About this file

This is a Determination to Solicit from a Single Source document for a federal contract action by the Bureau of Reclamation (BOR), CPN Service-Supply Team.

The procurement is for 9,000 gallons of Exxon-Mobil DTE Heavy-Medium Oil Group I with ISO Grade 68, to be supplied to the Grand Coulee Power Office. The resultant purchase order will be a firm fixed price contract with a delivery date of 30 days after receipt of order. The single-source justification is based on brand-name compatibility requirements. The oil currently in service in the Generator Units is Mobile DTE Heavy Medium ISO turbine oil, a Group I solvent-refined product. Mixing Group I and Group II oils (which are hydrocracked) will cause excessive air entrainment and damage governor filters and valves; the Bureau of Reclamation's Power Equipment Bulletin No. 11 explicitly prohibits mixing these oil types. Additionally, substituting a different oil would require draining and flushing the entire 120,000-gallon system due to proprietary additive differences, and would void equipment warranties.

Market research included searches of GSA, UNICOR, and AbilityOne, vendor contacts, and a sources sought solicitation that received nine vendor responses. Five vendors proposed Group II oils, two proposed oils unsuitable for turbines, and only two proposed the Mobil Heavy Medium DTE product currently in use. No other manufacturer offers a Group I oil meeting the government's requirements. Fair and reasonable pricing will be determined through competitive quotes received in response to a solicitation for the specified brand-name product, consistent with FAR 13.106-3(a)(1).

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

BOR, CPN Service-Supply Team

2. Name and Address of Single Source.

Exxon-Mobil Oil Corporation 22777 Springwoods Village Pkwy Spring, TX 77389

3. Description of Supplies/Services and Estimated Cost.

The Bureau of Reclamation, Grand Coulee Power Office has a brand name requirement for a total of 9,000 gallons of Exxon-Mobil DTE Heavy-Medium Oil Group I with ISO Grade 68.

The resultant purchase order will be a firm fixed price contract estimated at with a delivery date of 30 days after the receipt of order.

4. Description of Circumstances, including why only one source is reasonably available.

In accordance with FAR 13.106-1(b)(1)(ii) the following is the reason only one (1) brand name can meet the Government’s requirements. Mobile DTE Heavy Medium ISO turbine oil is currently the in-service oil used in the Grand Coulee Power Office Generator Units. This oil is a Group I type of oil which means it is a solvent refined based oil. Whereas Group II oils are refined by hydrocracking and have a lower solvency. Mixing Group I and Group II type oils will result in excessive air entrainment and gum up governor filters and valves.

Additionally, Power Equipment Bulletin No. 11 posted by the Bureau of Reclamation’s Hydroelectric Research and Technical Services Group states that under no circumstances should Group I and Group II oils be mixed.

Lastly, only Exxon Mobil’s oil will work because mixing oils will require draining and flushing the entire system which consists of over 120,000 gallons due to the oils having different additives which are proprietary. Mixing oils will also void any warranties.

5. Determination of Fair and Reasonable Price.

(11/2020)

In accordance with FAR 13.106-3(a)(1), prices will be determined fair and reasonable through completive quotes received in response to a solicitation issued for the brand name product specified.

6. Description of Market Research.

The contract specialist performed market research by searching GSA, UNICOR, AbilityOne, and contacting vendors.

Additionally, a sources sought was issued to determine if there were other brands of group one oils which could meet the Government’s requirements. After the source sought closed, nine (9) vendors responded. Five (5) vendors proposed a group two (2) oil, two (2) vendors proposed an oil that is not rated for turbines, and two (2) vendors proposed Mobil Heavy Medium DTE which is currently being used.

Based on market research, no other manufacturer offers group 2 oil that will meet the Government’s needs.
