Analysis. The hazard analysis will define hazardous operations and activities; and identify proposed methods for eliminating or minimizing the hazard. The methods will outline employee training requirements, personal protective equipment requirements, procedural changes, methods for evaluating program effectiveness, etc. The contractor will be required to receive approval of the Job Hazard Analysis from the Contracting Officer’s Representative seven to fourteen days prior to performing the work.
Personnel & Equipment: The contractor must give each contractor employee a written notice containing pertinent provisions of the safety and health program. The supervisor will instruct the workers in appropriate safety measures. The supervisor will not allow the placement of machines or other equipment in traffic lanes. The supervisor will assure equipment will not create a safety hazard due to the manner it is stored or utilized. The contractor’s equipment will meet Occupational Safety and Health Administration standards at all times while working on this project. If the Contracting Officer's Representative determines an item of equipment needs repair or is unsafe, the contractor shall immediately stop using the equipment and provide replacement equipment at no additional cost to the Government during the down times. The contractor must prohibit the use of any machinery, tool, material, or equipment that is not safe and/or does not comply with applicable requirement of these standards. The contractor must identify such machine, tool, material, or equipment as unsafe, by tagging or locking the controls to make them inoperable, or by physically removing it from its place of operation.
The contractor’s employees shall operate equipment in compliance with Federal, State, and local safety codes, and in accordance with manufacturer’s guidelines and manuals.
Reporting Injuries and Illnesses: The contractor will investigate and report accidents, injuries, or illnesses in accordance with Reclamation Safety and Health Standards, Section 3.7. The contractor supervisor will complete Form 7-2077, CONTRACTOR’S REPORT OF RECORDABLE INJURY/ILLNESS, and submit it to the Contracting Officer’s Representative within 72 hours of any incident or onset of illness. The contractor is responsible for providing and obtaining appropriate medical care for injured employees.
Compliance with Occupational Safety and Health Requirements: The contractor must remove employees who refuse or repeatedly fail to comply with safe work practices and standards, or supervisors who fail to enforce compliance.

52.225-09 BUY AMERICAN ACT—CONSTRUCTION MATERIALS MAY 2014
(a) Definitions. As used in this clause-- “Commercially available off-the-shelf (COTS) item”—
(1) Means any item of supply (including construction material) that is—
(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
“Component” means an article, material, or supply incorporated directly into a construction material.
“Construction material” means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.
Materials purchased directly by the Government are supplies, not construction material.
“Cost of components” means--
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.
“Domestic construction material” means—
(1) An unmanufactured construction material mined or produced in the United States;
(2) A construction material manufactured in the United States, if—
(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or
(ii) The construction material is a COTS item.
“Foreign construction material” means a construction material other than a domestic construction material.
“United States” means the 50 States, the District of Columbia, and outlying areas.
(b) Domestic preference.
(1) This clause implements the 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.
(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows: None
(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that
(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;
(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or
(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.
(c) Request for determination of inapplicability of the Buy American statute.
I-5
(1)
(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including--
(A) A description of the foreign and domestic construction materials;
(B) Unit of measure;
(C) Quantity;
(D) Price;
(E) Time of delivery or availability;
(F) Location of the construction project;
(G) Name and address of the proposed supplier; and
(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.
(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.
(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).
(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.
(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.
(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.
(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:
Foreign and Domestic Construction Materials Price Comparison Construction material description Unit of measure Quantity Price (dollars) * Item 1 Foreign construction material Domestic construction material Item 2 Foreign construction material Domestic construction material [List name, address, telephone number, and contact for suppliers surveyed. Attach copy of response; if oral, attach summary.] [Include other applicable supporting information.] [*Include all delivery costs to the construction site and any applicable duty (whether or not a duty-free entry certificate is issued).]
