About this file
This document is a Justification & Approval for Other Than Full and Open Competition (J&A) for a simplified acquisition over the micro-purchase threshold but under the Simplified Acquisition Threshold (SAT) related to the maintenance of a flash flood system at Lake Mead National Recreation Area.
The J&A justifies a sole source award to Water & Earth Technologies (WET) to supply and install deep cycle batteries on Hydrolynx equipment at remote flash flood signal sites, as well as have a Federal Signal siren technician inspect and diagnose issues with the system components. The total cost for these services is $27,197. WET is the authorized maintenance and installation contractor for the Hydrolynx equipment and has documented the deficiencies that need to be corrected. A sources sought effort returned two small businesses that used WET as a subcontractor, since WET is the authorized Hydrolynx contractor. A notice of intent to sole source was posted. The contracting officer certifies that only one source is available and that the anticipated price will be determined fair and reasonable.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR
Part 2) UP TO SAT
(See FAR 13.106-1)
Last updated 6/2/2016
Date: 7-29-24
PR Number: 40665663
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
Deep cycle batteries supplied and installed by Hydrolynx certified technicians at Remote Flash Flood signal sites across Lake Mead. Additional site visit by Federal Signal siren technician to inspect and diagnosis issues with those components of the system are also required. Total cost of services is
$27,197.00
2. Sole Source Justification rationale (Check one and explain below):
_X_ Only one responsible source.
Water & Earth Technologies (WET) originally installed the flash flood system at LAKE
(140P8120P0105) and is the current contract holder for inspection and maintenance on the flash flood system at LAKE (140P8123P0064). WET is the authorized maintenance and installation contactor of
Hydrolynx equipment (see letter from Hydrolynx in file) and have documented the deficiencies, from the field, to be corrected in the system.
3. Market Research.
140P8123P0064 was issued to WET for inspection, maintenance and testing of the flash flood system at
LAKE. Upon their April site visit, WET discovered multiple deficiencies that were not included in the original contract. The original market research for the 2023 contract included a sources sought effort, which returned 3 responses (2 small business and 1 large business). It was determined to solicit as a total small business set aside. The two small businesses that offered quotes, other than WET, used WET as a subcontractor in their quotes, since WET is the Hydrolynx authorized maintenance and installation contractor.
As this requirement is for more than $25,000, a notice of intent to sole source was posted 7-30-24, per
FAR 5.201(b)(1)(i).
4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
