About this file

This is an Amendment (No. 0002, effective 04/13/2026) to Solicitation No. 140R1726Q0021 issued by the Bureau of Reclamation, Pacific Northwest Region, Grand Coulee Acquisition Group for Law Enforcement Services at the Umatilla Field Office in Hermiston, Oregon.

The amendment adds FAR Clause 52.222-90 addressing Diversity, Equity, and Inclusion (DEI) discrimination by federal contractors in accordance with Executive Order 14398, and provides answers to four contractor questions regarding the Performance Work Statement. Key clarifications include: (1) administrative time spent managing and reporting may be deducted from total contract hours if specifically accounted for in annual summaries; (2) the restriction on taser use in Section C.5.1 has been removed; (3) alternative law enforcement vehicles such as side-by-sides, UTVs, or quads are permitted beyond standard certified law enforcement vehicles; and (4) the 100 percent accuracy requirement refers to log completeness, not monthly hour targets, as weekly patrols must only average 15 hours per week with a non-negotiable annual total of 780 hours. The period of performance is 06/01/2026 to 05/30/2031. All other terms and conditions of the solicitation remain unchanged.

The underlying Performance Work Statement requires the contractor to provide dedicated law enforcement patrol and enforcement services for deterrence and rapid response to public safety issues across Umatilla Project properties in Umatilla County, Oregon. The contractor must supply 780 annual hours of patrols, with an average of 10 hours per week dedicated exclusively to the 222-acre Oxbow Special Use Area and 5 hours per week across other project facilities including dams, pumping plants, and canals. All officers must be sworn, Oregon-certified law enforcement officers meeting Lautenberg Amendment compliance requirements. Key deliverables include monthly patrol/activity logs (due by the 15th of the following month), annual activity summaries (due by October 1st), and police reports (due within 24 hours of generation). Performance standards include 100 percent accuracy in documentation, 48-hour response time for investigation support requests (with only three unjustified incidents allowed annually), and 12-hour notification of property damage or safety issues. The contractor must maintain complete personnel records, provide administrative support, and ensure all officers are fully equipped with uniforms, badges, weapons, and trained in equipment use. Invoice deductions apply for unmet patrol hours, late or missing reports, and failure to meet response time or meeting requirements.

The purpose of this amendment is to:

1. Add CLAUSE 52.222-90 Addressing DEI

Discrimination by Federal Contractors. In accordance with EO14398.

2. Answer the following questions.

Question #1: In the solicitation language, there doesn't appear to be any accommodation for the administrative time for managing / reporting. Will we be able to include time spent by admin in generating the monthly / annual reports to our total hours? This is generally not a large amount of time in some of our other contracts, but it is something we include towards the contract hours.

Answer #1: Yes, this is now in section C.2.3 with text in red.

Question #2: In section C.5.1 - this specifically prohibits the use of tasers.

Although it notes that tasers can be carried by the Deputies, they may not be used. This will be problematic, since use of force is a dynamic and difficult situation to predict, we could not and would not limit use of force options available to our staff.

Answer #2: Section C.5.1 restriction on tasers has been removed.

Question #3: In section C.5.6 - that notes certified law enforcement vehicles...equipped with technology capable of supporting report writing... In some cases we may want to use side by sides or quads, or some other type of vehicle that may not necessarily have this equipment. We have these types of vehicles for other patrol areas, that are marked as Law enforcement - would there be any issues with us using these types of vehicles as part of our patrols of the areas specified?

Answer #3: No issues with this at all. The intent of the wording in the contract is to mean that they have to have appropriate cars

140R1726Q0021/0002 available but aren¿t limited to only using them. A side-by-side would be very useful at that 222-acre property. Additional narrative has been added to section C.5.5.

Question #4: In the Performance Requirement

Summary: There is a monthly requirement of 100

Percent accuracy, along with an annual requirement of the same. Does this mean if we do not meet the monthly hours we will receive a deduction for that month? Typically, we have included in our contracts a provision that basically says if we fall below one month, we increase the next month or months, so we have a balance that meets the required hours at the end of the year.

Answer #4: This is saying that the logs must be

100% accurate (i.e., no missing reports of contacts or incidents). The weekly hours requirement in C.3.1 specifically states that the weekly patrols must only AVERAGE 15 hours per week. The total of 780 hours is not negotiable, but week-to-week it just has to average. For instance, there would probably be less patrol activity in the winter and more in the summer. Paragraph 1 in C.2.5 says they are in charge of setting the patrol hours as long as they meet the contract requirements.

3. All other terms and conditions remain the same.

Law Enforcement Services Bureau of Reclamation

Pacific Northwest Region Umatilla Field Office Hermiston, Oregon

C.1 Introduction The Bureau of Reclamation has a requirement for dedicated deterrence patrol and Law Enforcement (LE) services on properties administered by the Umatilla Field Office (UFO) in Hermiston, Oregon. A dedicated law enforcement patrol presence provides continuous visual deterrence and allows for rapid response to illegal activities and public safety issues. Additionally, the UFO staff may require law enforcement support in the event of an emergency.

C.1.1 Mission The mission of the Bureau of Reclamation is to manage, develop, and protect water and related resources in an environmentally and economically sound manner in the interest of the American public.

C.1.2 Background Reclamation’s UFO is responsible for the administration of the facilities and lands associated with the Umatilla Project. The project includes facilities, structures and properties within Project’s physical and administrative boundaries consisting of the two high-hazard dams, five pumping plants, a large undeveloped property at the edge of an urban area, a field office and maintenance compound, and many miles of canals.

The Contractor shall be expected to enforce State, County, and local laws, ordinances, rules and regulations and to make non-federal arrests and issue citations on Umatilla Project property (proprietary jurisdiction) within the Contractors’ jurisdiction.

C.1.3 Scope The Umatilla Project has no dedicated law enforcement personnel. The purpose of this procurement is to provide visible law enforcement presence for deterrence of and rapid response to public safety issues, crimes, and potential threats in areas on the Umatilla Project for which Reclamation is responsible. Additionally, in the event of an emergency, the Umatilla Field Office or McKay Field Station may require law enforcement assistance in carrying our required Project or public safety duties.

A. The Contractor shall provide 780 hours of patrols and/or enforcement actions per year.

B. Any suspicious person or activity shall be investigated.

C. Enforcement actions shall be at the Contractor’s employee discretion.

The temporary removal shall remain in effect until the incident prompting removal has been resolved to the satisfaction of the Government. Once the incident has been resolved, the individual will either be allowed to return to performance on the purchase order or be permanently removed from performance on the purchase order as the Government deems appropriate.
