About this file

This document is a Justification for an Exception to Fair Opportunity (JOFOC) for the Department of the Interior/National Park Service at Mount Rainier National Park. The agency seeks to purchase fourteen 395/85R20 20-ply tires with MV/T tread pattern and Load Rating L for snowplows, with a total estimated cost of $14,700 ($1,050 per tire). The procurement is specifically aimed at matching existing tire specifications for the park's snowplow fleet to ensure consistent performance in extreme winter conditions, with the ability to potentially replace two tires on each side of a truck instead of all four when a single tire needs replacement.

The document details market research conducted through GSA eBuy, which identified one open market contractor, and an inquiry to the Defense Logistics Agency that received no response. The tires are original equipment manufacturer (OEM) specification for the fleet plows and meet brand name requirements under FAR 13.5. The contracting officer plans to determine pricing reasonableness through competition via public posting of a Request for Quote (RFQ) on SAM.gov. The procurement is being processed under PR Number 44018616, with certification and approvals completed on 06/04/2025 by Jim Ziolkowski (Chief of Facility Maintenance) and Hal Hoversten (Contracting Officer).

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Over SAT (FAR 16.505(b)(2))

PR Number _44018616________________________

1. Identification of the Agency and the Contracting Activity: Department of the Interior/NPS Con

Ops West/Mount Rainier National Park

2. Nature and/or description of the action being approved: We are purchasing tires to match the existing tires in order to change out tires on a plow without swapping out the entire fleet’s wheels.

The tires must meet the following salient characteristics:

Size - 395/85R20 20 ply Tread Pattern - MV/T Load Rating - L

3. A description of the Supplies or Services required to meet the Agency’s needs, including the estimated value: These tires, in good condition, are key to the proper function of the snowplows in extreme winter conditions. It is important to maintain the same tread pattern for plow control and function. This tread pattern matches the tread on each plow tire including what is in stock. In a typical winter each of the four snowplows can go through four sets of tires. Market Research has shown the price of the tires at $1,050.00/each; grand total of $14,700 for fourteen.

4. Identification of the exception to fair opportunity (see 16.505(b)(2)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value). The tread pattern on tires are OEM on the fleet plows. If one tire needs to be replaced, we may be able to replace two tires on each side of the truck, instead of all four. We cannot change out all four tires every time we have an issue with one tire. These meet the brand name specification as required under FAR 13.5 under which the RFQ is being issued.

5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The price is anticipated to be determined reasonably through competition through public posting of an RFQ on SAM.gov

6. Any other facts supporting the justification: The proposed tires are OEM to the equipment.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made: Sources sought posted on GSA eBuy identified one open market contractor; an inquiry was sent to Defense Logistics Agency with no response.

8. Certification by Technical or Requirements Personnel:

I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the Government’s minimum needs or requirements or other rationale for an exception to fair opportunity) which form a basis for the justification have been certified as complete and accurate:
