About this file

This document is a justification and approval for other than full and open competition for simplified acquisitions over the micro-purchase threshold up to the simplified acquisition threshold. The National Park Service Pacific West Region requires the rental of a 14-foot motor grader to open park roads in Death Valley National Park, California for administrative and emergency access after flooding from Hurricane Hillary in August 2023. The anticipated cost is $40,433. Urgent and compelling circumstances exist due to critical infrastructure such as water and sewage systems being inaccessible on flooded park roads, posing a risk to human health. Market research found limited available equipment in the remote area as other agencies had already rented inventory, with only United Rentals confirmed to have a motor grader in stock that could be delivered by September 7, 2023.

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Emergency Heavy Equipment Rental for opening park roads for administrative and emergency traffic after Hurricane Hillary Flood events August 2023.. Anticipated cost is $40,433.00.

2. Sole Source Justification rationale (Check one and explain below):

______ Only one responsible source.

___X___ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

Explain: The DEVA roads were inundated with flood waters from the remanence of Hurricane Hillary.

Nearly all critical NPS systems such as Cow Creek Water System, Furnace Creek Water system, Stovepipe wells Sewer Treatment plan, Grapevine water system, Wild Rose Water System, etc. are not accessible on NPS roads. DEVA does not have enough functional heavy equipment to open these roads both for administrative access to maintain the systems and assess damage after the storm, but also for emergency vehicles to be able to leave the park.

Without urgent action, the park is at eminent risk of more catastrophic and unknown damages to critical infrastructure by not being able to access the areas; such as losing potable water to the housing areas and sewage overflows, which would pose a hazard to human health.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:

Brief market research was performed by performing searches on the SBA Dynamic Small Business Search engine, reviewing past contracts for emergency equipment rentals and identifying business within a 300 mile radius from the remote area of Death Valley that have access to this type of equipment. The storm has left many business with empty rental lots as other agencies and private businesses have rented what little equipment was in the area already.

Oral Quotes were received for limited inventory of required equipment. Brad Metler, the contract specialist reached out to multiple businesses and only two large businesses responded. The two large businesses capable of providing the referenced motor grader is United Rentals and Cashman Equipment.

Cashman can provide a motor grader, but they have all been rented out and they do not have a timeline as to when they can provide the motor grader. United confirmed that they have a motor grader in stock and will be able to deliver to DEVA on 09/07/0023. Therefore, I determine that it is in the best interest of the
