About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition (OTFOC) for a Simplified Acquisition under the Simplified Acquisition Threshold (SAT) to repair and maintain the TTHM Removal system at the Katherine Landing Water Treatment Plant.

The J&A states that the water treatment plant has exceeded the Maximum Contaminant Level (MCL) for TTHM, posing a risk to public health, and the Arizona Department of Environmental Quality (ADEQ) is requiring the government to fix the issue or the plant will be shut down. Due to urgent and compelling circumstances, the government is pursuing a sole source award to Ixom Watercare, the manufacturer of the TTHM removal system, to provide a service agreement for one scheduled site visit and any needed repairs for up to one year. Market research confirmed Ixom is the only source available. The anticipated price will be determined fair and reasonable using FAR Part 13 price analysis techniques.

The related federal contract opportunity is a 1-year TTHM Removal System Service Agreement for the Katherine Landing Water Treatment Plant, awarded to an unknown vendor under Solicitation 140P8125Q0001 by the Department of the Interior National Park Service Pacific West Region.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR

Part 2) UP TO SAT (See FAR 13.106-1)

Date: 10/18/2024 PR Number: TBD

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The purpose of this requirement is to repair and maintain the TTHM Removal system at the Katherine Landing Water Treatment Plant. The water treatment plant was notified by the Arizona Department of Environmental Quality (ADEQ) that the drinking water from the plant has exceeded the Maximum Contaminant Level (MCL) allowable. Servicing the TTHM removal system is one step in reducing the contaminant level below the MCL. This requirement includes one scheduled site visit to inspect and service the machine as well as a service agreement to cover any needed repairs for up to one year.

2. Sole Source Justification rationale (Check one and explain below):

______ Only one responsible source.

___X__ Urgent and compelling circumstances exist.

______ Other _____________________________________________________

Explain: The ADEQ found that water samples from the Katherine Landing water treatment plant had exceeded the MCL. This represents a risk to the health and safety of the public who are dependent on the plant for drinking water. Drinking water exceeding the MCL may lead to adverse health effects, liver or kidney problems, negative nervous system effects, and may lead to an increased risk of cancer. This includes the local population and any visitors. Additionally, the ADEQ is requiring the Government to show that it is in the process of fixing the problem; Otherwise the plant will be shut down. If the plant is shut down, the Government will be required to haul in water to the systems tank and provide bottled water to all residents and visitors. It would cost upwards of $75,000/day to meet the water demand in this area.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

The Government will be pursuing a sole source award to Ixom Watercare. Ixom is the manufacturer of the TTHM removal system used at the plant. Market research including internet searches and information with subject matter experts shows that Ixom is the only business that offers a service contract for this work. Additionally, Ixom is registered as a small business in SAM.gov.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
